SUDDEN* DEATH.
John E. Carroll, aged twenty-one years on<
month aud twenty-eight days, who resided
about two miles east of Yorkville, died oc
Friday last from a congestive chill. On the
Monday previous to his death he was apparently
in good health.
THE FIRST BALE OF COTTON.
The first bale of cotton, of this year's
growth, raised in this county, was sold al
Rock Hill on the 2d instant, by Mr. W. L,
Robertson. It weighed 450 pounds and was
purchased by Messrs. J. M. Ivy & Co., at
20.15.
PATRONS OF HUSBANDRY.
We are requested to give notice that an
i extra meeting of York Grange, of the Patrons
of Husbandry, will be held at Yorkville
on Friday evening, (to-morrow) at 7} o'clock.
A full attendance of the members is very
much desired, as important business is expected
to come up for consideration.
AIR-LINE SCHEDULE.
On Friday morniug last, a change was
made in the schedule on the Air-Line Railroad.
The passenger train now leaves Charlotte
at 4.45, a. ra., and reaches Atlanta at
11.55, p. m. So soou as we can procure a
onnv nf the schedule giving the time of arri
val and departure of the trains at the way
stations in this county, we will publish it foi
the information of our readers,
RAIN STORM.
On Sunday night last, this section of country
was visited with the heaviest fall of rain
of the season. The creeks and branches in
the neighborhood were flooded to overflowing,
low-lands were inundated, feuces and watergaps
carried away, and the bridge on the
Charlotte road, overfishing Creek, two miles
east of town was removed from the abutments.
Since the rain, the weather has been
quite chilly, rendering thick clothiug and
fires necessary for personal comfort
REDEMPTION OF FORFEITED LANDS.
The comptroller-general has written a letter
to an Aiken lawyer in reply to the question
"if lands bought by the State for want of bidders
at a delinquent land sale can be redeemed
within ninety days by the original owner."
To this the comptroller replies as follows:
"I have the honor to reply that the act ol
the General Assembly 'providing for the assessment
and taxation of property.' (Section
108,) approved September 15, 1868, provides
that if the lands advertised at a delinquent
land sale of real estate not in cities, towns and
villages cannot be sold for at least one-fourth
of its assessed value, that the county auditor
shall purchase sufficient thereof at that rate
for the State, to satisfy the tax, costs and
penalties thereon, but this portion of the said
Section 108 was repealed by the act of March
19 1879 and now there is no law on our
statute books that gives the county auditor or
any other officer any authority to purchase
any real or personal estate for the State on
account of any tax ; hence lands cannot be
'bought by the State for the want of bidders.'
"The only mode the State has, or can get
any title to land offered at a delinquent land
sale, is in the manner prescribed in the revised
statutes, title 3, chapter 13, section 34, viz.,
by forfeiture, such lands not being sold for
the want of bidders.
"The same section (34) emphatically declares
that the county auditor shall designate
such lands as are 'not sold for the want ol
bidders' as 'forfeited,' and that 'the right, title
and interest' of the former owner therein shall
be vested in and transferred to the State ol
South Carolina, while section 35 (following)
declares how the county treasurer shall have
credit for the 'forfeited list' in discharge ol
his indebtedness. If you will note carefully
sections 36 to 46, inclusive, I think you will
decide with me that these eleven sections provide
only for the redemption of lands 'sold at
delinquent sale,' and not to those 'not sold for
want of bidders,' otherwise 'forfeited.' I know
? of no law in the State which refers to lands
forfeited to the State for taxes of 1872 save
that above noted, and when I refer to the
joint resolutions of the General Assembly,
session of 1872-73, I there find that twelve
(12) of these thirty (30) resolutions expressly
relate to the redemption of 'forfeited lands'
by the former owner, and made 'forfeited' in
previous years by Section 34 above quoted.
The action of the General Assembly by its
joint resolutions confirms ray opinion as to the
previous acts, and I can only decide that all
lands, 'offered for sale at any delinquent land
sale' and 'not sold for want of bidders', are
forfeited to the State and must be so held until
sold by an 'act' or redeemed by a joint resolution."
