D., of this city, having graduated with distinction at the .ental College of Baltimore, will soon commence tbe practice of his profession in this bis native State. Mr. Winkler was a pupil of Dr. Patrick, the widely known Charleston dentist, and his tborengh training sud mechanical skill should enable him to attain a high position in the important profession which he has chosen. BBYAN, PRES_>INO.-The petition of G. K. Byan, assignee of sundry bankrupts, was referred to Registrar Carpenter to call in lien creditors before 22d April, who shall then show cause why the sale Of real estate shall not be made; and further, that the Registrar shall report, Ac. R. B. Carpenter, State Circuit Judge, Quashing thc Writ. THE STATE EX. REL. GILBERT PILLSBURY, ET AL, VS. THE ACTING MAYOR AND ALDERMEN OF IHE CITT OF CHARLESTON-MANDAMUS-IN TUE COMMON PLEAS, CHABLF8TON COUNTY. In answer to this writ the respondents do certify and de-lare unto the court, "that they do not sur? render unto said persons thc properties and offices a'oro-aij, because thoy say that they are in posses? sion of said offices, having been adnitted and sworn under appoiutments and elections duly made, and that ma damus ia not, therefore, the proper remedy of -the petitioners." lue respondents, in further answer to the Faid writ, set forth the title i.nder wh ch they claim to hold their respective offices; they traverse the aeve ra! allegations made by tee petitioners as thc grounds upon whi-h th'-y are entitled to the writ, and which are recited in the ulternative writ; and they far? ther aver that the net of the Legislature, ratified on thc Ut day of March, instant, under the provi? sions of wkich the petitioners- claim .to be entitled to these office", is in violation of chartered rights of the cerporaters-ol 'he- city, and. aleo of the Con? stitution cf the State and of the United States, in several .particulars, and therefore inoperative and void. Upon the filing of this return the petition er?' counsel asked for time to plead, which wai granted. the pe ti-iou er s then filed a general demurrer to the respondents' return. The demurrer of the peti? tioners admits all the al legation a of the respondents' return, which are.properly pleaded, and would seem to put in issue the sufficiency in law of their cause shown by them for not obeying the mandate of the writ, but at the beariog the argument was confined to the question made in the first section of the re aponden'.s' return-is mandamut the proper remedy lor the petitioners ? The other questions raised in the respondents' return mare waived, nor were they admitted; but as the same quesiions hid been made in the pleas to tho writ of quo warranta against the same respondents issued and returnable at the same time and at the instance of the same relators, which was set down for hearing at a later day, the argu? ment was not had upon these questions, hat was re? served until the hearing of the quo warranta. The question discussed at bar, and nowt? be deci? ded, is a narrow and f ormal one, and does not go to the merits of th? case. It is not disputed that maniamus is the proper remedy against a public officer, who neglects or re? fuses to do some duty which the law enjoins upon him, and in which the petitioner or relator has an interest in and riyht to have done, and where there is no other remedy which is tull, appropriate and* adequate. The question i* whether this is such a case. On the part of the respondents it ia contend? ed that it Ls not. because they are in possession of the offices which the writ commands them to vacate and surrender to the petitioners de facto, *nd by color of ri^bt; and that theiemedy of the petitioners ia upon an information m the nature of a eui war? rant*, in which their tide will be put in question, and upon which the ju 'cm-nt ls of ous'er irom the offices held by them; asd that this remedy bas been already granted to tl:* petitioners by this <rourt. 1 ho petitioners, on the other band, claim that it ia the duty ot the respondents, required of them by law, to vacate their offices, and surrecder them to the petitioners-and that they can never obtain possession of these offices, even if there ebould be a ju igment of ?utter upon the quo war rania, except by mandamus, which is the only ade? quate, therefore the proper nmedy. The books speak o? mandamus as used to admit or 'restore to an office; bat it must bs borne iu mind that when used for this purpose lt ia directed to an officer or officers whose duty it ia to admit to the office claimed by the petitioner. The writ itself as? sumes the person to whom it is,di re.-ted to be an officer, and to continue in office in order to perform the duty icquired of bim. But when the office sought is filled by one claim? ing it in his own right, mandamus is not the remedy for one claiming against th? incumbent. In such a cos*tho clarmont, if entitled io the relief of the court, must obtain it through a quo wirrmnto. To illustrate ibis diatioction in the present caso, if the Acting Mayor and Aldermen of ch arie-ton should refuse to allow one to exercise a public office, to which ho had been elec ed by them, he would, upon a proper casft made, be entitled to a mandamut, com? manding them to admit him; but where the pell tioners seek tor themselves the offices of which thc Ac tm- Board axe in possession, they muse seek re? lief by a quo warranta, and not by mandimu*. This writ not only commands the Acting Mayor and Al? ai moen to surrender certain property, but vacate their offices. The authorities upon this point are numerous and decisive: "lhc court will refuse, to graut tho writ of man? damus if it appoir that the applicant has a remedy by information iq the nature of a quo warranta. Thus a rule tot a mandamus to admit a recorder was refused, because it appeared there was a recorder de facto, and. therefore, the applicmt had such a rem- I edy. For the consequence of vranting a rule in auch a case would be, that a second person would be ad? mitted to an office already filled by another, both claiming to be duly elected. "The court will, however, in some caaes, grant a mandamut, although the title of the officer to whom the nui' damut ia directed is questioned by tho pen? dency of an information in the nature of a quo war? ranto, for it may be collusive ; but if the prosecutor ff tilt quo vHtrranto be also the applicant for tte man? damus, it it otherwise." (Tapping on Mandamus, p. 27.) "When sn office or franchise ia full de facto, and another person disputes tho validity of the election .r appointment, Ina remedy is by a qua warranto in? formation, aod mt by a mond imus " >*If the elec? tion were doubtful, and fit to be tried upon an infor? mation in the nature of a quo warranta, tho court ought not to gnat ti mandamus." "If such ouster and election bebona fide, the court will not grant a man? damus in favor of the party displaced ; the proper proceeding is by a quo warranto against tho porty holding the office defacto." "Where the aldermen and assess irs of a ward in a borough bad deolared ?, B or C to be cte ly elected as councillors, and they accordingly took upon then selves the effice, and made daclaratioa required by law. ?ad acted as councillors, the court refused a mandamus to allow Y and Z to acidas councillor?, even as<>um<ng that they ought to have been declar? ed duly elected, for the office waa full de facto -of A, B and C. Mandamus to admit a recorder was refused, be? cause there was a recorder de facto, and the party had another remedy, by quo warranto. There both of thom claimed under the some election. (Bex. vs. Mayor of Colchester, 2 T. B.. 259 ) The writ ha? often been made use of in modern practice to admit or restore to an office, and the rule, as above laid down, seems *o have been unchanged. But when an office is filled by a perso? who had been admitted and a ?om, and ls iuby color of right, a man-iamut is never issued to admitanother person. The proper remeJy is by a quo warranto. The distinction as above shown between manda? mus and quo warranto, under the practice iu this State, is fully au?taiued iu State vs. selvre. (7 Hich., 234, and coses there cited ) But it ls Bald that even if th-re should be judg? ment of ouster upon tbe quo warranto given against the respondents, tbey could not be compelled to Bur render the books and property except by a manda? mus, and that, thereiore, it is the proper remedy. The couit will not assume that in case of judgment being pronounced against them on the quo warranta the Acting Mayor and Aldermen wo ul I so rei use; but even if tbey should do so. the remedy would be ample without mandamus. Ibo petitioners then have anolber remedy, appropriate, tull and adequate, and, therefore, mandamus is not the remedy. The petitioners' counsel contended that thc ?ct of the Legislature having declarad the peti? tioners entitled to the office* held hy iuv respond eai.'. Being made as a return to an alternative wn>, it is held to be sufficient why a peremptory writ shall no; issue. A fair of-the Plymouth Church, colored, is being held at the Military Ball. The much-needed filling on the sidewalk in But lcdge-ffroet, near the bridge, is being laid down. Thc up-town guardhouse is receiving, inside and out, a new coat of color-wash. To-day the floral decorations of the churches for Paster will commence. Bev. John Bacbman, D. D., pastor of St. John's Evangelical Lutheran Church, has issued an address setting forth thc necessity of enlarging the church. McCarthy, long and favorably known in the retail dry goods trade of Chorioston, who, for same time past, has added greatly to the popularity of the old stand at tbe southeast cornor of King and Wentworth streets, is having his establishment thoroughly reno? vated. The repairs, painting, Ac,, have necessarily interrupted his business a little for a few days, sad he will close entiroly for at least a part of Saturday.
