THE POWERS OP THE CONVENTION.
J. J. Wright, colored, from the committee on
the Judiciary, to whom was referred a resolution
of inquiry as to the legislative powers of the convention,
report that the committee are of the opiniou
tnai the convention has the power to legislate
as tar as thev may consider it; proper for the
good of the people.
On morion of F. J. Moses, Jr., white, the report
was made the special order for one o'clock tomorrow.
ABOLITION OF DISTRICT COURTS.
From the same committee, J. J. Wright reported
that the ordinance providing for the abolition
of the District Courts was, in their opinion, unnecessary,
siuoe the subject would be embraced in
I the report of the committee with reference to the
judiciary of the State.
The report was adopted.
AFTER THE BANKS.
C. M. Olsen, white, a Dane by birth, and one
of the most respected and intelligent members of
the convention* offered the following resolution,
which was referred to the committee jn Finance;
Resolved, That all banks and savings institutions
in this State which suspended payment during the
rebellion shall, immediately after the ratification
of the State Constitution, go into liquidation.
PUBLIC SCHOOLS.
B. F. Whittemore, white, offered a resolution
that no township or school district shall reoeive
any portion of the public school fund unless a free
school has been kept therein three months; the
legislature to have power to require every child in
the State between the ages of five and eighteen to
go to school for a term equivalent to sixteen
months, unless educated by other means. Referred
to the committee on Education. ?
, REPUDIATION.
R. G. Holmes, white, of Beaufort, introduced a
resolution, which was referred Ho the committee on
the Legislative part of the Constitution, that no
? debt contracted by South Carolina, during the war,
shall be paid by any act of the legislature of this
State.
NO DISTINCTIONS.
B. F. Randolph offered a resolution, which was
voted down, that the constitution shall hereafter
I make no distinction on- account of color in such
laws as it may adopt with reference to the public
'schools.
J. J. Wright moved that the resolution be indefinitely
postponed, and it was agreed to.
SHERIFFS, MAGISTRATES, AC.
J. M. Runion, of Greenville, who appears, from
the character of the resolutions, he offers, to be
fishing for political popularity more than the read
welfare of any particular class, moved that sheriffs,
magistrates, <tc., be elected bv vote of the people,
annually, for four veare, and that for four years
thereafter they shall be ineligible to office. Referred
to committee.
ASTAT-LAW.
The next special order of the day was the resolution
requesting General Canby to suspend all
sales of property for debts contracted prior to
June, 1865.
The object of the opposition was to kill it by
amendment. Two or three were offered, when
DeLarge, colored, called for the previous question.
Subsequently this was reconsidered, and T. J.
Robertson, Esq., read a speech which he had prepared
on the subject
He claimed that those who had brought about
the impoverished condition of the country were
not the poor men or the loyal ment but those who
pretend to represent its wisdom, intelligence and
wealth.

laws and homestead laws. Some of them assert
| that they cannot live in this conntiy?that a war1
w of races is inevitable. They are the principal
debtors of the State, and do not want to pay their
debts, and they never will, so long as they have
unconstitutional stay-laws to protect them.
For one he would say, let the property of the
country change hands, and if lanas sell cheap, so
much better for the poor man of the State, because
it will enable him to provide himself with a
home, and thus identify himself with the soil.
[Mr. Robertson did uot say, in "this connection,
that with one hundred of his four hundred thousand
dollars, he expected, on the first of February
next, to absorb the property of probably seventvfive
poor farmers and turn them adrift in the world
to seek homes elsewhere.]
The meu, said the speaker, who are asking for
relief, are those who ao not recognize the validity
of the Reconstruction acts of Congress, and
who refused to vote for delegates to this convention.
Some of them called the convention a menagerie,
but it is the menagerie which is to protect
their property at the expense of the loyal citizens
and working men of the countiy.
The speaker continued in this vein, so well calculated
to appeal to the passions of the colored element,
and wnen Mr. Robertson took his seat, he
was followed by R. H. Cain, of Charleston, a colored
preacher, who said that the only reason why
this peculiar question was before the house was because
it affected the poor man as much if not more
than it did the rich. He was in favor of measures
of relief, but did not believe that any act of the
k convention could effect relief in such a manner as
L would be either just or constitutional. Even if it
possessed the power, the men to be most greatly
Benefitted by the passage of the resolutions belonged
to that class who, since the war, have done all
they could to antagonize the true progress of the
country. If these people had made contracts they
had done so with their eyes open. If they now
? suffered it was oply in consequence cf tBeir own

any relief whatever. They not only should sell
their lands, but he would make them sell their
lands and give the poor man a change.
The remarks of Cain were thoroughly revolutionary
in their character, adroitly maue, and well calculated
to arouse, as he intended they should, the
passions of the colored delegates. The speech will
probably have the effect of dividing the two races
on the floor, breaking all combinations of moderate
men, and dragging such as Whittemore, Bowen,
Whipper, Wright, Laugley, and others into the
ranks of the negro extremists.
We said at the beginning of our reports that the
negroes had the advantage of intellect on the floor,
ana a few more such exhibitions as those of Cain
will draw the white men, body and soul, into the
range of colored control. No colored man will risk
his reputation by answering Cain, or put himself
beyond the pale of his party by antagonizing what
arc not evidently the prejudices of the convention.
The hour of adjournment arrived in the midst of
the debate, and the convention accordingly "rested
^ from its labors."

Friday, January 24.?The Convention assembled
at 12, M. The whole of the session was consumed
in debating the question, whether General
Canby shall be petitioned to suspend sales of property,
under execution, fora period of three months.
The News says, in speaking of the day's proceedings,
that "the fight 6n the question was fierce,
noisj*, and characterized by tne best imitation of
parliamentary pyrotechnics, of which the delegates
are capable." The Convention adjourned, at 3
o'clock, P. M., in the midst of the debate.

Saturday, Jan'y 25.?The President laid before
the body a communication from Major D. T. Corbin,
accepting the office of Solicitor of the convention
in conjunction with Major C. D. Melton.

acres of land which are now, or prior to the expiW

The resolution which has been under discussion
for two or three days, requesting General Canby to
suspend for three months all sales of property under
execution, was taken from the table, and on
motion of F. J. Moses, Jr., the previous question
was ordered. Mr. Moses being entitled to the floor
for one hour, occupied that time in making an elaborate
speech in defence of his measure. The hour
having expired, the question was taken by ayes and
noes, and it was decided to petition General Canby
to stay for three months, all executions for debts
contracted prior to the 30th of June, 1865. The
ayes and noes on the question stand as follows:

A curious feature of the above vote, that of the
ayes, thirty-five are white and twenty-two are colored
; of the nays, twelve are white and forty are
colored. This being a test vote on a very important
question, the spirit of the convention is fairly
illustrated by its publication.

B. F. Whittemore, white, of Darlington, offered
the following resolution, which was agreed to:
Resolved, While themcmbers of this convention
will not favor any scheme for the repudiation of
debts, the violation of the obligation of contracts,
or the taking of lands from the hands of the lawful
owners of the same, without reasonable compensation,
yet we are willing to further any measure
of relief consistent with the powers delegated
to us by the Reconstruction Acts of Congress.
The Convention then adjourned.

Monday, Jan. 27.?The Convention met at 12
o'clock, M., and was opened with prayer.

Reports from standing committees were then
called for, and F. J. Moses, Chairman of the Executive
Committee, to whom were referred the preamble
and resolutions recommending the removal
of State officers, declared that the removal of these
officers at the present time would be prejudicial,
and they recommend that the preamble and resolutions
be laid on the table, believing that the removal
of such officers should be left to the people.
It was moved that the preamble and resolutions be
laid on the table, whicn was adopted with a few
dissecting voices, ?

reported the following ordinance:

We, the people of the State of South Carolina,
by our delegates in Convention met, do ordain:
That there shall be assessed and collected by the
Tax Collectors of the several Districts and parishes
in this State, in additional to the tax already levied,
under General Orders No. 139, issued from Headquarters
Second Military District, bv Brevet Major-General
E. R. S. Canby, dated Charleston, S.
C., December 3, 1867, Commanding said District,
the following taxes, which shall be collected by the
persons and at the times and in the manner prescribed
by the said General Orders.
On all real estate 75 cents on every $100, excepting
such lands as are exempted in article first of
said General Orders.
On all articles manufactured for sale, barter or
exchauge, between the first day of January, 18C8,
and the first day of January, 1809, 10 cents on
every $100, to be pajd by the manufacturers.
On buggies, carriages, gold and silver plate,
watches, jewelry and pianos on hand or to first day
of January, 1868, except when held by dealers for
purposes of sale, twenty-five cents on every $100.
From the sale of goods, wares or merchandise,
embracing all the articles of trade, sale, barter or
exchange (the Cotton tax of the United States excepted),
which any person shall make between the
first day of January 1868, and the 31st day of December,
1869, 10 cents on every $100.
Upon each hack, stage coach, buggy, wagon and
omnibus drawn by two or more horses, there shall
be paid a tax of $5; and on each dray, cart, buggy
and express wagon drawn by one horse, a tax of
$2.50; and upon each and even,' person keeping a
dog or dogs, Bhall pay a tax of 50 cents.
And the tax collectors, Sheriffs, or any other
fsrson whose duty it may be to collect, or the
reasurer of the State, whose duty it is to receive,
shall be liable upon their respective official bonds
for neglecting or refusing to collect, safely keep,
pay over and disburse the same in conformity to
the order of the Convention.
Sec. 2.Beit further ordained. That a sufficient
amount of the sum thus realized, is hereby appropriated
to refund to the Treasurer of the State
of South Carolina, any sum or sums, which may
be advanced by the order of Brevet Major-General
E. R. S. Canby, or otherwise, for the payment
of the per diem, mileage, or other expensj^,
of this Convention.
Sec. 3. Be it further ordained, That the funds
on credit of the State are hereby pledged for the
redemption of bills receivable of the State of
South Carolina, issued in conformity to an act
of the General Assembly of the said State, of
December, 1865, and susequently the act of September,
1866, and also for the payment of tne
bonds and other obligations of the State ; provided,
that all obligations created for the purpose
of aiding the rebellion, and for maintaining a not
tile government to the laws and authorities of the
United States, are hereby declared to be null and
void, and shall never be paid by any tax to be im~<sr,aJ

Sec. 4. That for the purpose of defraying the
current expenses of this Convention, the payment
of its officers, members and contingent accounts

Second Military District, be requested to issue
from time to time, as may be necessary, such orders
upon the Treasury of the State of South Carolina,
lor the payment of such sums as may be authorized
by this Convention, in such amounts as
may be agreed upon between the President of this
Convention and the General Commanding, to the
officers and members of this body for their per
diem and mileage, and for the current expenses of
the same, and that the amount of tax herein authorized
to be levied, shall be placed in the Treasury
of the State, to reimburse said advances.
Sec. -5. Be it farther ordained\ That if the taxes
levied and assessed under this ordinance should
be in excess of the whole expenses of the Convention,
it shall be retained in the Treasury, subject
to the future order and in conformity to the provisions
of the Constitution to be adopted by this
Convention. Should there be any deficiency in
the sum required to be raised by taxation under
this ordinance, to reimburse the Treasury for its
outlay, the first Legislature which assembles hereafter
shall make such further provisions as may be
necessary to raise funds for this purpose.
Sec. 6. Be it further ordained, That the per
diem of the President and members of this Convention
shall be:

Sec. 7. Be it further ordained, That the mileage
of members and officers of this convention

convention, by the usual mail routes.
Sec. 8. Be it further1 ordained, That all payments
made, in conformity to the several provisions
of this ordinance, shall be upon the authority
of the President of this Convention, upon therecommendation
of the Finance Committee.
The ordinance was passed to its second reading
by its title, and made the special order for Tuesday,
at 12 o'clock.
The Chairman then stated that he wished to be
relieved from any delicate position in which he
might be placed during the debate on the subject
of pay ana mileage, by explaining that when first
nominated by his constituency, he had determined
not to receive any compensation, on the ground
that as Collector of the Port, he received a salary
from the United States Government, and he did

the convention at the same time, either as delegate
or chairman, and his determination on that subject
was analfercd and unalterable.
SALE OF LANDS IN SMALL TRACTS.
E. W. M. Mackev offered a resolution that a
clause be incorporated in the constitution providing
that hereafter in sales of all lands either for taxes
or executions of whatever sort, the lands shall not
he sold in lots of more than one hundred and sixty
acres, for the purpose of enabling all, by their own
frugality and economy, to provide themselves with
a homestead. Referred to the Committee on the
Miscellaneous provisions of the Constitution.
B. F. Whittcmore introduced a resolution to the
effect that, as the convention had passed a resolution
to renuest Genereral Canby to stay cxecu-J
tions, and thus relieve the landholders of the State,!
that the convention now request the same officer
to prevent the withholding the laborers' share of
the crop on account of dents due from the laborer
to the employer, and also to prevent the enforcements
of claims against laborers for four
months. Referred to the Committee on Petitions.
The hour of 3 P. M. having arrived, the chairman
declared the convention adjourned.

Southern qualities are in very light supply,

To Raise Supplies for the Town of YorkviUs^/or
the fiscal year, endina in February, 1808, and to
Impose a Tax upon the citizens thereof:
BE it Ordained by the Town Council of Yorkville,
now met, and by the authority of the
same, that for the purpose of raising supplier for
the Town*of Yorkville, S. C., for the fiscal year
ending in February. 1868, the following Taxes are
imposed upon the citizens and inhabitants of said
Town, to belaid on or before the 10th day of Feb
ruary next, in unueu oiaies v^urreucy, wj wn.;
1st. On all real estate within the Corporate limits
of said Towr to be paid by the owner or person
in possession of the same, one-fourth of one per
cent, on the assessed value thereof recently made
by Commissioners appointed for toe purpose.
_2nd. On each Dray, Hack, Cart, Wagon or Omnibus,
drawn by two horses or mules, Three Dollars
; drawn by one horse or mule, Two Dollars; *
each wagon, drawn by fous horses or mules, Five
Dollars; each carriage, drawn by two horses, One
Dollar; each buggy, Fifty Cents.
3rd. On each male inhabitant, over twenty-one
years of age. Fifty Cents. ".
4th. On all stock in trade, Ten Cents On every
hundred dollars' worth of the same, on hand January

6th. On till dogs, within the corporate limits of
the town, a tax of Twenty-five Cents. .
6th. Payment to be made to the Clerk, on or
