Judgci Carpenter Decides against Clarn -Pilli*??ry to bo Scalen J o-fl?y. On Saturday morning Judge Carpenter de? livered Ids opinion in tho contested elootiou caso between Aotiug Mayor Clark and tho present Aldermen, and Mr. Pillsbury and his Aldermen. Judge Carpenter roviows the wholo case and argues it in an able maiiDor, citing authorities in support of tho position which he takes. Tho following extract, which forms the conclusion of tho opinion, is all that the gonoral reader will caro to soe: The line of distinction, running through all tho authorities, is between pubho and private corporations. Over the former the legislative control is supreme, while it is not so over tho latter. The manifest reason is that the char? ter of a private corporation constitutes a con? trol between it and tho government,and vested rights acquirod uncter the aot ot incorporation are as sacred as private rights vested by any other law. And this is also true iu regard to rights of property in a municipal coiporation: bocnuHo to the extent that suoh legal rights bave become vested under tho charter they are doomed private corporations, and are placed upon tbe same footing. Honoe the Legislature could not require the property ot the city to bo sold and the proceeds paid into the public treasury, for the reasons that con? tracts have been made, debts oontiaoted, pro? perty purobased for specific public uses, and theso among others have become vested rights under the chat tor. j The aot of March 1st, 1869, does not amend the charter. It makes an election tegular and valid which was before irregular and defective. The State government had constituted certain persons its political agents to conduct the election; they conducted it in an irregular and illegal manner. The conditions upon which it should have been held were prescribed by tho political powers of the State; tho same powers might have neglected to require the perform? ance of those conditions beforo the eleotion, had a right to waive them afterwards, deem? ed it expedient to do so, and d.d make it valid and legal. The power conoedod, the expediency and propriety of the measure, are considerations exclusively for the Legislature. The statute it unambiguous, its language explioit; the law has spoken,and it becomes my imperative duty so lo decide. According to the views I have taken of th< case,' the first and fifth pleas are bad in law though true in fact, and the issues joined arc wholly immaterial. The demurrer is sus tai net to tho second, third and fourth pleas, and over ruled as to the sixth plea. The relator wil have leave to repicad as to tho first and fiftt pleas, and upon doing so in a pro Dor manner judgment of ouster will be rendered a gains, the respondents. ? am not insensible to the magnitude of the questions discussed and decided. Financial and commercial Interests, of vast importance, hav< been enlisted ; party feeling, passion and pre? judice invoked; but however desirable it maj bo to foster the former, and curb the latter they are matters with which, as a judge, 1 havi no conoern. It is not my province to deolan an act of tho political departments void unies it is so beyond a reasonable doubt. He mus be a bold man who would affirm that this ac is within that oategory, after a careful exam m ation of the 'authorities. I am not that mar Fully aware of the public interest felt in thi case, I have given it tho most careful and ans ions investigation, and honestly and firmly re ly upon tho accuracy of my conclusions. I re fleet with satisfaction upon the fact that thi decision is not final, and that if I am in orro the moro mature judgment of tue Suprem Court affords an ample correction. Au should that court arrive at a different con elusion from my own, it will bo my duty an pleasure to oxoouto tho law aa expounded b the highest judicial tribunal in the State. By this it will be seen that Judge Carpentt decides unequivocally that Mr?*Pillsbury an his Aldermen ore entitled to their offices undi act of the Legislature of March 1,1869. Son amendments to the pleadings of the relat?) were ordered before the final judgment of ons er was pronounced. As soon as they wei made by the counsel, the writ was issued ac served on the Mayor and Aldermen individi ally. Tho Pilot Boy is a fine;? staunch steamer, and has lately been ov hauled. Sn o is said tobe ono of the fast boats in Southern waters, and there is o two and a half or three hours of sea passage the trip. Captain Peck, the commander of i Pilot Boy, is a well-known and experiem officer.
