Legal Practices in England,

Lawyeisin England are either counsel
or (solicitors. Counsel were original!) of
two classes-sergeants ?nd barristers;
but since thc Act bf 73 sergeants, as a
cluss, have censed to have any meaning,
and aro virtually abolished. Before then
nil judges had first to be made sergeants,
bul now it is never done. Sergeant Ball
antine is the last remaining sergeant I not a
judge) in England. A barrister is "call
ed to the bar'' in England - a term equiv
alent to being "admitted ' in America.
The privilege of calling persons to tho
bar is exclusively held by lour ancient
societies -that is, the inner and middle
temple, and Lincoln's and Gray's I nus,
which now act as a corporation, l'util
recently a law student had only to pay
some lees, and eat a certain number of
dinners in the "hall" of one of these so
cieties, lo entitle him to be called lo the
bar : hut with the exception of members
of the universities, student.-* hare lo un
dergo a preliminary rxaminamition in
general knowledge before they ?rc nd
milted students, and all must pn*s an ex
amination itt law before they are granted
thc degree of banister at law, which,
besides giving them thu right lo practice
in all English Courts, confers upon them
the title of "esquire."
Barristers only have audience in high
courts of justice and appeal. When the
judges "go circuit," they are. therefore
accompanied hv barristers who conduct
the cases tried before lue different assizes,
there hoing no "bar" except in Loudon,
and consequently no barristers r?sident,
ns such, in any of the assize towns. Bar
risters of eminence and some years!
standing ?it thc bar are appointed queen's
counsel, by patent from the crown.
While a great honor, being made a t?. C.
rathers hampers a mau in some respects.
Eur instance, bc cannot, ns a general rule,
appear without a "junior" for a plaiutilf,
though he may lor a defendant ; nor eau
he accept a brief to defend a prisoner
without licens from the crown, for which
the prisoner has to pay a fee. Formerly,
attorneys were distinguished from solici
tors in chancery and proctors in admiral
ty. Now all distinctions are abolished;
proctors, attorneys, and all, are called
solicitors of the supreme court, with
right to practice ill any court alter being
mlmittcd by the incorporated law society.
Solicitors are only allowed nudienco in
inferior tribunals, such as county courts.
Judges and barristers wear wigs and
gowus in couti. Judges have two sorts
of wig ;a full-bottomed wig-viz , one thnt
bangs down on euch side of thc face -
und an ordinary wig, to cover the bend
only. Thc former is worn on slate oc
casions, at the opening of the leroi, when
the Assizes are held, Ac. ; tho ordinary
wig at ?iii?triwt. A scarlet gown trim
med with ermine is worn by Ibo Judges
when they Hit in criminal cases, ami a
black silk gown in civil cuses, (?ueen'a
counsel, on extra occasions, or when ap
pearing at the bar of (ho House of Lord's,
wear a full-bottomed wig; ut other times
the ordinary "bar" wig, UH it is called.
Tho later is a small wig, fitting lightly on
tho top of the head, with two little curls
or knots, called "tails," pendant from ibo
back. The wigs ol J udges and barristers
ure made of gray curled horsehair. A
sergeant's wig is a bar wig with a black
patch on the crown. The attorneys and
solicitor-general are both t?. C's and
wear wigs of that grade, (?ueeu's coun
sel wear silk gowns; ordinary barristers
"ntull" gowns. When a barrister is made
a li. C., be is therefore, said to "take
silk." Barristers also wear white cam
bric "bauds" at tho throat, and when a
( \. C. is in mourning hu has white cam
bric "weepers" round bis wrists.
The lei m "devil" is applied toa barris
ter who does another barrister's work for
him. Every barrister of large practice
hus a "devil" to act for him in bis ab
aenco. At the common-law bur the
"devil" does not share the fee, but at the
equity bar he does. The attorney-guner
ul s "devil" Invariably becomes ii judge.
There aro two judges now on tho bench
-Justices Harmon and Bowen, who have
filled this position.
All tho judges of tho high court of
justicoaro addressed ?ti court, "my hud,"
and "your worship." Tho vice-chancel
lors and county court judges ure address
ed, "your worship." in private life
judges assume their individual title only.
They aro never culled "JudgeSo-and so"
oft" the bench ; but "Sir Thomas" so nud
so, or "Mr." Nor aro thc attorneys or
solicitor-general ever calltd "geuernl"tio
und-Bo.
Tho higher judicial officers uro invari
ably knighted, and frequently elevated
to tho peerage. The judges uro indepen
dent of royal pleasure, and are appointed
for life ; on retirement, after a service of
fifteen years, they rcccivo tx pension of
.C8.00O per annum. When an nction ia
to be brought or defended, n client lays
his claim or defence before a solicitor,
who ucla for the client until tho caso is
ripe for trial. At that point the solicitor
makes up a statement of all the facia
constituting tho claim or d?fonce, togeth
er with tho names of tho witnesses, and
what each is expected to provo. This is
called the "brief." Thc solicitor thou
aelocts a Queen's counsel (generally to
conduct tho trial of tho case, and ono or
more ordinary barristers to assist, giving
each a brief, upon which is marked tho
fee each is to have. Tho Q. C. is called
tho leader in tho case, though an ordina
ry barrister in au unimportant case moy
be a leader. The old common law "dec
laration" is now called the "statement of
claim," and tho plea tho "defence."
Special pleading, in nil ita ramifications
mid technicalities, is therefore somewhat
abridged.
Terms of courl are now called "sit
tings." There are four of them ; namely,
Hilary, Easter, Trinity and Michaelmas.
Barristers' offices are called chambeis,
and aro for tho most part situated in the
different buildings which en masse com
pose the "Temple." The names of bar
risters on tho doors of their chambers,
and at the entrance of the building, are
always preceded by "Mr." Solicitors
wear gowns and bands (but no wigs)
when practicing in the county courts,
where they have audience. Lincoln's
Inn Fields ia a locality almost exclusive
ly devoted to solicitor's offices, though
their places of business are not strictly
confined to any part of tho business quar
ten of London.
Among the most eminent bar
risters, most of whom are Q. C's,
are Charles Russell, famous UH a cross
examiner, Judah P. Benjamin, whoso
li?e is maritime and commercial, and
whose income baa been placed at from
>:20,000 to ?30,000 a year; Charles
Butt, whose specialty is admiralty, and
who, by the way, I hear, has a brother
"ranching" in southern California; Po
land, a specimen "Old Bailey" barrister;
Tunderwick, who appears in more di
vorce cases than any other mun ; Cohen,
M. P. for Southwark ; Wills, who can
make a telling after dinner speech ns well
as a close argument in the chancery di vi
sion ; John Maule, the public prosecu
tor; Sir John Holler (pronounred
Hooker) the attorney-general of lh,o hist
minister ; Sir Hardiuge Giffard, the late
solicitor-general ; Sir Henry Jame?, the
present attorney.general, and Montague
Williams, the most rising man at the
criminal bar, who was once an officer in
the army, and whose warlike propon
sities, there fostered, show themselves not
alone in his snarling manner of speech,
but in his adherence to the "code" as ti
means of settling quarrels among gentle
meo. So far, hnwever, owing to the dis
favor with which duelling is regarded
both by tho law and public opinion in
England, he has, I believe, only been
able to figure in the character of a will
ing second.

prietor of the place, who had been taken

man, to lay for him. lie look a friend
into his confidence, and the pair made
up their minds to heat the fellow with
the contents of the money drawer. Ho
they counted the pennies and lound there

iow for their opportunity.
That evening the betting man was on
hand, and in a manner not to excite sus- !
piciou thu saloon keeper said lo his j
friend : "I wonder how many pennies
.here arc in this drawer?"
The betting chap pricked up his oais
and remarked : "Let each of Us put Hp
ff}, and thc one who conies nearest to the j
number shall take the pot."

.Mr. Van Dyke saw one watching a
brother sportsman nearly a milo away,
whose motions he could hardly himself
make out. It is ?rue that for recogniz

every valuable I have in this world is in
that baggage, ?.

nearly ali night long. I could hear her
in my sloop, und when 1 told her, as soon
us she became exhnusted, that tho bag

said his companion, "but how about th?

"Why, I've just boon telling you," ho

been blown up on a steamboat by a mud
woman then you don't know y ny thing
about explosions-that's all."
