The request was complied with. At 3 o'clock
the Court convened, when the case of the State
vs. F. B. Lloyd was called. Col. F. W. McMaster,
duly commissioned by the Governor
to try this cause, was present His commission
was read by the Clerk of the Court, and
the oath administered by his Honor, Judge T.
J. Maekey. The acting judge then took the
seat of authority, and called the case. C. S.
Brice, Esq. and'T. C. Gaston, Esq., appeared
for the State, and J. J. Hemphill, Esq., for the
defendant. Mr. Gaston asked that the trial be
postponed until 10 o'clock Saturday morning,
for the reason of the absence of witnesses for
the State. He said it was his understanding
that the defendant would admit the purchase
of school certificates,Jand would rest his defence
on the fact of bis having purchased only those
that were issued by his predecessor in office,
which he (the defendant) claimed he had the

wa8 one simply of law, which must rest upon
the opinion of the Court, after argument by
counsel. The counsel for the defendant contended
that the fact of the purchase of the
certificates must be proved, which necessitated
the request on the part ofi the counsel for
the State for the postponement of the trial
until the desired witnesses could be produced.
The Court granted the motion.
The Court met on Saturday morning, Col.
F. W. McMaster upon the bench. The counsel
for the State and the counsel for the defendant
announced their readiness to proceed
with the trial of the case of the State vs. F. B.
Lloyd, county school commissioner, charged
with purchasing teacher's pay certificates.
Carter Ross, upon taking the stand, testified
that, in the capacity of an agent, he had bought
school certificates for F. B. Lloyd, receiving
for his services five per cent, commission. He
said that his instructions were limited to the
purchase of certificates issued during the
years 1871,1872, and 1873, for the defendant
had told him it was no violation of law for
him to buy the certificates of those years.
The witness identified a certificate shown him
by the counsel for the State as one that had
been bought by him and turned over to the
defendant. D. I. Walker, ex-School Commissioner,
upon being sworn, was shown the
certificate that had been bought by Carter
Ross, as alleged, for the defendant, and testified
to its being one issued by him while in
office. The testimony then closed, the defence
producing no witnesses. The chief points in
the argument of the counsel for the defendant
were the absence of proof, on the part
of the State, to show the validity of the
school certificate in question, inasmuch as the
authority of persons, whose names appeared
on the certificate, as school trustees, was not
established; and, admitting the validity of
the certificate, the defendant had violated no
law, inasmuch as the certificate was issued
prior to his entrance upon the office of school
commissioner. The counsel for the State held
a different opinion, and gave the authorities
bearing upon the point. Col. McMaster took
a similar view of the matter with the counsel
for the defendant, and in his charge to the
jury instructed them to render a verdict of
not guilty. The jury did not carry out the
instructions of the acting judge, for, after
consulting a while over the case, they brought
in a verdict of guilty. His Honor ordered a
setting aside of the verdict, and the entering
of a nolle prosequi in the case.
Upon the re-assembling of the Court on
Saturday afternoon, the grand jury made a
presentment against B. G. Yocom, Treasurer,
charging him with breach of trust, with
fraudulent intent. This charge is based upon
the alleged re-issuing by the accused of paid
school claims of the county. The Solicitor
was instructed by the Court to draw a bill of
indictment in accordance with the allegations
of the presentment. This makes three presentments
found by the grand jury at the
present terra of the Court against Treasurer
Yocom?one charging him with conspiracy

make monthly returns to the County Commissioners
; and another, with breach of trust
with fraudulent intent.
Wednesday of this week had been appointed
as the day of trial of the case of the State
agaiust this defendant, but owing to the unDreDaredness
of the State for the trial, and
the physical inability of the leading counsel j
for the State, C. S. Brice, Esq., a postponement
of the trial was made by order of the
presiding judge. An extra term of the Court
of General Sessions will be holden. beginning
ou Tuesday, the 18th instant, for the trial of
this and other cases. In consequence of the
hostility existing between Judge Mackey and !
the defendant in these causes, a judge from j
another circuit will preside at the extra term.
Before the adjournment of the Court on
Saturday, sine die, the grand jury made their
* report, the prominent points of which I will
give in ray next correspondence.
The County Democratic Convention met today
at this place, in pursuance of a resolution
adopted at the last meetiug. Owing to the
inolemency of the weather, the attendance wa3
slim?barely a quorum of the delegates being
present. The following gentlemen were elected
to represent Chester county in the State
Democratic Convention: General W. A.
Walker, T. C. Gaston, Esq., Maj. J. W.
Wilkes, R. T. Mockbee, Esq., Maj. Julius
Mills, and Mr. C. W. McFadden. The alternates
are Messrs. J. E. Johnston, J. R.
Culp, C. S. Brice, R. S. Hope, J. G. McAfee
and J. J. Hemphill. No instructions in refer
ence to the course they must pursue at the !
State Convention were given the delegates.
They can, consequently, support the straightout
or mixed policy, as their judgment determines
to be the part of wisdom, at the time,
with all the facts before them.
Two tracts of land were disposed of to-day
at sheriff's sale?one bringing $4 per acre and
the other 50 cents per acre.
Mr. Joseph Wylie took his departure for
New York to-day for the purpose of buying
his spring and summer goods. The great
depression in business will occasion more limited
purchases by him than usual at this season.

grateful remembrance. It gives me pleasure to

their respective premises, otherwise the work will
be done by the Town Council, at the expense of
the owner of each lot. Plans and specifications
will be furnished to the owners of lots on application
being made to thelntendant. The following
is the section of the charter relating to the
sidewalks in the town of Yorkville:
"Sec. 8. That the said Town Council of Yorkville
shall have power and authority torequirfe all
persons owning a lot or lots in said town to make
and keep in good repair sidewalks in front of said
lot or lots, whenever the same shall front or adioin
any of the public streets of said town, if, in
the judgment of the Council, sucn siaewaiKs
shall be necessary, the width thereof, and the
manner of construction, to be designated and regulated
by the Town Council; and, for default or
refusal to make and keep in repair such sidewalks,
the Town Council may cause the same to
be made or put in repair, ana require the owner
to pay the price of making or repairing: Provided,
That such contract for making or repairing
be let to the lowest bidder."
