Youmans, Esq., of Edae field. J_*_ THE HOT SPRINGS.-Wo print this morning an advertisement announcing the opening for the season, on June 1st, ot the famous Hot Springs, Bath County, Virginia. Mr. P. M. Quarlcs, tho travelling agent of tho Hot Springs, informs us that all the buildings have been repaired, painted, and titled out with new furniture, linen, beds and t ible ware, and the Springs offer unsurpassed attractions to both tho invalid and pleasure-seeker. The terms aro $3 per day, $20 per week, and $75 per month. THE MAZYCK-STREET HOSPITAL.-By invita? tion of tho Burgeon in charge, Dr. J. Somers Buist, the members of tho Medical Association visited tho Mazyck stroot Hospital yesterday, and were conducted through Ibo various Wards. The condition of the hospital, which challenges comparison with any similar insti? tution in thc country, gavo great satisfaction j to the visitors. During their stay Dr. Buist performed, iu* highly satisfactory manner, I an amputation. Thc new addition to the hos? pital was also visited. THE iErNA Picnic at thc Schweizenplatz, yesterday, was a most enjoyable affair. Tho company in all numbered about two hundred and fitly persons, a largo proportion ot* whom were ladies. Dancing, lunches anti shooting for tho priz?-a silver butter dish-'.vero tho entertainments of the day. Tho prize was won by Mr. Thos. Watson. PLEASING INCIDENT_The formor servants Of Mr. McNellage, who was buried yes'orday, asked as a groat favor to be permit tod to carry the remains of then- old master to the grave. ASSAULT WITH A COOPER'S ADZE.-Samuel Hazel, (white,) while walking on Vendue Bange yesterday, was set upon by two dogs, one of which took hold of him. In order to get rid of the dogs be threw a brick bat at them. This incensed ono Hagerty, who made at Hazel and assaulted him with a cooper's adze, and would have serionsiy injured him but for a bystander. Early yesterday morning a writ of quo war ranto was served on Alderman Greene, who, as tu tho oase of Alderman Barrow, is said to have removed from tho ward which ho was elected to represent, thotoby vacating his omeo. This writ was made roiumablo yesterday at 10 P. M., when Aldermen T. J. Mackey, Barrow and Groeno appeared by counsel boforc J\ asociale Justioe Willard. When tho court was opened tho relatora were represen lcd by their ouuael, B. C. Pressley, Esq., and Sam'l Lord, Esq. T. B. King. Ejq., appeared for Alderman Greeuo, and Mr. 0. C. Bowon lot Aldermen Mackoy and Barrow. Mr. C. C. Bowen movod that lt. P. Thariu, Esq., bo admitted to practice in thc courts of tho State, that ho might appear as ono of tho counsel for Aldermen Mackey and Barrow. Judge Willard decided that Mr. Tharin could bo admitted tor tliis particular case, but not for general practice; aud Mr. Tharin was so ad? mitted. Mr. Tharin then movod that the writs against AJdoriuen Mackoy and Barrow be dis? missed, for tho following rcaaons : 1. The writ being issuod against a member of a parliamentary and legislative body which has adopted tho rulos of tho United States Houso of Representatives, the question is coram nan juaUice, because tho City Council ouly havo tho right to Judgo ol'tho qualifica? tions of their own monibors. 2. The Constitution of the State, adoptod Marcar?, 1863. repeals the act ol' 1818, in Article 8, section 7. Tho residing in thc ward is no longer required. 8. The act of March, 1, 1809, validifying the election, was an act passed under the consti? tution now in force, and heneo applies to tho ucw teum-o-of-oflice, having cured foiover all irregularities "alleged" by tho adhorents to tho anciont tenure. Mr. Pressley said that these pleas should be made the return ot thc defendants. If this were not dono, tho defendants would by those pleas be ablo to test tho feeling of tho court on the main facts of tho case, aud would, if tho court woro against them, be ablo then to mako a formal return to tho writ, which would bo equivalent to having two trials of tho sub stauco of thc eise, and a great disadvantage to tho relators. Mr. Tharin sail that the defendants did not mike a return to the writ, but pleaded lo the jurisdiction of the court, which they had the right to do. The City Council alone could de? cide tho matter, for they were tho only judges of tho qualifications of the?r membors. By them tho question must bo heard, adjudicatod and finally determined, and to them it should havo been submitted. Mr. Pressloy explained the effect of tho pleas put i i by tho doi'euco, and cited authority to provo that a writ ot quo warrante could not be dismissed cr quashed, no re!urn to tho wiir having been made. Judge Willard said that if the defendants were right, a resolution of C, uucil or an ordi? nance of Councd would baye the power to oust a case from tho highest court, in tho State. Mr. Thariu said bc was not prepared to show by what statute Council was given the autlioti ty to determine the qualifications of its mem? bers. It had that power under the genera! law of the State, aud of tho United States; but he had not had time to find the particular statute. Nor had bo any authority to show that the writ might be dismissed as a plea to the jurisdiction of the court. TudKojyillard said that ho would hnhl to tho auihoritpeited byrne relators, and ruled that the respondents must make a return to the writ. Mr. Bowen asked that the caso be continued to Monday morning, to give the defendants time to make their return. Mr. Pressley opposed this motion because City Council was hurrying up matters in suoh a way as to make necessary a speedy determi? nation of the case if any good were to be ac? complished by it. Council was holding night? ly sessions and reading bills three times atone meeting. This might be right or wrong. Council might be doing good or harm. But as persons who were believed to b ? disqualifi?e! were taking part in the- proceedings and mak? ing laws, it was absolutely necessary to have their right decided without delay. He was will? ing to give the defendants just as much time as they desired, if they would not, ponding tho decision of the court, proceod lo exercise tho powers which it was claimed wore unauthor? ized. But if the parties were resolvod to go on until stopped by tho courts, there should bo no postponement in the hearing of tho case. Mr. Bowen. CIRCUIT COURT-CHIEF JUSTICE CHASE, PRESIDING. - * At ll o'clock precisely, yesterday morning, his Honor Chief Jushoo S. P. Chase and his Honor Judge Biyan, conducted by Mr. Epping, United States Marshal (Mr. Johnson not hav? ing yet qualified,) entered and took their seats upon thojudgo's stand. Tho first case taken up was tho case of in rc. John Odom, bankrupt, ex parte J. H. Hud sou. Motion to reverse order of District Judge establishing tho validity of a note the consideration of which wa3 tor the purchase of slaves. C. W. Dudley and William Whalov, Esqa., appeared for appellant; Messrs. CP. Townsend and J. Brrrett Cohen, Esqs., contra. The case involves the validity of a noto given for slaves in 1833, Judge Bryan having decided in favor of the note. The argument was opened by Mr. Dudley for appellant. Messrs. Townsend and J. B. Cohen followed in reply. Air. Whaley closed on the part of appellant. The next case in equity was that of the South western Railroad Bank vs. Edwin Parsons, E. P. C:ottand others, being a bill for injunction, direction and reliof. Messrs. W. A. Priiisrle and Edward McCrady, Escrs , for thc bank: Messrs. Yeadon, Dougherty and Mcrumiugci contra. Mr. Pringlo lead tho bill and affida? vits and addressed the court. Messrs. Yeadon and Memmitiger read the answer. Messrs. Yeadon and Memminger followed in reply tc Mr. Pringle. Previous to the hearing of the above case, ou motion of Mr. Yeadon, Wm. Dougherty, Esq., a practitioner in tho United States Courte of Georgia, was admited to pricti^e ia thc United Slates Courts for South Carolina. In reply to Mr. Memminger', tho Chief Justice stated it was not his purpose to call either ol the dockets regularly, but to have the bar in? dicate to tho clerk such cases aa they desire to Jtave placed unon the spacial docket. Th?j> might then be taken in their regular order, taking the appeal docket first. He desired to accommodate tho bar as far as practicable, and if they can agree among themselves as to what cases they desiro to have submitted to a full court, they may be given to the clerk, to be taken up in their order.
