Two cracks have oponod in the roof of. the tunnel, buf. it is believed that no permanent injury has been done. -Secretary Seward, it is Btated, is making arrangements tor an extended tour of travel, which ho proposes undertaking On the expira? tion of his term of office. Tho journey will be across the Continent to California, and from , thence through the Republics of South America. -It ia said that the New York savings banks aro beginning to invest to a considera? ble extent in Southern securities. On Thurs? day thc Wall-street quotations of South Caro? lina stocks wore as follows: South Caro ima sixes, 72a73; do. ?ow, 70a71; do. registered stock, 62a65. -The pardon of Dr. Mudd, though nob yet ?granted by the President, is considered all but. certain. Tho recommendal ions for the pardon are very strong, one alone containing over five hundred names, being those of every officer aud soldier on duty at Dry Tortugas. It is said tbat his attention to tho sick at that place during the prevalence of yellow fever has won . for bim tho gratitude of all, who earnestly join in the recommendation to Executive clemoncy. ( -Manton Marble, the editor and owner of ' the New york World, is said to be a hard-work- ' ing, indefatigable man. Those who know his habits say he is a marvel -of endura noe. -There have been a great many singular de- ' velopments connected with tho Rogers mur- I dei', the latest of which is unfolded in the nar- , rative of Mr. Everett B. Delano?, formerly a, ( detective officer in New York. Some time last fj year ho was first mate on board of a steamer which numbered among its deck hands a fel- 1 .low named James Manar. Between Delanoy 1 and Manar an intimacy sprang np, and the' ' latter, being in a destitute condition, was pre- ' sented by bis friend with a felt hat and a dark i blue flannel coat? Both'men afterwards left ? tbe boat, and their association began gradually . to die out. On the morning after the Bogers . morder, Delanoy met his former friend in Uni? versity place, tapped him on the shoulder, and said, "Jun 1" "Jim" sprang as though he had' ' been shot, and before Mr. D. could express his 1 surprise at this, and ask an explanation, a j fri eu J accosted him; anti "Jim'' slipped away. This circumstance, the fellow's name, and some other straws, gav? ibo ex-detective ah idea. He sought ont Sergeant Lowry, add re? quested permission, to examine the hat and ?oat which had belonged to tho murderer, and > identified then) at once as the articles which ho had given to Mah ar. Of course the latter was sought out and arrested. -A New York letter of Wednesday says : - "Our business mon generally take a hopeful view of the trade prospect, and expect a m nob better season when the spring opens than the last one. They look for a groat increase in the trade of the South, where ?he people are much better off pecuniarily than they were a year ago, ami they also expect a better and healthier trade with the West than they have had for some years. In anticipation of an ac? tive season, the- importers have sent muoh larger orders abroad than they did last year or the year before. And the import entries this year thus far shaw s great increase ovor those of the same period in 1898. Last week? for instance, they were more than double those of the same week in 1868. It is possible that our merchants are too sanguine, but certainly they are a great deal more hopeful than they were a year ago, and they say their advices from tho South and ?West Bro encouraging. The New York city trade has been so Knob overdone during the past few years that it is not likely to be par? ticularly profitable, either to retail or, whole* .ale dealers, for some time, but the bnt of town -trade, and especially that of the distant sec? tiona named, is expected to make tip for de? ficiencies at home. A few weeks will probably show whether the expectations sf importers and jobbers, in regard to activity in the sprint, are well founded or not." -A very large and fashionable audience was present at the opening of Mr. Edwin Booth's ' theatre in New York, Wednesday evening. The play selected was "R meo and Juliet;" bnt be? fore it had commenced Mr. Booth made his ap* pearanoe before the audience, and tn a few woll selected remarks referred to tb? calamity which nearly two years ago deprived the community of. bia services, and of his Hibseqnont resolve to build, a theatre .worthy of the Metropolis and tho drama. Mr. Booth divided the favor or the audience with Mr. Edwin Adama, and both were called before tbe curtain. Mies MoVicker's Juliet was injured by timidity. Sbejworoa. white satin skirt, hooped with pearls, and cut pompadour, trimmed with silver bullion fringe; a pearl neoklaoo and a tiara- of diamonds, and her long black bair flowing. The Nurse of Mies Fanny Morant was a perfect suooess. Tho scenery is described as absolutely perfect. Some fault is found with tho theatre itself, which, "though a splendid triumph Of up? holstery and mechanical contrivance, is not in any high sense a work of art." The most glaring defeot is a want of lobby-room. ! " "i. iiii CHARLESTON. MONDAY MORNING. FEBRUARY 8, 1869. Thc Debate on the Charleston Blectton nm. The debate in the State Senate on Thurs? day last, on the motion to postpone the consideration of the Charleston Eleotion hill to Tuesday next, developed the fact that a strenuous attempt is being made to paBS the bill as a strictly party measure, without regard to its constitutionality, jus? tice or propriety. Mr. Corbin wanted to know ?whether "the law is to be enforced,"-the question which the State is now asking of the Leg? islature; and he also wanted to know whether "money influence and big names "are to rule, contrary to principle, law "and justice," while tho State asks of the Legislature whether "party is to rule, "contrary to law, justice and the State Con? stitution?" Mr. Corbin declared that he oould show that.the hill was "wise, just "legal and right." This he may be able to do in the Senate chamber; but this he can? not do in any court, or before any tribunal in the State, where argument may be met by argument, precedent by precedent, and simple assertion by the irrefutable logic of facts. . But the speakers who preceded Mr. Cor? bin did not confine themselves to declaring that the law was meet and just, and, ?there? fore, should be passed. Mr. Allen told the Sonate that they might postpone the bill if they were willing to be trampled upon by the Acting Board of Aldermen, and called upon them, if they intended to assert their rights as legislators, to act upon the bill at once. As far as we know, the Acting Board of Aldermen is composed of inoffensive men who desire to trample upon no one, and least of all to wound the sensitive feel? ings of a worthy brother Republican. They did but perform the duty which the law of 1868 devolved upon them. They decided that there had been no legal Municipal eleotion in this City. They did not declare, contra? ry to law and evidence, that Pillsbury and his Board were duly elected. This is the head and frsnt of their offending. -And what the rights of the Senate, a legislative body, have to do with a judicial question-a question which has been before the courts and which is confessedly kepi out of the courts at this moment by the friends of Mr. Pillsbury, because.a learned judge cannot hear and determine a grave question as quickly os senators may vote when they hear the crack of the party whip,-Mr. Allen' did net venture to explain. But whatever may be the thoughts of certain senators, Ihe people know that,, in tho words of Mon? tesquieu, "there can be no liberty if the "power of judging be not separated from "the legislative and executive powers." They knew that "were the power of judg "ing joined with the legislative, the life "and liberty of the subject would be ex " pos ed to arbitrary oontrol; for the judge "would then be the legislator." And the Senate will remember that their actions 3innot be hidden from the broad light of lay. They and their pretended laws will be arraigned at the bar of public opinion,. .' md this question of the rights of the Sen? kte, as opposed to thc rights of tho people, be tried by the test of the Constitution of, the State, by the law* pf the land, by an au? thority' superior to' any which even Mr. Allen and his colleagues possess. Nor will this bs done out of opposition to ; Mr. Pills? bury alone. The is me new is not between Mr. Clark or Mr. Pillsbury; it is whether the Legislature of the State is to accumu? late all powers-legislative, executive and judicial-in the same hands-an accumula? tion which may justly be pronounced "the "very definition of tyranny." Mr. Allen? in thc course of his specob, also asked whether the lawyers and press of Charleston and the Democrats of that oity did not "declaro in advance that they "would not abide by tho election if Mr. . "Pillsbury was successful ?" Our reply is that stich a declaration was not made by either the lawyers, the Democrats or the press of Charlestop, but that a declaration was made, aa it is made now, that they would and will abide by the results of a legal election and thc decisions of the courts of thc State, jj whatever those results may be. Beyond this they will not go. Beverly Nash, the odored senator from Richland, followed Mr. Allen, and said em? phatically that hs was not willing to leavo "the rights of the citizens of thc State (t. e. "Pillsbury) te the courte, judges, or any "particular individual/- and that thc mat? ter should be settled "without any regard "to thc Supreme Court, District Court, or ?Any other court." Also, that if Pillsbury and his. Aldermen were elected, as wa? shown by the highest number of votes, he wanted them "put into office, if it required "the Governor to call out the whole force "of the State for that purpose/ And ats? -and ihiR is the key-note of the whole de? bate-"this matter is tho life of the party, "the Republican party ' in Charleston. It "depends upon it." He was in favor of tbs bill? not only because be believed it to be right, but also "as a party measure." The threat of calling out th? whole force' .? th? State to install Mr. Pillsbury wiU hav? no effect here, but it proves plainly enough that this senator is ready ^o usurp th? functions of th? Executiv? as welt as those of th? Judiciary. It is not enough i that the ultra-Radicals should be tb? law-' I makers and the judge? of tho Stale. They will not be satisfied unless they ar? th? It is- no- rhetorical flourish now- to say that the Radicals in the General Assembly ate striving with might and main to over? ride the organic law which they sad their party framed; hut, whatever the conse? quences, there will be for us this consola? tion at least-that by their violence, their . disregard of law, and their working "out? side the constitution," these Radicals will seal the fate and seoure the downfall of their party.
