opinion of Mr. Justice Davis against the constitu?
tionality of the trial ol' citizens by Military Courts
the following paragraphs appear: It can never be
in a country of written constitutions, with a judi?
cial department to interpret them, that anv Chief
Magistrate would be so far forgetful of his dutv
as to order the elocution of a man who had de?
nied tho jurisdiction that tried and convicted him.
The caso afterwards had been brought before
Federal Judges, with power to decide it. who
being npablo to agreo in the grave question it in?
volved, had, according to known law, sent it to
tho Supreme Court of the United States for deci?
sion. But even the suggestion is injurious to
thc Executive; aid we dismiss it from further
consideration. There is therefore nothing to
hinder ibis Court from an investigation of
the merits of this controversy. The control?
ling question in the caso is this: Upon the
facts st? ted in Mulligan's petition and exhibits
filed, had the Military Commission mentioned in
the exhibits jurisdiction to sentence Mulligan, ho
not being a resident of the rebellious States or a
prisoner of war-a resident of Indiana for twenty
years past, and never in the military or naval ser?
vice-is, while at his home, arrested' bv the milita?
ry power of the United States, imprisoned, and.
on cort.in criminal charges brought against him,
tried, convicted and sentenced to be hanged, bv a
Military Commission organized under the direction

diana. Had this tribunal tho legal power and

question was over considered by this Court, nor
ono which moro nearlv concerns "thc rights of the
whole people; for it "is the birthright of every
American citizen, when charged with crime, to be
tried and punished according to law. The power
of punishment is alone through the means which
the laws have provided for that purpose, and if
they aro ineffectual, there ia an immunity from
punishment, no matter how grave an offender the
iudividual may be, or how much his crimes mav
have shocked "thc 6ense of justice of the countr'v
or endangered its safety.

Paraphino Manufactory of W. R. Winch Sc Co.,
corner Richards and De^awaro streets, South
Brooklyn, and the adjoining Oil Refineries of

ed last evening. Loss $300,000. Two men were
bumed-fatally it is feared.
M. de Montholon, late French Minister, and
family, sailed in the St. Lawrence yesterdav.
Georgo Schleget, a lithographer, lias been ar?
rested on the charge of having engraved a counter?
feit imitation of the label of the Longworth Wine
Manufacturing Companv, Cincinnati, to be used
for furthering tho sale ot spurious American winos.
He was held to answer the charge. Five or six
civil suits arc ponding against alleged manufactur?
ers of fictitious wines.
A German journeyman shoemaker was murdered
in Thompson street last night by a negro. The af?
fair is wrapped in mystcrv. Noarrests have beon

NEW YORK, December 31.-Thc steamship Anda?
lusia, wh:ch startod for Charlesion, returned hore
with her cylinder broke.
Advices from Panama state thnt the Amorican
brig Jack Miljacket, Capt. Dawes, from Singapore,
was seized at Aspinwali by the United States
Consul under suspicious circumstances. She loft
Singapore for Molbonrne, with a carero of specie
consigned to Melbourne, Australia, for which
voyage her papers were made out in regular order.
Thc vessel was originally built in the United States,
and was afterwards transferred to the British flag
bv tho American Consul at Singapore. Thc Consul
al Aspinwali reserved the vessel and placed a
guard of marines from the U. S. ship Mackinaw on
board. The Captain had previously disposed of
his cargo, but the purchaser declined to fulfill his
agreement on hearing of the circumstances.
The steamship Henry Chancy, from Aspinwali,
brings $000,000 in treasure.
BOSTON. December 31.-While discharging tho
steamer Saxonia, at this port, from Philadelphia,
two boxes containing four dead bodies were found.

Gen. J. \ Reynolds has been placed in command

WASHINGTON, December 30.-Tho Courrier des
Etats Unis, of yesterday, explains tho non-rc
ccption of Mr. Seward's cable dispatch of Novem?
ber 22. It was presented to the Minister of
Foreign Affairs bv Mr. Bigelow, but was refused on
account of its rudoness. Mr. Bigelow argued that
what was nido in French is very polite in Enirlish;
to wliich the French Minister replied that it was
useless to discuss such a paper from a Govern?
ment that did not regard its own stipulations of
ncutralitv, and instanced thc occupation of Mata?
moros. Bigolowth?n telegraphed to Soward, and.
getting a reply denying thc occupation of Mata
moras, tho cable dispatch was received condition?
ally, but afterwards was returned to Mr. Bigelow,
on the confirmation of tho occupation.
WASHINOTON, December 30.-Signor Romero,
represent?rig tho Juarez Government herc, is of
opinion that, owing to the violations of understood
stipulations on thc part of the United States and
France, both will act according to their pleasure
in Mexican affairs. He Ia apprehensive that the
evacuation of the French will not occur till'it snits
Napoleon's convenience.

NEW YORK, December 31.-The United States
steamship Powhattaii. boaring tho broad pennant
of Admiral Dahlgren, left Panama on the lilli for
the Pacific. Bishop Vasques, of Panama, has been
banished for refusing to take the oath recently or?
dered by President Mosqmro, who has ordered thc
seizure of all cannon and other material of war
attempted to bo transferred across thc Isthmus to
the Pacific. In the difficulty with Spain, Mosquiro
has decided that Now Granada will remain neutral,
and that cither belligerent will have a right to
bring prizes into port for adjudication. Senor
Agualdo has been appointed Consul-General from
Columbo for tho United States. Valparaiso datos
of the 3d. ai.d Callao uates of 14th, nave been re?
ceived. It was not known at Valparaiso if peace
had been made with Spain. The Chilian foreign
minister had gone to Callao on a special steamer,
and his vi ut was believed to have reference to the
offer of European mediation. The late Peruvian
Minister to England is charged with gigantic
frauds on guano contracts, amounting to nine mil?
sons of dollars.

The old Euglish poet here gives in a few lines a
very lively picture of thc New Year's holiday, as
observed in the oldc.ii time. There always has
been more or less festivity connected with the
celebration of tho Kew Year, both with Jew and
Christian, Tagan and Mahommcdan. Thc transi?
tion from thc old year lo thc new is naturally
suggestive of feelings both of sorrow and of joy.
All feel thc solemnity of the occasion; sorrow and
regret at thc departing year, joy and welcome to
thc new, that carries.in its bosom so much of hope

In Scotland the wassail bowl was held in sacred

sweetened ale. with an infusion of spirits. When

year, each member of thc family drank of this

competent provision of buns and short-bread, or

would stop aud give and take sips from their res?

would enter with vociferous good wishes, and soon

empty-handed, but with their hands full of cakes
and bread and cheese, of which, on thc other hand,
civility demanded that each individual in the house

Thc giving of gifts, presents to friends, and sub?
stantial assistaucc to the indigent, an old and
time-honored custom. When pim. were first in?
vented and brought into usc about the beginning
of the sixteenth century, they were a New Year's
gift very acceptable to ladies, and money given for
thc purchase of them was called "pin-money," an
expression which has been extended to a mm of
money secured by a husband on his marriage for
the private expenses ol' his wife. Pins made of
metal, in their present form, must have been in
uso some time previous to 1513, in which year a
statute was passed (33 Hen. Y1IT. c. (I), entitled
"An Acte for tho true makin? ofPynr.es," in which
it was enacted that thc price charged should not
exceed (ls. 8d. a thousand. Pins were previously
