'- Mr. NICHOLAS HAUMOHD, of New Marion, Ind.,
was struck by k'ghtoing on the morning of the 4th
instant.- Mr, HAMMOND -was alone in a meadow at

hoar, and when discovered was entirely divested,
ofM^'.cfo?ung,.feyen. to his boots, which were'
: either torn or burned off him ; one of them waa

found. At latest accounts, Mr. HAMMOND was yet j
alive, but there was no prospect of his recovery.
Boring the last week there were 405 deaths in
New York City and the public institutions, and 105
in Brooklyn. The .per cen tage in both cities, ac-I
cording to Dr. H VRRTB, continues to show the delete- j
rious effects of the present tenement house sys- j
tem. The presence of cholera is not reported in j
any of the large cities of Europe, and we may rea-']
son&bly expect that the commercial towns in the
Mississippi valley will be the only sources whence
pestilence can reach New York the present year. ?
The Gonzales (Texas) Inquirer, a few weeks ago, 1
said that the Mayor of that-town bad draped the !
publie square in black, on account of the passage
of tlie Sheratan Bill, which placed the country
_ under military trule, General. GRIFFIN took the

of its payment in a summary manner. He called

it down. Ho was arrested and committed to jail in
dofault of $1000 bail. . _ __

j The order of Gen. GRIFFIN, issued in Texas,
is one of peculiar significance and deserves
the consideration of our people. Ita purpose _
and its effect are to exclude from the jury box ;
every man who cannot take the test oath, and
of course to supply their places with,' "?nyn.1
men" and freedmen." " ' " .

and by the laws of the United States it -is the
prerogative of the Judge of tho United States
Court to apply thc test oath to a Jury in his
discretion, and upon motion to that effect -by:

lenge is also given to any party for the cause
that the Juror challenged has participated . in
the rebellion.
It scarcely needs comment to explain to '
what enormous abuses an extreme application
of such laws must lead. The only qualification '
of a Juror in this" State is thc .payment ' of j

man who pays his taxes' is legally qualified to
sit on a jury. There are facts which it is imr.
possible to remove, and which, therefore, it is-j,

us - practically and - clearly the extent of the
great change from slavery td freedonij a change
which we have to ace opt,-not as the acquiescence
in an abstract proposition,- but as a revolution

Let us admit what we cannot deny--the right
of the freedmen to eit upon-tho jury .as any

In criminal trials, we have all felt that while '|
trial by jury, may be a defence bf tho innocent,;
it is almost ludicrous to: consider it as a means |
of correcting the guilty. ' In civil trink tho ex?
perience, of every suitor and every lawyer, will
testify."to its uncertainty. The recent: openly, j
expressed dissatisfaction of some of the leading
English legal authorities, goes' oven further. r,\
But it seems to ns imperative now) that if I
the Jury box is to be opened to all classes, that j
additional precautions should be.taken to. se?

In North Carolina a citizpn must be a free?
holder, possessed of fifty acres of land in order :
to be qualified as a Juror, and while wei do not j

tion, we think auch qualification of Jurors, as
is ' secured, by' the possession of a certain ]
-amount of ?ducation, and. such an amount of
taxation as indicates thrift, hohe sty, and
steady industry, absolutely necessary. - - - - : ''
