Charleston mandamus case. It is nqw believed
that the opinion of Chiof J?stice Moses will
also be iu favor of the claimants.
It is understood that Governor Soott,upon
toll consid?ration, has determined to issu? the
bonds for the redemption of tho notes of the
"Bank of tho State Before the Legislature
passed the law, thoy had the opinions of some
of tho best le^l ?da of the State as tc its
liability , and subsequently a resolution to post
pone their issue was laid on the table. The
Attorney-General having given an elaborate
opinion as ta tho duty of the Governor in the
promises, ho fools cotnpollod to carry oub tho
views of the law-making ppwer, and the bonds
will-he accordingly issued. ..

At the lato conference betwoen Lord Cl?ren
Ion and Mr. Burlingame, at which the agree
ment was made, which has been already tele
graphed, Lord Clarendon, in roviewing his
former conversations, fully acknowledged tho
propriety and j?stico of the several points
which Mr. Burlingame had advanced in refer
ence- to the policy which he deemed desirablo
that England should pursue.
Mr. Burlingame held that tho objects of tho
present mission showed evident signs of pro
gress, and by no means evinced a retrograde
disposition on the part of tho Chinoso Govern
ment. Ho also deprecated the practico of
Western Powers in using an unfriendly pres
sure to introduco new systems and new ideas
among a people whoso knowledge of foreign
nations was of recent origin, and who were
nurtured under a traditional system to which
they were accustomed, and attacked because
such repressive policy would tend to revolu
tion and repress progress, whereas the Chinese
Government fully admitted the necessity of
progress and desired to encourage it gradually
without a sudden shock to the feelings, pas
sions or prejudices of the people.

from foreign nations, and assured Mr. Burlin
game that England did not desire or intend to
apply any unfriendly pressure in order to in
duce China to advance more rapidly in her in

Chinese people.
The tolegrnph reports a severe earthquake
at Tabreez, in Persia. No loss of life re
ported.

In view of the questioned authority of Mr.
Johnson's amnesty proclamation, the following
extract from Mr, Lincoln's proclamation, dated
December 8thi i8o3, is important: "Whereas,
in and by the Constitution of the United States,
it is provided that the President shall hav?
power to forant reprieves and pardons for
offences against tho United States, ex
cept yi oases of impeachment, &c; and
whereas, the declaration of Congress for
a limited and conditional pardon accords
well with the established judicial exposition of
the pardoning power," &c. The declaration of
Congress to which Mr. Lincoln alludes inciden
tally has been repealed, but it is claimed that
Mr. Lincoln based bio amnesty prorogation on.
the constitution.
The Election Committee are absent, investi
gating the New York election frauds.
It iav stated that tho Frocdraen's Bureau
furnished tho negro ' Monard, who claims a
seat in Congress as successor to Colonel Mann,
transportation to his home in Louisiana.
The Militia bill was signed to-day by Wade
and Colfax.
The printers of the Grant and Colfax Club
presented General Grant with a congratulate v
letter. Grant's reply was confined to thank, i.
Two negro men were found dead in the
French Min'stor's house this morning. No

thousand volunteers there were twenty-six
thousand troops employed iu defending the
frontiers, guarding the Pacific Railroads, and
fighting the Indians.

Ten thousand copies of Commissioner Wells'
Internal Revenue report were ordered to be

A petition was received from the Virginia

of Georgia, setting forth tho condition of af
fairs, and asking congressional interference.
Morton introduced a bill forbidding tho land
ing of submarine cables without the consent
of Congress. Referred to the Judiciary Com
mittee. *
The resolution referring tbe President's am
nesty proclamation to tbe Judiciary Committee
was adopted.
Stewart introduced a bill reconstructing
Georgia, and rescindait; iho act of July 25,
1868, so far as it applies to Georgia. It retains
all tho officers of the Stale and members of the
Legislature, except those disqualified by th
Fourteenth amendment. It provides for tbe
reasecmbliug of the convention in March to
amend the constitution, which shall be sub
mitted to the people and then to Congress.
Meantime the Georgia Government shall be
provisional. Referred to the Judiciary.
Tho claim of Miss Sue Murphy for property
used for military purposes was discussed.

Tuesday, and will, it is believed, remain in ses
sion till the latter part of February of first of
March, when no doubt there will be a general
clearing out for Wellington to .witness the iuw
