B 8ALE8-DAY. ? [ Comparatively few persons from the country were o in town on Monday, and there was little public ? . business. The sheriff re-sold the Broad River Cold g E Mine, at- the risk of. the former purohaser, for t ft $500. It was bought by H. D. Stowe. This prop- v ^ erty^was sold three months ago for $10,100, and ^ was bid off by L. M. Seacrest. The sheriff also sold a tract of land belonging to Gr. W. S. Legare, lying on the South Fork of 1 Fishing Creek and containing four hundred acres, c for $600. Purchaser. S. P. Hamilton, of Cheater. * Thomson & Jefferys, Assignees in Bankruptcy, I re-sold at the risk of the former purchaser, a tract ? of land, the property of Samuel Black, containing t two hundred aud forty acres, at $5.50 per acre, to 1 S. G. Hemphill. Hubbard, holding the office of State Constable o of South Carolina, was arrested in this city on a S * * ? ?? -L- n warrant issued Dy justice juis, upou tue amunviv of William R Flint, charing him with the offence c of false imprisonment The accused was taken be- J fore Justioe Ells that night, and being unable to p give the bail required?one thousand dollars?was ? committed to the city jail to await an investigation, v On yesterday morning the prisoner was again I brought before Justioe J?lls, on a warrant issued at j I the instance of Pleasant Sharpton, charging him c k 4 with the same oflfeDce, and bail required in the ? ' * same amount as in the previous instance. The 5 f case is a very singular one. . . In the early part of last month a row occurred in the neighboring town of Hamburg, South Caro- i lina, which resulted in the wounding of the town 3 marshal, Kennedy, by a young man named Keyes. _ On the fourteenth of that month Hubbard arrived in Hamburg from Columbia, armed with authori- y tv from the Governor of South Carolina to arrest Keyes and all other parties supposed to have been p implicated in the shooting affair. On his arrival * in Hamburg, Hubbard and his deputies arrested several of the citizens of the place on suspicion, among others, the two complainants, Flint and Sharpton. On the evening of the 14th, the pros- ecu tors allege that Hubbard and his offioers brought them from Hamburg and the State of T South Carolina into this city, and procuring a room . at the Globe Hotel, confined their prisoners in it P until next morning, despite the fact that this hotel " was 'situated iu the State of Georgia, and not within the jurisdiction of South Carolina, On the morning following this imprisonment, the party went to Columbia, and after an examination the - prisoners were released on bail and returned to V their homes. On last Saturday night Mr. Flint . became aware of the presence of Hubbard in this * city, and took out a warrant for his apprehension. P He was discovered that night about ten o'clock by ? the officers, on Ellis street, and was arrested and carried before Justice Ellis, with the result above f described. ^ The accused denies the charge, of conrse, and gives a very different version of the affair. He says that after having arrested the parties in Hamburg, being unable to leave for Columbia before the uext morning, he found it impossible to obtain lodgings for the night in the former place. Ac- 1 coraingly lie released two of his prisoners on parole, J ; accepting their promise to meet him at the rail- ^ ' way station next morning; Messrs. Sharpton and i Flint he proposed should accompany his officers and himself to the Globe Hotel in this eity for the night, at the same time informing them that as soon as they touched Georgia soil he would, of course, have no authority over them, and if they remained with him they would do so voluntarily. ? These terms, he says, they accepted, and' spent that night at the hotel, without the employment of any force whatever, and next morning accom- i pauied him to Columbia. This, we confess, does not sound like a very probable story, and circumstances are certainly against the accused. Hubbard appeared very indignant yesterday j morning at bis examination, that a gentleman so loyal as himself, and one holding so high a position under a loyal State government, should be arrested and incarcerated on the affidavit of two Ku- ? Klux Democrats. When the amount of his bail had been decided upon, he immediately sent a dispatch to Governor Scott, informing the latter of T his difficulty, and then went up town, in the cus. tody of an officer, to search for bondsmen. Later ^ ' in the day Governor Scott sent a telegram to this W- city announcing that he would be responsible for _ J the amount of bail required, and, on the strength of this, bail was procured, and the prisoner re- -. leased until next Monday morning, wheu he will J appear before Justice ElUs for a preliminary exam- <. ination. The accused is coarse looking, but well r made, sports an enormous blaok moustache and 1 seeins to be a man of a great deal of intelligence and shrewdness. He says that for some time past j" he has been on the track of a man named Briscoe, (_ whom he styles a "notorious desperado and bushwhacker," who has committed many murders in South Carolina, and for whose apprehension there has been a reward of $5,000 offered. He says that he had laid a trap for him which would have re- i suited in his arrest on Saturday night, had he not J been arrested himself. The accused was represented yesterday morning by Major J. P. Carr, and the State by 31 r. J. (J. C. Black. The Chronicle of the 6fh instant states that Hubbard was held to bail for five hundred dollars in each case, to insure his future appearance. ^ Upttroal.
