ArjTH0RiT7.--The statement in yes? terday's paper in reference to Colonel CABEW, tho 1 erin" of the District, and General BENNETT, was ?founded on rumor, and was not altogether in ac? cordance with the facts. We have since seen Col. CAREW himself, and ascertained from him the fol? lowing particulars: During tho recent session of i the Sessions Court, JAMBS FOX was convicted of larceny, and under the laws of the State, senten? ced by Judge ALLEICH to six months' imprison? ment and thirty-nine lashes, to bo inflicted in three instalments of thirteen lashes each. The Sheriff notified tho keeper of the jail that he would proceed to execute the sentenoe at ten .'dock on Tuesday, 20th inst., and accordingly re? paired to the jail at the appointed time. He was told by a non-commissioned officer iu charge that he could not permit him to have access to the prisoner. Colonel CABEW then went to the head? quarters of General BEENETT, to ascertaiu whether this interference with the execution of the laws which had been restored by the joint proclamations of the Provisional Governor and General Gm.MOUE, then in command of this De? partment, had been made by authority. General BBKKKTT being absent, Colonel CABKW stated his business to Captain BUEUEH, thc Adjutant, and was informed that the matter wau referrod to the Major General Commanding, and that pending his consideration of tho subject, and until bia decision was declared, thc punishment could uot be in? flicted. Major General Commanding has been informed that yon propose to indict tho pun? ishment of 39 lashes upon a percou named Charles Fox, now confined iu tho District jail, pursuant to a sentence of tho Court of General Sessions, Ur. Judge Aldrich presiding. Tbe officer in command of tho jail has been notified not to permit this punishment, and the sentence cannot bo executed. Any attempt by you to execute elsewhere this or similar sentences, will be treated us a violation of General Order .No. 1, dated Headquarters, Depart? ment of South Carolina, Jan. 1st, 1866, and promptly dealt with as such. Punishment of the lash cannot be ii.dieted in this city upon any per? son while tho military authority continues in force. The Courts of South Carolina cannot have the assent, either expressed or implied, of the mili? tary authorities, of a punishment unknown to the laws of the United otates. 1 am, Sir, very respectfully, your obedient servant, M. We think it probable that a misapprehension may exist in reference to the facts of this case, and would state, for the information of our read? ers, that the punishments imposed by His Honor Judgo ALDRICU, were not of his own motion, with respect, at least, to their character. Tho penalty for the crime of larceny iu this State has always been whipping. The commun law of England was adopted by an Act of the. A Dam BEBA.TR A rr KM PT AT MURDER.-On yes? terday, as two colored soldiers, belonging to the 85th Begimcnt, wo believe, were proceeding up Meeting 6treet, and had just passed the Circular Church, one of them was'seen to stop and lean on his musket, whilo tho other stepped forward some ten pacos, wheeled, and coeking his musket, de? liberately aimed and fired, hilting tho other in the nock, and wounding him 6o severely that ho lies in a precarious situation. We have been unablo to ascertain the cause of this murderous assault, but presume tho military authorities will make a j thorough investigation of thc whole matter. MURDER.- A diabolical murder waa committed in King, nour Calhoun-street, about ll o'clock last j night, on tho peraou of an unknown colored man, ipparently about 25 yearB of ago. flo is supposed io have been a butcher in the market, and resided in Stato street, near Lodge Alloy, ile waa stubbed n the back and died almost instantly. Thc monis and orchestra are complete, and our peo? ple, who have always been great lovers of operatic performances, must prepare themselves for a series of the most elegant entertainments which j lave been given in Charleston for many years. To those who have never seen this a tr an go and most peculiar chemical discovery, ve would say purchase a box, and be as much gratified and astonished as all are at the first ex? hibition of them. TUB CIRCUS.-Last night we did ourselves thc pleasure of taking the juvenile members of the family to tho inside of tho big canvass on Citadel 3quare. Tho crowd was immense; an hour beforo tho performance commenced, every availablo soat af the amphitheatre waa tenanted. The place was sot merely fall, but it wai crammed, jammed. Everybody was there, and his wifo WAH Micro, and ill bis children. Aud tho way the little boys and ?irls onjoyed all the lino sights and funny sayiugs was enough to convert an anchorilo. Tho horses trero fine, and performed well, somo of them most learnedly. The riders did what circus riders al? ways do-stood, leaped, danced and pirouetted on aorsoback, and jumped through tho prescribed number of hoops. Tho clowns wero "dreadful" funny; thoir jokes extremoly original. We know that they wore good clowns, fur they did and said thc same things precisely 'bat wo havo known avery clown to say and do since wo wero "kneo high to it dook." "Cnar" certainly is a most mag? nificent h..i rf, and we could not bat i>ity the poor :ininia?., r- > accustomed to aristocratic society. It is such a coming down, from being ono of the [tuestan Emperor's horses of state, now to be com? pelled to make a fool of himself for the delecta? tion of the crowd-which, to say tho least, is not iltogothor aristocratic. And the lions-we must not forget them-they roared splendidly ; and everybody was delighted. Ko kind of amusement appears to bo as popular as the Circus ; and as long as people enjoy such shows, why, wo say, lot them have thom. PROVOST COUBT.-8am Myers, colorod. Assault | and Battery. J. D. Cox testified that, as bo was paddling a small boat up to Fairchild's Wharf, ;ib 'ut half-past ll o'clock on Tuesday forenoon having bcon on the other e??o of the river to get Borne oyeterB-tho defendant, who woe standing on the wharf, addressed some words to him, and then threw bricks at him, some of which fell in the boai, and one struck him in the back. Witness got on shore aud proceeded to Calhoun-street to look for a policeman, so that bo might havo tho defendant arrested; but he got ahead af witness and met him in that street, and commenced throw? ing bricks at him again, aud struck him in tho face with his fist, and kicked bim in thc stomach. De? fendant borrowed from a boy who was wich him a large knife, but his sister carno out a gato and at? tempted to drag him in. Tho negro seems to he willing to work; but those who hare never soen the large towns are very anxious to mako one trip, to seo if there is not some placo where work will be easier. Those who have been soldiers seem to go to work with more earnest? ness, and appear very quiet and well disposed. Tho peoplo nro tired and utterly disgusted with the questions now agitating tho country. They have Inst nearly all thoy were worth before the war, and now thoy wish to go quietly to work to make up aomo of their loases. They care more to know about the market price of articles such as they wish to aoll or buy than they do for politics, and no wonder." A Washington correspondent states that the Reconstruction Committee have decided to report a joint resolution for tho admission of Tennessee. It will distinctly state that Tennessee having ap? plied for admission into the Union, and her Cen btltution being Be-publican in form, alie ahall be admitted on the same terms aud for tho ?arno rea sone that Territories are. It will fully remedy the radical idea that all Southern States are at pre? sent out 0? the Union, and conveys the false im? pression that Tennessee admits the fact and asks to bo readmitted.
