CHARTER OF THE TOWN OF YORKVILLE.
j| Be it enacted by the Senate and House o
Representatives of the State of South Caro
Una. now met and sitting in General As
serably, and by the authority of the same:
^' Section h That all citizens of this State
who have resided, or may hereafter reside
v Tor sixty days within the limits hereinafte]
/ designated, shall be deemed, and they are
hereby declared to be, a body politic and
corporate, under the name of the Town ol
Yorkville; which said town shall extend
one mile in every direction from the Couri
? House at Yorkville.
Sec. 2. The municipal powers of said town
shall be vested in the Intendant and foui
-Wardens, who shall constitute the Town
Council of the town. They shall be citizens
of the United States, and shall have resided
in this State for twelve months, and in said
town sixty days immediately preceding
> their election. They shall hold their office
for one year and until their successors are
v elected and qualified.
8ec. 3, The election for such Intendanl
?v and Wardens shall be held at such time, nol
later than the month of May of each year,
and at such convenient place within said
town, as may be designated by the Town
Council, fifteen days^-public notice thereol
/having been previously given, at which
election all male inhabitants of the age ol
twenty-one years, citizens of this State, whc
shall nave resided within the State twelve
months, and in said town sixty days immediately
preceding such election, and not being
nnder any of the disabilities mentioned
in the Constitution of this State, shall be
entitled to vote. The polls shall be open
from 9 o'clock in the morning to 5 o'clock
in the evening; and when they are closed
the Managers shall forthwith count the
votes, declare the election, and give notice
of the result thereof in writing to the per?
sons elected, who, if eligible, shall.thereupon
qualify by takiug the oath prescribed in
the Constitution. The said Town Council
shall be empowered to appoint three Managets
of Election, to make all necessary ordinances,
rules and regulations for the propei
i management and control of said election,
and to pnnish offenders against the same:
Provided, That the present acting Intendant
and Wardens of said town are hereby
authorized to appoint an election for Intendant
and Wardens for the year 1887 undei
', the provisions of this Section. In case a
vacancy shall occur in the office of Intendant
or any of the Wardens by death, resig
nation or otherwise, an election to fill such
vacancy shall be held as early as practicable
gfv thereafter, and conducted under the same
forms and requirements as are herein provided
for conducting the regular election,
And in case of sickness or temporary ab
sence of the Intendant, the Wardens forming
a Council are empowered to elect one oi
their number to act as Intendant during the
time. The Town'Council shall serve without
compensation. They shall, within twenty
days before the expiration of their term
of office, through the Treasurer, make and
publish a full account of their receipts and
expenditures, and shall pay and deliver tc
their successors all moneys, books, records,
papers or property in their hands belonging
to the corporation.
Sec. 4. The said corporation shall have a
common seal, may sue and be sued, plead
, and be impleaded, in any Court of justice
in this State, and may retain, purchase,
hold, possess and enjoy to them and theii
successors all such property as they now
; ? . _ may be possessed of or entitled to, or which
- i shall hereafter be given, bequeathed to, or in
any manner acquireu oy uieu, nuu iu ocu,
i, alien, or in any way transfer the same or
any part thereof.
Sec. 5. The Intendant shall, as often as
he may deem necessary, summon the Wardens
to meet in Council, any two of whom,
with the Intendant, shall constitute a auo
;rttm for the transaction of business. They
'shall have full power, from time to time,
under their corporate seal, in Council assembled,
to make all such ordinances as may be
- necessary to carry their corporate powers fully
into effect; to make all such ordinances as
they may deem proper,relative to the streets,
roads, markets, public squares, public buildings,
public scales, weights, measures, fire
department, water supply, police and health
of said town, and the building and maintaining
of sidewalks at the expense of the
land owner along whose lot the sidewalk
runs, provided the owner, after due notice
to do so, fails to build or maintain the same;
" -atrTair such ordinances as may tend to
preserve the quietude, peace, safety and
good order of the inhabitants of said town,
\ and the protection, security and enjoyment
* of their property; and they may provide
for the enforcement of all ordinances so
, made by them, and for any violation thereof
they may provide for the punishment oi
the same by fine, not exceeding fifty dollars,
or imprisonment in the town prison not exceeding
thirty days, for each offence:, Provided,
That all ordinances, before taking effect,
shall be published for at least two
weeks in a newspaper published in said
town, or if there be no such newspaper, in
any newspaper published in the County:
Provided, further, That all ordinances enacted
under the charter lately expired, excepl
such (in whole or in part) as may be inconsistent
with this charter, shall be of force it

Sec. 6. The said Town Council shall have
power to abate and remove all nuisances ir
said town, and they may lay out and open
new streets, and widen or otherwise altei
those now in use; and they shall have power
to compound with all persons liable tc
work the streets of said town, upon such
terms as their ordinances may establish
and all persons refusing or failing to laboi
or pay such commutation shall be liable tc
such fine or imprisonment as the said Towr
Council may by ordinance prescribe.
Sec. 7. The Town Council shall have
power to appoint a Clerk, a Treasurer, f
Town Marshal and all other necessary officers
for such town; to fix their compensation,
prescribe their duties and require
bonds for the faithful performance of theii
duties: Provided, That the Treasurer's
compensation shall be two and one-hali
per centum upon receiving moneys, anc]
a like per centum upon paying rnoneyj
out. They shall have power to establish
and keep a guard house or town prison
for the confinement of prisoners, and
when necessary, to use the common Jail 01
the County for such purposes, said towr
paying for the maintenance of said prisoners,
and to organize and maintain a police
force for the town, and to prescribe their duties,
and to require bonds for the faithful
Serformance of their duties; and the Towr
farshal or any of said police are authorized
to arrest and commit to said guard house 01
town prison, for trial before the Intendant
any person or persons who may be guiltj
k within the corporate limits of said town o)
F\ a breach of the peace, or of public drunkenness,
or open indecency, or of resisting
said police, or any other disorderly conduct
injurious to the public safety or good order
of the said town or of its citizens; and alsc
any person or persons who may violate any
of the ordinances of the said town ; and the
said Town Marshal or Police shall, Whenever

ty, have authority to call the posse comitatus
of said town to their assistance, and any
person or persons so arrested and imprisoned
shall be liable to all the costs ana expenses
of said arrest and imprisonment, and
be further liable, upon conviction, to such
fine or imprisonment, as the Intendant trying
the same may impose: Provided, That
said fine or imprisonment shall not exceed
that mentioned in the fifth Section of this
Act: And provided, further, That no person
so arrested shall be detained in the said
guard house for a longer period than twenty-four
hours awaiting his trial; but Sundays
are not to be taken into account in
computing said time.
Sec. 8. The Town Council shall have power
and authority to impose an annual tax,
not to exceed two mills upon the dollar, lor
ordinary town purposes, on all the real and
personal property within the corporate limits
of the town, and to lay a tax upon all
dogs and upon all pleasure carriages, barouches,
omnibuses, carts and wagons used
for hire or public employment within said
corporate limits, and charge and collect in
advance a license tax upon every show 01
exhibition within said town, and also upon
every pool or billiard table kept for gain 01
profit.
Sec. 9. During the months of January
and February of each year all persons lia
ble to taxation shall make return of theii
property, under oath, before the Treasurer
who shall have authority to administer sait
oath; that the said Town Council may sum
k mon any person to appear before them an<

; answer under oath concerning their properf
j ty liable to taxation; and the said Town
Council may correct all returns and assess at
! its true value all such property liable to taxI
ation. And should any person or persons
fail to make return of their property within
the time above mentioned, or fail to
appear and answer concerning their property
when summoned as above provided, the
Treasurer shall make out an assessment
from the books of the County Auditor of
the real-and personal property of such person
liable for taxation, and may, when directed
by an ordinance so to do, add thereto
a penalty of twenty per centum for such failure:
An ordinance declaring the rate of annual
taxation upon property and other subjects
of annual taxation for the year shall be
published at least two weeks during the
month of October, and all persons liable to

ing month of November; upon failure to
make such payment, the persons so in dei
fault shall be subject to a penalty of twenty
; per centum upon the amount of their taxes.
, It shall be the duty ot the Treasurer to en1
force the collection of any and all taxes,
t penalties, commutation moneys or other
F charges due to said corporation; and for this
i purpose he shall be authorized and etnpowf
erea to issue executions, under the seal of
> the corporation, directed to the Sheriff of
s the County, or the Town Marshal, requir
ing him to levy and sell of the property,
real and personal, of such persons so in de[
fault, sufficient to pay all such taxes, penal>
ties, charges and costs. If such executions
i are lodged with the said Sheriff, he shall
: be entitled to charge and collect the same
1 costs now provided by law on executions
? against property: Provided, That no mdla
) bona costs shall be charged against said
town; and all property upon which a tax
shall be assessed shall be declared and made
i liable for the same, and for any penalties
1 and other charges thereon, in preference to
all other debts or encumbrances, except
debts and taxes due to the State: Provided
' further, That the present acting Intendant
; and Wardens, or their successors in office,
: are hereby authorized, upon two weeks'
public notice, to levy and collect two mills
- tax during the month of January, 1887, to
defray the current expenses of the town for
the year 1886, the special assessment for that
i, purpose to be also made during said month ;
all the provisions of this section to obtain,
so far as may be, for the enforcement of
f this special tax. But if this special levy

creased two mills in order to cover the ex.
penses of 188G.
Seo. 10. So long as the Act entitled "An
Act to prevent the sale of spirituous or inT
toxicating liquors in the Town of York>
ville, in York County," approved February
9th, 1882, remains of force, the Town Coun
cil are hereby authorized and empowered to
i regulate the sale of such liquors made upon
I prescription by the drug stores situated in
L the said town in the following particulars:
> They may, by ordinance, with appropriate
, penalties, require the physician giving the
prescription to certify in writing at the foot
thereof all the facts the existence of which
- allows the prescription to issue, and appoint
I a committee of their body to inspect the
> files of the said drug stores and see to it
that said prescriptions are made in due
' form and that none others are filled.
' .And. the Town Council shall be authori
ized and empowered to require all peri
sons, companies and corporations now en?
gaged, or who may hereafter become en'
gaged, in business vocations or professions
of any kind whatsoever within the lira>
its of said town to take out a license from
the Town Council who shall be authorized
i to impose such charges or tax for the con
duct of the 6ame as by ordinance or the saia
' town may be provided, and the revenue
i derived from such license shall be for the
Sublic Aises of said town and the Town
ouncil may enforce the payment of such
license or tax in such manner as they, may
i by ordinance provide,
i Sec. 11. The Town Council shall have
power to define the limits of a fire dis'
trict within said town, and to prescribe
of what material buildings or other struct
ures within such limits shall be construct1
ed; and to prevent the erection of buildings
or other structures therein of any other
material than that prescribed; and they
shall be authorized to make all ordinance*:
1 necessary to carry this power into full effect,
and to punish by fine or imprisonment, or
otherwise, all violations or attempted vio?
lations thereof. "
Sec. 12. The Town Council shall be au1
thorized to borrow money only for corpo;
rate purposes and upon corporate bonds,
bearing interest not exceeding seven per
1 centum per annum: Provided, that no loan
' shall be effected without previous concur'
rence of a majority of the voters of said
' town votiug upon the same, to be ascertain1
ed by a special election upon the amount
1 and purpose of such loan, previously named
J and stated by an ordinance of said Town
: Council, which election shall only be or'
dered by the said Town Council upon twen'
ty-one days' public notice, and upon a pe"
tition presented to said Town Council, sign1
ed by a majority of the residents who are
" owners of real estate therein, praying such
5 election. If the loan be voted, the Town
Council are hereby authorized to enact ap5
propriate ordinances for the payment of the
1 principal and interest: P)-ovided, That the
[ levy for that purpose shall be made along
with the levy for ordinary town purposes,
and that said special levy shall not exceed
' two mills for any one year.
\ Sec. 13. That all offences against the or[
dinances of said town, and all offences mentioned
in the seventh section of this Act
) shall be tried before t'.e Intendantof said
1 town, who shall have all the powers within
the corporate limits that Trial Justices
5 now have, or may hereafter have, except

" convicted before the Intcndant shall have
| the right of appeal to the Town Council,
I agreeably to the provisions regulating apr
peals from inferior Courts: And provided
' jfurther, That said appeal shall be final.
Sec. 14. That this Act shall take effect
\ immediately upon its passage; it.shall be
' deemed a public Act, and shall continue of
' force for fourteen years and until the end of
the session of the General Assembly next

' Sec. 1"). That the present acting Town
1 Council of said town shall continue in ofj
tice until their successors shall be elected
and qualify under tbe provisions of this
J Act, with all such powers and duties as if
1 they had been elected hereunder.
! Sec. 10. That all Acts of incorporation,
[ or amendments thereto, repugnant to this
Act are hereby repealed.
