testify as to the calibre of this ball, but I think i it is too heavy for 32. The State closed. Argument was opened by Mr. Jeffries for ! the State, who was followed" by J. F. Hart for | thedefence. W. B. Wilson, Jr., then made an argument in behalf of the State, and at its close, it then being 6.30 P. M., the Court adjourned until 9.30 Friday morning. When Court convened on Friday morning, Mr. MeKissick made an argument for the defence i and was followed by his colleague, Mr. Rion, j Solicitor McDonald having the close. Theargu- i ment of counsel occupied the time until near 1 j o'clock, when Court took recess until 2. The Judge then delivered his charge, which was a clear exposition of the law as it relates to the taking of human life under all circumstances, and as the law related to the case just heard he was particularly explicit. At 10 minutes to 3 the jurv retiree!, and at 9 o'clock the next morn- j ing the Judge was notified that a verdict had j been reached. When the Sheriff waited upon ; the Judge to escort him to the court room he did not know that the jury had agreed upon a verdict, the foreman having merely directed him to notify the Judge that they wanted him, and all who repaired to the court-room were surprised when to the usual question bv the Clerk, "Mr. Foreman and Gentlemen of the Jury, have you agreed upon a verdict?" the answer from "the foreman came. "We have." The indictment was then handed the clerk and ho read the endorsement: "Guiltv of manslaughter, with recommendation to the mercy of the Court." The Judge at once proceeded to pronounce the ! sentence of the Court, which, divested of the usual formalities and comments upon the case and admonitions to the prisoner, is in the following words: "The defendant, Robert C. Bishop, being brought to the bar of the" Court and asked what he has to say why sentence should not be pronounced against him, says nothing save as he has hitherto said, whereupon it is considered and adjudged by the Court that the said Robert C. Bishop be coufined at hard labor in the State Penitentiary for the period of three years." After the jury in the Bishop case retired, the next case called was the State vs. R. L. Simmons, chargiug him with procuring goods by false pretences; prosecutor, John R. Ashe. Hart & Hart appeared for Mr. Simmons. The allegation was that Mr. Simmons applied to Mr. Ashe for advances, to be secured by a lien on his crop, and that he represented to Mr. Ashe that he was the owner of the land he purposed cultivating; whereas the title to the land, as Mr. Ashe afterwards learned, is vested in Mrs. Simmons, wife of the defendant; and besides, Mr. Simmons also cultivated two other parcels of land, one belonging to Mr. Quinn and the other to Mr. Hall, on each of which he applied fertilizers supplied to him by * Mr. Ashe. Mr. Simmons denied making the alleged representations to Mr. Ashe. The Court charged the jury that if Mr. f, Simmons had rented land from Quinn and Hall, it was his for the time rented, in the meaning of the law, and the charge of false pretence could not stand as it related to those parcels; while in regard to his wife's land, if he spoke of it as his, as the head of the family and manager of the premises, it was not fraud within the meaning of the i Act. The jury returned a verdict of not guilty. Only one case remained on the Sessions docket, viz.: The State vs. W. T. M. Beard, appealed from trial justice. Appeal dismisssed. On Saturday morning, immediately after sentence was pronounced upon Bishop, the Sheriff brought in the prisoners who had been remanded for sentence and they were sentenced in the following order: Daniel Darwin, colored; burglary and larceny: at hard labor in the penitentiary for one year. Lee Hambright, alias Lee Rogers, white; grand larceny: at hard labor in the penitentiary for two years. Greene Berry Griffin, white; bigamy: at hard labor in the penitentiary for one year. Sam Patrick, colored; gambling: at hard t labor in the penitentiary forsix months and * to pay a fine of one dollar. Same, for carrying a concealed weapon,at hard labor in the penitentiary for three months and the forfeiture of his pistol. Kd. McDonald, colored; malicious mis ciuei: at naru moor in. me peuueuuary eight months. Berry Anderson, colored; carrying concealed weapon: to pay a fine of $25 and costs of prosecution, or be confined at hard labor in the county jail for ninety days. Alonzo Hoffman, colored ; petit larceny: at hard labor in the penitentiary six months. Wiley ^Fewell, colored ; assault and battery of high and aggravated nature: at hard labor in the penitentiary four months, or to pay a fine of $50. Fine paid. In the case of George Beckham, colored, convicted at last July term of manslaughter and sentenced by Judge Witherspoon to the penitentiary for ten years, from which verdict he appealed to the Supreme Court, and the remittitur havingcome from that Court sustaining the verdict, on motion of the Solicitor the Judge signed an order directing the sentence to be carried into execution. Court of Common Pleas. The Court of Sessions was then adjourned sine die, and the Court of Common Pleas was opened. The calendars were sounded and on motion of attorneys a number of orders were granted. By Wilson & Wilson the petition of Alice J. Evins vs. David A. Long, praying a decree annulling the marriage contract between the plaintiff and defendant, was presented before the Court. After hearing testimony and the facts in the case, which are fresh in the public mind, the decree was granted. Court then, at 1 P. M., adjourned until 10 o'clock A. M. on Monday. Court convened on Monday morntng all the jurors drawn for the second week answering to their names except F. W. Moore and J. W. Bailes, who could not be found. J. R. Haile and A. R. The day was occupied in the hearing of civil business, and on Tuesday the case of Oriana Adkins, Adin'trix., vs. the Atlanta and Charlotte Air-Line Railroad Company, for damages sustained by the death of her husband, a brakeman em ployed on that road and who came to his death in the service of the company, was taken up.
