AN A OT TO OBOANIZB AND GOVERN THE MILITIA OF THU STATE OF SOUTH CAROLINA. SECTION 1. Be il enacted by tho Senate and Houso of Representatives of tho State of South Carolina, now mee and sitting in General As? sembly, and by the authority of the same, That all able-bodie I malo citizens between the ages or eighteen and forty-five years, residiug in thiB State, and not exempted by the laws of the United tates, shall be subject to military duty, excepting 1st. All perBons in the army or navy or volunteer torces ot tho United States. 2d. Regularly ordained or licensed ministers and preachers of tho Gospel. 8d. The Lieutenant-Governor, members and officers of tho General Assembly, the Secretary Of State, Attornev-Goneral, Coinptr aller-Gene xal, State Auditor, Commissioner of Bureau of Agricultural Statistics, Superintendent ot Edu? cation, State Engineer and Surveyor, State Treasurer, and clerks and employees in their offices, judicial officers of the State, including Justioesot the Peace, Sheriffs, Coroners, Con? stables, civil officers of tho United States, ferrymen employed at any ferry on a post road, and millers. ?th. And all persons entertaining conscien? tious scruples against bearing arms, practicing Ehysioians, irofcssors, teachers and students l oolleges, academies and o amnion schools. 5th. Persons regularly and honorably dis? charged from the army and navy of tho*United States in oonaeqoen30 of tho performance of military or naval duty, in pursuance of any law of this State, ?nd all persons who now are, or may hereafter be, active members of re Sularly. incorporated fire companies in this tate. 6th. That commissioned officers who shall have served aa snob in tho loyal militia of this Btate, or in any of the United States, for the epaee ot seven years; but no such officer shall be exempt unless ny his resignation attor such term of service, duly acoepted, or in some other lawful manner be ahail have been honorably discharged. 7th. Idiots, lunatics, paupers, and persons ' convicted of infamous crimes, shall not be sub-' jeot to military duty. SEO. 2. That under tho directions of the Com? mander-in-Chief, all persons liable to military duty within this State, who are not already members ot the National Guard, as hereinafter provided, shall immediately upon tho passage of thia Act, and from timo to time thereafter, as the Comm >nder-in-Chief shall deem neces? sary, but as of teu as once in every two years, be enrolled. * Such enrollment shall distinctly specify tho names and residences of the per? sons enrolled, and shall also divide the t ame iu to two classes-the persona between the ages of eighteen and thirty years to constitute the first class, and the parsons between the ages of thirty and ?ortv-flve years to constitute tho second class. Four copies of suoh enrollment shall be made by the officer making the same, one ol' which, attor being corrected, shall be re? tained by him; another shaiTtfB"2Red in the office of the Town or City Clerk in which such com? pany is enrolled; another shall be filed in tho office of the olerk of the Courts of Kee ard in the County whore such district is situated; and the (fourth shall bu fited in the Adjutant-GeuaraTs of? fice. The persons-making such enroilment'shah* bo compensated at the rate of one doll<u* and fifty cents per day for every day necessarily spent in making and copying the same, the number of days not to exceed ten ; aud tho amount of such compensation shall be paid by the Treasurer of the State, upon production of the certificates of the clerk ot the Courts ot Eeoord in the Caunty and of the Adjutant General that snob roils have been duly filed, 00 or before the first day of February, iu each ?ear, in whioh snob enrollment shall be made : Tovided.thit the Commander-in->uhief may, if he deem it necessary, extend the term c ? com {?leting the first enrollment under this ac', not o exceed twenty days, and authoriz J payment for the same, as heretnbofore specified and sst forth. Ssa 8. That all persons duly enrolled, who shall negleot to attei.d the musters and drills provided tor in this act, except in cases of sickness, shall be subject to a Ano of one dol? lar i'or each day so neglecting, which if not paid to the county treasurer on or bo.ore the fifteenth day of March next ensuing, shall be collected by the collector or receiver of taxes ?f the city or county in which the person so neglecting is enrolled; and the Board or Coun? ty Commissioners, at their annual meet.ngs are authorized and directed to annex a list of the several delinquents, with the fines sot op? posite their respective names, to the assess? ment rolls of the several towns and wurdi; and the warrants for the collection of the sane eb all direot the collector or receiver of taxes to collect the amount from every porsou appear? ing, by the said assessment roll, liable t > pay the same, in the esme manner as other taxes are collected; the same to be paid to too Coun? ty Treasurer. And when the name of any per? son ho twee 11 the ages of eighteen and twenty one years shall appear on tho said roll liable to {>ay the said fine, tho sa<d warrant shall direct he collector to collect the same of tbe father, Kardien, or employer with whom such person all reside or be o n ploy ed, or out of any pro? perly such minor may own or possess in the city, village, town or ward in said county; and such collector shall proceed and execute such warrant, and no property now exempt from other executions shall be exempt from the pay ment of suoh fine. SEO. 1. ihe County Treasurer of each coun? ty Bball, on or before the twenty-fifth day of April in each y.-ar, pay to the Treasuier of the State, upon his orders, the actual sum received from delinquents who hive laded to attend such musters and drills; and it shall be the daly of the officers commanding tho several regiments, to furnish the County Commission? ers the names who have failed lo attend snob musters and drills. The County Commis* sioner shall givo the names of the poisons 00 failing to the county Auditor; and no lesa they are excused, shall place an extra assessmautof one dollar per day on their general tax, if a property holder; and in case said delinquent or any of them are not property holders, then he or they shall be comp ailed to work the public roads, at a rate not exceeding one dollar per day. 8?o. 5. SEO. 7. SEC. 9. That all persons claiming exemption shall tile a written statement of tho same, ven? ded by affidavit, in tho offico of tho Town Clerk of tho township in which ho resides, on or before tho fifteenth day of January; iii do fault of which, euch person shall lose the bene? fit cf suoh exempt-ton, excopt suoh as aro espe? cially exempte I by thia act or by act ot Con? gress. SEO. 10. That tho person makin r such en? rollment shall, theroupon, if such person bG exempt according to law, mark tho word "ex? empt" opposite the name of each pers >n pre? senting such oxomption; if mich exemption bo permanent., tho name of such oerson sbaU not be included in any subsequent enrollment. If any person shall swotr falsely iu such affidavit, he shall, upon proof thereof, be adjudged guil? ty of porjury in any judicial court of compe? tent jurisdiction. BEG. ll. That tho persons thus enrolled shall form the reserve militia ot tho' Statu of South Carolina ; those over eighteen and not over thirty years of ago, shall constitute tbe reserve of the first class ; ind those over thirty and under forty-live years of ago, shall coustituto the reserve of tho second" class. SEO. 12. That if any officer charged with any duty under the provisions of thin act, Bhall re? fuse or neglect to perform any of tho duties required of him by this act, ho shall forfeit and pay tho sum of not less than titty nor moro than one hundred dollars tor each and every offence, to be recovered in the name of tho people ot the State of South Carolina; and such officers shall, OB an additional penalty, bo deemed guil:y of a misdemeanor ; and it Bhall bo tho duty of the solicitor of tho judicial cir? cuit within wu ch said offender roaides, upou the complaint of tho commanding officer of the regiment, or on tho part of tho Board of Coun? ty Commissioners, to prosecute the same. Any penalty incurred aud paid, or collected under this section, shall be paid into tho treasury of the county, for the uso of tho military fund of tho county, whore tho fund may have accrued. SEO. 13. That the Adjutant-General, under the direction of the Commander-in-Chief, shall organize and apportion the militia, und the districts therofor, into divisions, brigades, regiments, squadrons, troops, batteries and oooipanies, and cause the same to be number? ed and lettered as nearly in conformity with the laws and regulations governing the army of the United States as circumstances will per? mit, and may after divido, annex or consolidate the same, and the districts thereof, as ho may judge expedient. SEX 14. That the organized militia of this State shall be known as the National Gifcird of the State of Sou Ji Carolina, and shall consist o fauch divisions, brigades, regiments and bat? talions, and in addition thereto, such batt eries of light artillery and troops and squadrons of cavalry, as tho Commander-in-Chief may deem expedient ; and nothing herein cont lined shall be so construed as to interfere with the p aver of the Gomniandor-in-Chief, in case of war or insurrection, or of imminent danger thereof, to order drafts of the militia and to form new reg? iments, battalions, brigades or divisions, as he may deem just and proper : JProvidtd, That tfaero shall be no military organizations, or formations, for the purpose ot arming, drilling, exercising the manual of arms or military ma? nouvres, not authorized under this act, and by the Commander-in-Chief, and any neglect or violations of the provisions of thu) section shall, upon conviction, be i unishod with im? prisonment at bard labor in the state Peniten? tiary, for a term not less than one year, nor mora than three years, at tho discretion of a compe? tent cour . SEO. 15. That an Assistant Adjutant-General may be appointed, if deemed necessary by tho Governor, by and with the advice and consent of the Senate; his salary shall be at the rate of fifteen hun ired dollars. The duties of Quar toimaster-Genoral shall devolve upon tho Ad jutaut-G lierai in times of peaoe. SEO. 16. That in case of invasion, insurrec? tion or ebelliou, or imminent danger thereof, the G J vernor" shall appoint, by and with the advice and c >n ?ont of the Senate, a Qaarter tnaster-General, Commissary-Goneral, and a Surgeon-General. . SEC. 17. That the arms, equipments and mu? nitions of the State shall bj stored under the directions of the Commander-in-Chief, and in such places as he may Jesignate. SEO. 18. That all officers of the militia (ex? cept as heroin provided, t shall be appointed and Comm?8Sionpd by the Governor. They shall draw pay only when engaged in actual service. SEC. 19. That all commissioned officers .of the militia shall be appointed and commission? ed by the Crm^nauder-in-t hief, and may be removed from office on rccommondati >n by the oommanding officer of their respective brigades and divisions. Removals may also be made by decisions of court-martial or re? tiring or examining boards, pursuant to law, and tor misconduct any officer may be sus? pended by the Commander-in-Chief. SEO. 20. 1 hat the militia of this State shall he mustered and drilled at suoh times as the Commander-iD-Chief or commanding officers of divisions, brigades and regiments may di? rect.
