A MILLION WANTED. s. < R. N. Cain, colored, offered a long resolution to petition the Freedmen's Bureau to loan a million of dollars to the State* to be invested in the purchase of lands for the benefit of freedmen, these lands to be divided into ten, twenty, forty, sixty, and one hundred acre tracts, and sold to the freedmen or others, who are to have five years in which to pay for the same. Referred to Committee on Petitions.. THE FREEDMEN'8 BUREAU AND EDUCATION. The report of the committee reoommending the continuation of the Freedmen's Bureau, and that a Bureau of Education be established as soon as practicable, was taken up, discassed by B. Byas, of Berkeley, and B. F. Randolph, both colored, ^ and adopted. The report of the ooramittee that the convention has power to legislate, as far as may be'for the good of the people was, on motion of E. W. M. Mackey, laid on the table. CONTRACTS BASED ON SLAVES. 8 The report of the committee on the above sub- t ject, coming up next in order, was read a second ( time. c Mr. J. M. Rutland thought it was not proper i for the convention to consider this subject. He a thought it should be left to the courts of the coun- t try to determine whether contracts were void or s not Their business was to frame a Constitution c for the State.'and reasons had been assigned why t it should be done speedily. The matter of con- c tracts he regarded as peculiarly within the prov- g inoe of the courts. - c A measure of this character smacks a little of a revenge upon parties to whom debts for slaves are due. He was no advocate of the moral rights of c slavery and had never believed that one man had r a right to own another and call him his property. But such was the law of the land. Slaves were v property and they were bound to recognize that s Fact If it was the object of the convention to punish parties who dealt and trafficked in slaves, \ this measure would not do it It would punish { those who sold, but pay a premium to the purchaser who had not fulfilled his obligation to pay. He c hoped the convention would not dabble in this matter. The question should be left exactly where they found it Mi1. S. Corley, by consent of the convention, 1 read the argument which he had prepared on the subject He considered the resolution invalidating all contracts for the purchase or sale of slaves, t as of doubtful utility, ana & highly dangerous precedent for the guidance of future legislation. The ( Constitution of the United States denies the right r of any State to pass an ex post facto law, or any t law impairing tne obligation of contracts. This v resolution was a violation of that plain principle, b The idea that because man cannot be rightfully 5 held as property, is no reason, in a moral sense, I that there is not and cannot be any leeal right to a his services as such, is fallacious. Perhaps more d than half the members of the convention could t testify that they once held slaves, bought and sold oa nmrw>rh7. and lptmllv held as such. No reason. therefore, ooald be urged for setting aside each f contracts. There was no difference between the buyer and seller, in a moral sense. If the act of b the speculator was criminal, that of the purchaser t' was equally and even more so. If the purchaser, a in his own estimation, received the value for his v obligation to pay, it was not the legitimate business t of the convention to inquire whether he was a fool t or an idiot for purchasing. The legal right of the u master being forfeited by the war, and the United n States Government denying the moral right to g hold such property, the legal right reverted to the t original owner, the slave himself. o He was not willing to relieve one class of citi- h sens at the expense of another. Personally, he I bad no interest in >the matter, having never sold or bought a slave. While yet a boy he vowed eter- c nal hostility to slavery, and determined never to t claim for himself any right which he denied to n others. For the last twenty-five years he had been persecuted because of his devotion to freedom and n the Union. He thanked God that he had at last o the opportunity, as the representative of the free n people of his native District (Lexington), to vin- s aicate his right of free speech. He claimed, how- n ever, no right which he would deny to others. He demanded that while he and his non-slaveholding o friends were required to pay their debts, that eve- c iy quandam slaveholder should also pav his debts, a Mr. Whittemore moved that the subject be discharged, and made the special order for one o'clock ii Monday. r the per diem of members. fi The special order.being the unfinished business n of yesterday, the ordinance providing for the pay of members was taken up, and after much discus- j( sion and many motions, in which the attempt was made to reduce the amount, it was passed to its third reading, and ordered to be engrossed in the r following shape: ? Cooghlan, white, of Sumter, offered the following resolution: Resolved That this convention take such action as it may in its wisdom deem compatible with its z powers, and conducive to the pubhc weal, to expunge forever from the vocabulary of South Caro-. a Jina the epithets "negro," "nigger" and "Yankee," as used in an opprobious sense. That the B exigencies and improved civilization of the times B demand that this convention, or the legislative g body created by it, enact such laws as will make it a penal offence to use the above epithets, in the manner described, against any American citizens of c \ this State, and to punish the insult by fine or im X prisonmcnt Referred to the Committee on Miscellaneous e Provisions of the Constitution. Corley, white, of Lexington, offered the follow- ^ ing, which was referred to the Committee on the q Judiciary: c Whereas, The rebel legislature of South Caroli- E na did authorize guardians to invest the funds of * ' their several wards in Confederate bonds; and whereas, the present provisional government fully q endorses the justice and legality of the said act, by n the operation of which many innocent and helpless s orphans have lost their entire estates, and the said v bonds are now being tendered by guardians in d lieu of United States currency in settlement of such claims; therefore Resolved, That in the opinion of this convention all legislation authorizing the tender of Confeder- <; ate bonds by guardians in settling the claims of their wards, is a monstrous wrong, contrary to the con- ? stitution and laws of the United States, and therefore null and void; and that all parties concerned c are now m precisely tne same legal relations as , though no such legislation had been enacted ; and tha^the Committee on the Judiciary be directed t to prepare an ordinance which will reach all cases r of this complicated swindle, and determine wheth- r er any guardian, who has sold property and invest- J , ed the proceeds during the rebellion, shall be en- J! titled to any favor on that particular ground. CAPITAL PUNISHMENT. S. Corlcy, white, of Lexington, offered a resolu- q tion which provides that no violation of the laws of q the State shall be deemed a capital offence. That v imprisonment for life shall be substituted for the " death penalty, aud thatfora less offence than mur- i der, the period of incarceration shall be graduated r to accord with the moral progress of the criminal, t conforming to the provisions of a wholesome pris- p on discipline. UNIVERSAL CHARITY ON THE RAMPAGE. A. C. Richmond, white, of Berkeley, offered the following resolution: - ' 1 Whereas, Several of the members of the body consider it desirable to offer numerous and divers v esolutions, apprehending, possibly, that the voice >f the people may be heard, asking why all the ielegates do not offer resolutions for the goodo?, he people?that the homeless shall have noii)?*C he houseless houses, the ^antHfcss lands, the moniyless moneys that debtors shall be debtors no more, < Confederate scrip no scrips and everybody free from dn, therefore, be it _w. Resolved, That of one blood were made all the , rntions of the earth; that the poor shall always^te- vith us; that the hungry will always need food, he naked clothing, the landless land, the homeless , lomes, and the moneyless money?in fine that fiiure legislation shall be in the interests of hunanity, for justice and protection to the poor and ecurity to the rich. Timothy Hurley moved that the resolution be J eferred to the Committee on Spiritualism, but it ras finally laid on the table. FROM GENERAL CLITZ. B. F. Whittemore, from the special committee tppointed to confer with Brig. Gen. Clitz, report- 1 id that that officer stated that by order of Major 1 General Canby, he requested the Mayor of the Aiy yesusrutiy IU IUIUIMI a oci^cautauuuvu nen that they might be in attendance at the hall, ind ready for any order from the President. That hey were sent here for the purpose of preventing ; m occurrence similar to that which took place up- : in the floor the other day, between a member of his convention and a representative of the press if this city. The General also remarked that the 1 ergeant had no instructions to come upon the floor | if the hall, but was to remain outside ready to repond to any call. F. J. Moses, Jr., moved that "the explanation if General Clitz, asconveyed by the committee, be . eceived as satisfactory.'' That all proceedings to enforce satisfaction r payment of judgments or decrees rendered, reorded, enrolled, or entered up on such contracts in ,ny court of this State, are hereby prohibited. 3d. That all orders heretofore made in any court a this State, in relation to such contracts, whereby ropertv is held subject to decision, as to the vaidity of such contracts, are also hereby declared roll and void arid of no effect The question was discussed until the hour of ad- , ournment, without reaching any definite result I ? i The Bankrupt Law.?For the benefit of our ' eaders, and those who may wish to take the bene- ! it of the Bankrupt Act, we publish the following rem the Edgefield Advertiser : \ "There is said to be great diversity of opinion j mong lawyers and commissioners in bankruptcy as o when the fifty per centum clause of the bank- j upt law went or will go into effect, and that the ' iuestion will probably be submitted to Chief Jusice Chase for decision. A glance at the law itself ' rill show that there is no ground upon which to iase such a doubt. In section 33d it is provided: 1 'And in all proceedings in bankruptcy commenced ! ne year from the time this act sh*!' go into operaion, no discharge shall be granted to a debtor , rhose assests do not pay fifty per centum of the < laims against his estate, unless the assent, in wri- < ing, of a majority in number and value of his cred- j tors who have proved their claims is filed in the ase at or before the time of application for dis- j harge." . _ ( The act went into operation June 1, 1867. To Raise Supplies for the Town of YorkvQle,for the fiscal year, ending in February, 1868, and to m Impose a Tax upon the citizens thereof : BE It Ordained by the Town Council of Yorkville, now met, and by the authority of the same, that for the purpose of raising supplies for the Town of Yorkville, S. C., for the fiscal year ending in February. 1868, the following Taxes are imposed upon the citizens and inhabitants of said Town, to be paid on or before the 10th day of February next, in-United States Currency, to wit: 1st On all real estate within the Corporate limits of said Town, to be paid by the owner or person in possession of the same, one-fourth of one per cent, on the assessed value thereof, recently made by Commissioners appointed for the purpose. 2nd. On each Dray, Hack, Cart, Wagon or Omnibus, drawn by two horses or mules, Three Dollars ; drawn by one horse or mule, Two Dollars; each wagon, drawn by four horses or mules, Five Dollars; each carriage, drawn by two horses, One Dollar; each buggy, Fifty Cents. 3rd. On each male inhabitant, over twenty-one years of age. Fifty Cents. ' * 4th. On all stock in trade, Ten Cents on every hundred dollars' worth of the same, on hand January 1st, 1868. 6th.
