M'."RID, December ll.-The proposals of capitulation mado by the insurgents at Cadiz were rejected. At the expiration of tho ai mis tice hostilities were recommenced, and a des? perate conflict took place, in which artillery was used by the troops and tho insurgents. The loee in lolled and wounded was heavy on both sides. The result was indecisive. The insurgents still occupy the Hotel de Vide and the surrounding district. The rebels have de? tained within the Hotel de Ville ull the foreign consols they could seize, and hope by this means to be able to prevent the threatened bombardment of that'portion of the city by tbe vessels of war lying in tho harbor. Great po? litical excitement prevails in Xeres, Malaga and 1 erragolia- General Prim is now on his way to the Southern provinces, in the hopo that bis presence there will restore tranquillity. PARIS, December 12.-The Gaulois asserts that the insurrectionary movement at Cadiz ie instigated by agents of Isabella. Midrid dispatches, dated Thursday, say a large number of workmen employed by the j municipality on public works, armed with car-1 bineo end ba> onets fastened on sticks, assumed a, threatening attitude, which they still main? tained. The national militia was ordered to proceed against them. WASHINGTON, December 12-The President hoe approved the bill to remove the disabilities of Chief Justico Moses, of South Carolina. Jadgo Meses leaves to-day for his State, and will immediately enter upon the dischurge of his Judicial duties. There is a heavy pressure lierc to have the .Freedmen's Bureau continued beyond January 1. The Reconstruction Committee oppose its continuance. Colonel J. B. Robb has been herc eomo ten days looking after the postal interests of Geot gia and Florida. Ho has been successful in secreting a weekly Hervice on the coast between Savannah and Jacksonville, Fla. Supervising inspectors of floating crafts bave been ordered to thoroughly investigate the re? cent collision on thc Ohio. RICHMOND, December 12.-In the United States Circuit Court this morniDg, Judge Un? derwood presiding, thc case of Sally Andersou (colored) sentenced to death by thc County Court for arson, was brought up on hab?a? corpus, on tho ground that one of the ma? gistrates composing thc court which tried her had held thc office of constable before tho war, and thereby baing disqualified by tho Fur.tccnth amendment, thc whole court was illegal and its proceedings vitiated. Judge Underwood sustained the prisoner's plea and discharged her from custody. In ce livering tho opiuion, he said that if even a clerk of thc court was disqualified it vitiated the pro? ceedings. There are one hundred and fifty nine convicts in tho State prison sentenced since thc adoption of the amendment, who may nov.- bc released by habeas carpus and turned loose under this decision. HAVANA, "December ll_Thc- Diario to-day publishes the following news from tho interior : The Spanish troops at Manzanillo, reiuforced by sailors from the men-of-war in the barber, had a short skirmish with the insurgents near the to.vn. Ten of tho latter were killed and many wounded. Tho troops captured a large number of horses and some important corres? pondence. The government loss ie not re? ported. The Diario also states that since the battle at Cabre and Quantanamo, four hundred rebels have voluntarily given themselves up to the military authorities and received pardon. Tho Revolutionists flatly contradict those state? ments, and report that they are constantly ror ceiving reinforcements of men, tr ms and am? munition. Within a week about fifty young men, some of them of the first families in the island, have left Havana to join the rebellion. Spaniards hero continue to subscribe money and furnish recruits for tho government. Green, of tho Third Circn rendered an important decision yesterday, the case of ono Jenningo of Loxingtou Couul It appears that Jennings wai tried and so tenced by a military commission, in April, 18i He was confined in Fort Macon, North Cu lina, by order ot Goueral Canby. Recently, accordance with instructions from tho W Department, he was transferred from Fo Macon to the jail in Ricblaud County in tl State. Messrs. Bachman and Watics, yest? day, sued out a writ ol' hab?as corpus to brir him before Judge Gro:-n. Thc case was boa at twelve o'clock yesterday. Counsel for prl oner contended that no sentence of a milita j commission could be executed by the prese i State anthoritios, and that thc duty of b Honor was to discharge the prisoner. This raised tho question of the legali of tr?ale by military commissions. Tl State was represented by Attorney-Gen ral Chamberlain, who claimed that the se lenee of military commissions stood upon pr cisely thc same footing as tho sentence of cn tribunals under tho provisional Rovornmen and were to be executed in the samo mann so soon as the prisoners were turned over t tho United States to the State authorities; thi the only remedy for tho prisoner in the prosoi instance was by an appeal to Executivo den ency. The point is a very interesting one I lawyers, and ono upon which they aro niue divided. His Honor ?ulgo Green held di tinctly that the position ta'sen by tho Attorue General was correci. and that he had no ai thority to interfere with the execution of set tences pronounced by military officials. In the Uuited Statis Court to-day thc cat of Professor Charles Bidford va. Alexandf McBco, ct al, excited much interest. It was bill for relief and account. Messrs. Sullivan i Stokes, of Newberry, appeared for cotnplaii ants, and Messrs. Easiey & Wells for d?font ants. After thc hearing of able and eloquot arguments on both sides, an order was pz^sc referring the whole case to tho Uuited State Commissioner, to report certain points thcrci specified which tho court deemed not sufi ciently elucidated. Thc case is a suit on a bond given by th Baptist College to tho complainant, who wa pat to act as president of the institution, tc servicos rendered as professor for himself an lady. Tho defence was that tho complainant wa wholly incompetent, and the institution sun rapidly, realizing nothing, mainly on ace om of tho president's incompetency. Thero wer rispectable gentlemen testifying to bis thoi ough competency, and others cqual'y respoc! able testifying directly lo tho eoatiary, whic rendered tho necessity of thc order of rofercne more imperative.
