Senators Sargent and Sherman and Representatives
Kason and Hnrlburt farther objected
to the last paper presented and read, (
oh the ground that the papers are not proper- ^
ly authenticated under the Constitution and
fcawwof, tho United States, and that the action ?
of the canvassers is hull and void because it is a
an expost facto action. i
There being no farther objections, the pre- 0
siding officer announced that the Senators c
would retire so that both Houses eould con- r
aider the objections, and the Senate then re- ^
tired to their chamber at 3.10 P. M. f
The electoral tribunal met on the 2nd, and s
? after adopting rales, took ap the Florida j
case.
Mr. Kasson, on the Republican side, delivered
a long argument defending the action of h
the Board of State Canvassers, and contend- ?
ing that the Commission had no right to go t
behind the returns. The Constitution and t
laws, he said, had provided the mode of ma- j
king the returns. History showed that Con- c
gress should have very little to do with the a
returns from the States. The rights of the 1
States had been zealously guarded, and but ?
little was left for Congress to do. if the vote
of Florida could be reversed, then the vote f
of New York could be reversed. If the ninety
votes, which was the majority in one of ?
the canvasses, could be set aside, then the ^
60,000 majority could be set aside. a
Mr. Thurman asked if Mr. Kasson's argu- t
raents extended so far as to hold that if four
Electors had been chosen who were disquali- fied
under the Fourteenth Amendment to die
Constitution, their votes could not be ques- 1
tioned. ?
Mr. Kasson replied that he thought that v
the provisions of the Constitution relating to P
officasjo? profit or trusty.and the disqualifies- ^
tioos referred to, were imperative, He h?J t
not bad time to carefully^exainiaeUbis prop- c
** osition, and as his hour bed expi red he w&s
not now able to go into the discussion of the question.
t : | J |, i / ; ^ ;'
k Mr. McCrary followed in an argument of 1
one hour. ,
Judge Clifford asked if counsel proposed t
to Submit eridence before proceeding to^the a
arguments, or to make their arguments first? ?
Mr. Field said they proposed to submit s
some evidence. ' ] J
Mr. Edmunds, interrupting, asked if Mr. a
Field appeared as objector or counsel ?
C,. , , ? i _ -l;?.? nr. f J
Mr. ineia repuea, as oojector. iur. x^umundB
said it was bis opinion as an individual.member
of the commission, that the privileges
of the objectors bad been exhausted.
Mr. Merrick stated that.he was requested
by Mr. O'Connor to say that he preferred to f
submit the evidence, and that up to this time
be had been under the impression that it had v
been submitted. ' .
Justice Miller said that he did not under- j
stand that any evidence had been offered, and I
suggested that in order to save time counsel s
N prepare a synopsis of the evidence.
Mr. Evarts said that his side proposed to submit
no evidence, unless the commission
decided to receive evidence. If^for instance,
it was proposed to go into the questions ^
whether Humphreys was disqualified, they J
would desire the opponent to show that he ^
had resigned the office of Shipping Commis- ?
sioner. - tl
Mr. Thurman said be would suggest, for o
the convenience of counsel, and to save the ?
time that would be spent in objections, if the ri
counsel agreed on the facts, about which l<
there could be no controversy.
The commission then, at 5:10 o'clock, P. M,
adjourned to 10:30 A. M. to-morrow. ?
On the 3rd, the Electoral commission alI

of its reception to be decided hereafter. Two
hoars were allowed for discussion as to c
whether the commission shall confine itself to o
the matter laid before it by the President of
the Senate. In the preliminary struggle the *
Republicans argned to confine, and the Dem- J
ocrats to enlarge the scope of the inveetiga- b
Iwin. i
On the 5th, being the fourth day of the g
deliberations of the Commission, argument c
of couusel for both sides was concluded on
the question of the Commission receiving evidence
fb the same manner as testimony was
taken by the Congressional investigating
committees.
PP The Commission had appointed to meet on
Tuesday to consider what evidence, if any, is r
before it, and to consider its powers and du- b
ties in the case preliminary to having a final ti
