NINETEENTH DAY.
Thursday, Februaty 6.?The Convention as
sembled at 12, M.
The convention proceeded to the oonsideratioi
of the special order for twelve o'clock, namely, th<
report of the Committee on the Bill of Rights.
B. 0. Duncan, of Newberry, moved to strik<
k out from the first section the words "born free anc
equal," so that it would read "all men are endow
ea by their Creator/' &c.
He said that until a man became of age he car
tainly was not free ; consequently the statemen
was not true, and he wishea to see nothing in th<
constitution that was not literally correct
C. C. Bowen offered the following amendment
as a substitute: "All men are born equally free
and independent, and have certain natural inhcr
ent and inalienable rights."
R F. Whittemore said he would like to ask th<
mover of the above how people are born indepen
dent All men are born free and equal politically;
and, whatever may be the aspirations or qualifica
tions of individuals, they are. entitled to th^e privi
leges enjoyed in oommon. ;
G. Lee moved to lay the amendments on the ta
ble, and the motion being agreed to, the questior
recurred in passing the first section to its third
readiog, and it was decided in the affirmative.
Section 2 was read, on motion of B. 0. Duncan,
modified verbally, and passed to its third reading.
Section 3. B. 0. Duncan offered as a substitute
the following:
"All political power is originally vested in and
derived from the people, and all free governments
arc founded on their authority and instituted foi

B. F. Whittemore contended that the amendment
changed the entire character of the section,
which declared the right of the people at all timcf
jjgf to modify their form of government.
A motion was made to lay the amendment on
the table, whereupon the President explained that
such a course was unparliamentary unless it wa*
designed to carry with it the original proposition.
The proper way to get rid of an amendment was tc
vote it down.
Mr. Duncan urged that as the idea was already
expressed in the Bill of Rights, its repetition waf
unnecessary.
C. C. Bowen favored the amendment. He
said that it was upon the identical phraseology
of section 3 that the discussion and difficulty arose
which led to the war.-and he saw no object in perpetuating
it in the forthcoming constitution. It
was known as the States Rights clause, characterized
as such, and, in nearly all of the constitutions
lately formed, has been left out.
J. H. Jeuks considered, -tho section, as it stood,
revolutionary. No clause ought to exist in the
constitution upon which caupe raised a question
as to the paramount authority of the United States.
A. J. Ransier, colored, said the Bill of Rights
expressed and embodied this idea. The right of
secession was denied in toto. The section in question
simply provided that the people may at will
modify and change their form of government.
Further discussion followed at some length, and
the amendments being voted down, section 3 passed
to its third reading.
On motion of F. J. Moses, Jr., the vote on
\ Section 2 was reconsidered, for the purpose of
k making the following substitute, which, niter debate,
was agreed to: "Slavery shall not exist in
this State, neither shall involuntary servitude, except
as a punishment for crime, whereof the party
shall have been duly convicted."
Section 4 was read and passed to its third reading
without objection.
Section 5 was amended, on motion of G. Pillsbury,
by the insertion of tho word "shall" as a
substitute for "ought to," so as to make it read
that "all attempts to dissolve the Union shall be
resisted," &c.

Moses, substituting the words "disconnect from"
for the word "dissolve," but the motion was no!

Sections 5 and 6 then passed to a third reading.
C. C. Bowen moved to strike out the section '
on the grouud of superfluity, and after considerabh
debate the motion was agreed to.
Sections 7 and 8 were passed, and the conventioi
adjourned.

After discussion and attempted amendment, th(
report of the Committee on Rules and Regula
tions, fixing the hours of session hereafter betweer
half-past 10 A. M., and half-past 2 P. M., wai
adopted.
On motion of R. C. DeLarge, the convention
r resolved itself into a Committee of the Whole (J,
M. Rutland in the chair), and took up for conside
ration the unfinished business of yesterdav, being
the 9th section of the Bill of Rights, which read;
as follows. '
Sec. 9. In prosecutions for the publication o
? papers investigating the official conduct of officer
or men in public capacity^ or when the matter pub
lished is proper for public information, the trutl
thereof may he given in evidence ; and that in al
indictments for libel, the jury shall have the righ
to determine the law and the faots under the di
rection of the court.
Several speeches were delivered, and amonj
* others, one f>y the President of the Convention
Dr. Mackey. He concluded his remarks by offer
ing tbe following resolution:
Resolved; That the committee of the whole no\
rise and report that they have had the ninth sec
tion under consideration, and recommend that th
words "have the right to determine the law ant
facts under direction of the court" be stricken ou
and these words be inserted, "the jury shall b
judges of the law and fact."
The resolution was agreed to, the committee rose
reported progress, and the convention adopted it
report.
With but slight amendments, most of tben
verbal in character, the convention then passed sec

The I8th, 19th, and 20th sections of the Bill o
Rights were passed without material alterations
The News in commenting upon the proceedings c
the day, says:
''Three or four days more may be consumed ii
the consideration of the Bill of Rights, and thei
will come up the next article of the future consti
tution?namely, that referring to the judiciary.
From conversations on the floor, it is evider
that the action thereon will not, by any means, b
so unanimous as the action at present. The pre
position to throw the election of the judiciary int
the hands of the people?a mass of votere, the m;
jority of whom are not possessed of intelligence?i
regarded as a dangerous blow at the interests an
institutions of the State. Some of the best men i
the convention are said to be preparing to mate
fight upon the question; and the general wish <
the country, as far as we know, is that they sha
succeed in defeating the measure. If not defeater
the ratification of the future constitution is by n
means a certainty.

The reports from Standing Committees being
called for, W. E. Rose, from the Committee on
Petitions, made a report on the resolution to appoint
a committee to report to the convention the
names of such persons as desire to have their disabilities
removed, and recommend that, in lieu of
y a committee, parties wishing such a privilege accorded
should apply to the convention by letter.
The Committee on the Miscellaneous provisions
of the Constitution, made a report on a resolution
providing for the organization of the militia, ana^
recommend that the following be adopted as an article
in the constitution:
"The militia of the State of South Carolina shall
consist of all able bodied men, residents of the
State, between the ages of eighteen and forty-five
years, except such persons as now are or may hereafter
be exempt by the laws of the United States
or by the State; and shall be organized, equipped
and disciplined as the General Assembly may by
law provide."

THE BELL OP RIGHTS.
On motion of Mr. Holmes, of Beanfort, section
20 was re-considered, whereupon N. G. Parker offered
the following as a substitute:
"All offences less than felony, in which the punishment
does not exceed a fine of one hundred dollars
or imprisonment for thirtv-days, shall be tried
summarily before a justice 01 the peace or other
officer authorized by law, on information, under
oath, without indictment or the intervention of a
grand jury, saving to the defendant the right of
appeal; and no person shall be held to answer for
any higher crime, unless on presentment before a
1 grand juiy, except in cases arising in the army or
i navy, or in the militia, when in service in time of
war or public danger. _.
; Considerable discussion ensued, but the substi|
tute was finally adopted and passed to its third
. reading.
Section 21 received its second reading. It is as
. follows:
(; Section 21. No person Bhall be imprisoned for
; debt, except in cases of fraud; and a reasonable
amount of property, as a homestead, shall be cxt
empted from seizure or sale for the payment of
; any debts or liabilities, except for taxes, that may
' be contracted after the adoption of this constitution.'
> Several amendments were offered, and debate
. followed, which was participated in by Randolph,
Whittemore and others. Whittemore offered an
[ amendment to strike out all after the word "sale,"
. and insert "except for the payment of such obligations
as are provided for in this constitution. " Af.

grain has an upward tendency, and the rates

ushels of Maryland came to hand per steamer, a
1 part of which was sold at $1.45 per bushel, weight,

prices, during the week, have continued

There has been moderate receipts of Baltia
more grades, which are offered at $11 to $12 per

City Mills Family is selling at $14.50 per barrol.
There is a fair demand for Northern Middling,
which is held at $8.50 to $9.50 per barrel.
Bacon.?There has been an improved inquiry,
f and prices are quite firm, the stock of many kinds
being very low. Prime Western Shoulders may
^ l>e quoted at 12i cents per pound ; Prime Western
i Ribbed Sides at 14 cents, and Prime Western
Clear Ribbed Sides at 14i cents per pound. Bright
a second quality Meat sells at 10 to 11 cents per

God in infancy, and, early in life, made a public
profession of religion. In her last sickness, she
was patient and submissive; conversed with her
Pastor of her fears and of her hopes?hopes which
rested onlv on Jesus?He alone was precious, and
in her sufferings she was able to commit to Him
her soul, as unto a faithful creator.

EMIGRATION
AND REAL ESTATE AGENCY.

the purposo of inviting foreign emigrants and
others to settle in this and the adjoining Counties
and Districts. Our aim will be to supply the emigrant
with a cheap homestead upon liberal terms.
We are now establishing agencies in Germany,
France and the principal .Northern titles, where
me superioi auvamages this country attorns to
emigrants will lie fully explained, as there seems
to be a general desire'to have our surplus lands
occupied by the thrifty emigrant, whose industry
and energy will greatly add to the general prosperity
of a country. We invite all persons having
surplus Lands to offer them, through us, for sale
upon liberal terms. It is only by such a course
that our object can be accomplished. Our aim
will also be to supply labor in all its branches
chiefly by emigrants. Wo will also buy and sell
City property upon liberal terms.
