THE BROAD-STREET WHEELBARROW CHANGES .irs BASE.-Che Broad-street News Depot has . changed hand?, and Courtenay's down tewn book store will soon be numbered with the things of the post. After the death of the late Mr. S. G. Courtenay ihe stock was not re? plenished, and it was the design of the ad ministrators to clo3e out tho business. This has now been effected. Mr. Hiram Harris V having purchased the establishment, will J transfer his printing business to it. Tho lower story will bo used as a salesroom and the printing material be kept in the upper story. The blue wheelbarrow, the well known sign of Mr. Harris, has also wheeled into line, aud will now bc stationed in future before thu door of No. 9. AFTER THE STORM.-Tho excitement of the election left tho public pulse in a feverish con ditton, tho victors being olatod with their triumph, while the defeated paity were in censed at tue frauds used to control the re? sult. The streets were comparatively clear during tba day except in the neighborhood of the Courthouse, where a crowd of lazy negroes hadcollected waiting fir something totara up. The protest was the principle topic of conversion, and Parson Cain, Marshal Ep ping, B'.loy and others wno were looked upon as traitors to tho cause, were reviled and abused .by th J embryo colored politicians. These de duded darkies are Jiving in the expectation of a futuro state of bliss when they will become pensioners ot tho city bounty, and now await the realization of their dreams, lhere lives oro spent in idlonoss, and they ore ripe for any mischief-a ents?nne to society, and deserving to be arrested as Yagronts. BEAL ESTATE SALES.-Messrs. Leitch & Bruns sold, yesterday, for J. W. Gray, Master in Equity, a plantation in 8t. John's Berkeley, known as Claremont, containing one hundred nod twelve acres-seventy-four swamp and >tiirty-cight acres of high laod-for $5225, one quarter cash, the balance in one, two, three and four years. A lot at the southeast corner of Mcoting street and Horlbeck's alley, mea?uring forty? -six feet front, by one hundred and fourteen deep, for $3000, one-half cash, balance in one year. The plantation known as the Oaks, situated on tho Waccamaw Eiver, containing fourhun . dred acres; also, a tract of land known ss the Turkey H-.il Soa?hore, and one known as tho Boone Savannah tract, for $1600, one-quarter cash, balance in ono, two and three years. RADICAL MISRULE EXEMPLIFIED-RESISTANCE TO LAW.-Ye3terday a darkey named Quash Howling amused himself by the intellectual amusement of beating his wife. His iib ob? jected strenuously to his pastime, and took out a peace warr.mt aga'nst her liege loid. This was served by two white constables, who arrested thc wife-beater. Quash no sooner found himself within the clutches ol the law than ho showed that his na no was no mis? nomer by bellowing like the bull of Bashan. His cries attracted the attention of tho colored .Courthouse loungers, and they, wLh ono accord, rushed to th3 spot with clubs uplift Dd in defenco of their howling brother. Notwich standing tho violence of tho crowd and thc ^frantic efforts of the prisoner to escape, tho -constables bungon, although one of them was cut in th> face. A rescue would have boon -effected but for the timely arrival of Lioa'enant Minott, of thc police force, who took tho howler io thc Guardhouse. Tile Election Protest I THE POWER ASS DUTY OF THE CITY COUNCIL IN THE PREMISES. It is somewhat remarkable that in tho ac', of the Legislature, uuder which tho Municipal election of Tuesday last was held, tbcro ia no provision made for a new election under any circumstances whatever. In calling attention to this fact it is not our purpose to express an opiuion, much less to impress an opinion on others; for an opiuion on tais matter, to bo worth anything, should be the result of elaborate examination by coun? sel learned in the law. Wo merely wish to sug? gest some itieas which have occurred to us on reading th'^act, which may not have occurred to others, and which it might bo unfortunate to have suggested at too lato a stage of the proceedings in protest. The only words of the act diroctly rolating to any dissalisfactiou which might bo felt in re? gard to tho result of an election held under it are the followiug : The Managers of Election shall decido con? tested oases, subject to the ultimate decision of the Boards ot Aldermen or to aldous, when organized, except wheo the elecliou of a majority of thc persons voted for are contested, or the Managers charged with illegal conduct, in which case the returns, together with the ballots, shall be examined and tbs caso in? vestigated by the acting Board of Aldermen, who shall declare the election, and their de? cision shall be binding upon all parties. Tho only other provision having any bearing upon the d?cision of an election is that re? quiring the officers elect to be inducted into office on the Monday following tho eloction, which would seem to require that the Board of Managers or Board of Aldermen, as the caso might be, should make their decision on or before the said Monday. Now, it ha9 ocourroi to us that there is no provision made hero for a protest properly so called, bnt only for the defeated candidates contesting the seats of their successful com? petitors. In other words, that this act pro? vides no remedy for the public who may bo ag? grieved by tho result of the election, but only for candidates, who, having beon rightfully electo 3, are deprived of their seats by fraud or mistake. If this view is correct, tbcro is no right of protest, under this or any other law, for tho act expressly declares that tho decision of the Board of Aldermen "shall bo binding upon all parties." The power ot the Board of Aldermen is thus limited to deciding a dispute between two candidates as to which is elocted. If A is not elected, B is, and there is an ond of ?ho matter. No need for a new election. Thc duty of the Board of Aldermen under the act, in this view of the matter, is plain. They must examine tho election in all its details, and give their decision in favor of thc candidate who, in fboir opinion, has tho greatest number of legal Totes. They mast, with dae regard to their oath of offioe, declaro either Mr. Pillsbury or Hon. H. D. Lesesne to ba Mayor of Charles? ton. If the circumstances of the case aro such that they cannot constitutionally declare either party to be olected, for example, if a number of tho ballots havo been destroyed, os is said to be the case in the present instanco, it will be their duty to declare that the election has been without result; for it is not to be sup? posed that the Legislature would require them tu make a decision against the truth. But even then they have no power to declaro a now elec? tion. This is a defect in the law which can only be remedied by a new act. A. Wright, one of thc most experienced landlords in thc Southern country. Ile had pre? viously, influenced by sim'lar considerations, voted for Seymour and Blair for President and vice-President, and for Colonel R. W.
