It is almost impossible for us to follow the
involved processes bj which the Attorney
General arrives at very doubtful conclusions.
?.I am not prcparod," "nor am I prepared" to
give a positive opinion, seems to be the refrain
with which most of the paragraphs of ingeni?
ous logic end.
The two questions which have by far the
largest practical interest are, of course: 1.
Who are executive and judicial officers of a
S tat a ? and 2 : what is engaging in insurrec?
tion or rebellion, and giving aid and comfort ?
Now as to the latter, it is unquestionably a
correct conclusion that a person who gav? aid
and comfort to the enemies of the United
States in the war with Great Britain of 1812,
or in the war with Mexico in 1847, is disquali?
fied, but for ?ll practieal purposes the At?
torney-General might as well have gone on
and told us whether the members of the Hart?
ford Convention were disqualified or not. We
believe that there are two or three of that
venerable generation of Federalists still totter?
ing down the hill in knee breeches and silk
stockings, and they may really feel an interest
in the question whether they can bold office

The Attorney-General takes the position,
which we think impregnable, that " when an
insurrection,by its continuance and power, takes

Tito principle is sound enough, but how AS to
the application? Upon what principle does the
Attorney-General hold that a "conscript" is not
disqualified, but that thc Major-Gcneral. who
commands him is t Are they not both forced into
service by the law of thc dt facto government ?
?? the mere alacrity with which what is admitted
to be a binding law is obeyed, a sufficient distinc?
tion, and if so, why is not thc test to be pushed
further and the respective spirit with which
two conscripts may have discharged their du?
ties, bc made thc test of disqualification? The
truth is, upon the Attorney-General's principle,
the whole population of tho South were cou
scripted, for the law of the land made it the
dut; of all men between certain ages to serve
. in the army, and the mau who " volunteered,"
and the man who waited until he was sent for,
were doing precisely the same thing, obeying
the laws of the de facto government which con?
trolled, them. If a judgment ia binding in
nocent whether made by the debtor himself or
actually enforced by the Sheriff.
Is a surgeon of the army disqualified, or is
he saved by the following generality: "The in?
terests of humanity require such officers for
the performance of such official conduct in time
of war or insurrection, as well as in times of
peace, and the performance of such duties can
. never be considered criminal." Morally crimi?
nal, certainly not, but whether legally
criminal is Jthr. question which the general
principle appealed to does not solve, unless its
force bc admitted tb "a much wider extent than
the case itself.

Attorney-General he is not,, disqualified: but
suppose the father furnishes a horse for that
.son to join thu cavalry, is thi? giving aid and

The fact is, and the obscurity of this opinion
is perhaps the most striking of illustrations,
that tho Reconstruction Act was based upon
principles so repugnant to right and justice
I that any attempt to correct its fundamental
wrong by principles of correct legal interpre?
tation, only makes eon fusion worse con-'
founded.
. With regard to who are to be considered ex?
ecutive or judicial officers of tho State, it is
scarcely worth while to follow the opinion.
There are certain officers whom the Attorney
General thinks disqualified, about whom no?
body has ever felt a doubt; while, as to tho
doubtful, thc Attorney-General is not yet pre?
pared to decide. Wc suppose the most latitudi?
narian construer of the Act, never supposed
that it included Commissioners of the Poor,
Commissioners of the Roads, &c,-upoa which
cases the Attoraoy-Geueral is as clear as we
ure. As to the really doubtful cases, tho At?
torney-General is waiting for au abstract, and
we will imitate his example aad wait also.
While we cauuot profess to bc satisfied with
the opinion, wc recognize fully that the diffi?
culty has arisen from the fact that thc views of
.the Attorney-General .as to what is law and
right, differ essentially from thc precepts upou
whioh the law itself is bused.

miro and adopt the vocabulary thus made to their

by our beet scholars and writers to s teni this cur
rout, and numerous treaties havo been writton re?
cently, pointing out vices of style and expression,
but as loug as Doctors of Divinity, members of '
Congross, and other high dignitaries, are guilty of ,
this cruue, we cannot reasonably hope to seo it <
