condition, and will speedily rehabilitate the State as a constituted part of the great national confederation. With this expression of my sentiments, which will not, however, control me in the important administration of the duties of the office to which you have assigned me, I am now prepared to take my place as your presiding officer, at the same time invoking your indulgence for any unintentional errors that I may commit, and your earnest co-operation in preserving the dignity and decorum of the body. W. G. Whip per, colored, of Beaufort, offered the following resolution: Resolved, That pending the appointment and report of the Committee on Rules, the oonvention i adopt and be guided by the rules of the House of Representatives for its government. The resolution was agreed to. On motion of R. C. DeLarge, colored, the thanks of the oonvention were returned to CoL T. J. Robertson, for the dignity and impartiality with which he presided over the deliberations of the body. it G. Holmes, white, of Beaufort, moved that the convention proceed to the election of a secretary by ballot The President announced that having adopted the rules of the House of Representatives as their guide, the secretary must be elected viva voce, unless me nues were icmpururiiy susucuucu. On motion of B. F. Whittemore, the rules were suspended, and Carlos J. Stallbrand was unani monsly, by acclamation, elected secretary. The new secretary, as the reporter was informed, formerly occupied the position of chief of artillery under General Sherman, and was himself a major-general in the Federal army. N. G. Parker moved that the convention proceed in the same manner to the election of assistant secretary, sergeant-at-arms, assistant sergeantat-arms, door-keeper, assistant door-keeper and chaplain. . v"Vf / F. J. Moses, Jr., of Sumtef, said that he was opposed in toto to that part o?tbe resolution which \ looked to the election of a chaplain. As tar as he I was individually concerned he vyas opposed to the services of any chaplain, and opposed to having these proceeding opened with prayer. That truth t which had been neld so sacred in the past has < been of late so prostituted in all legislative bodies, that there was a great probability it would be prostituted here, and instead of prayers we should have 1 simply political harangues in the guise of a sacred invocation. Furthermore, he held it to be incumbent upon ; the delegates to have some respect for the Treasury of the State. The people were poor, and where 1 there were so manv chanlains on the floor, he i thought it unwise and injudicious to add to the expenditure to be entailed upontltf State by rea- i son of these deliberations. - *'?> B. Randolph, colored, of Orangeburg, said he was strongly in favor of the election of a chap- I lain, because it was the custom in Congress, in the I legislature, and, as far as he was informed, in other i conventions which had been held No one on this floor could possibfy more respect 1 the Treasury of the State than himself, but he I could not respect it so much as to ignore religion ( and overlook God. Langley, colored, of Beaufort agreed with : the delegate from Sumter that there were clergy- i men enough in the convention to open the prooeed- I ings with prayer, without taxing unnecessarily the treasury of the State; and he hoped, that they i would be patriotic enough to discharge this duty , to the convention and the State, without drawing , eight dollars a day for their services. DeLarge (colored) opposed the idea of having so many "hangers on," and digging so deeply into the treasuiy as their appointment would necessitate. If thcv^kept on, they would soon , have as many attendants as delegates. J. J. Wright (colored) agreed with DeLarge. The amendment was adopted, and the motion then agreed to. On motion of B. F. Whittemore, Paul M. Poinsett (a colored man) was elected assistant secretary, and on the motion of a colored delegate, Wm. K. Mitchell (also a colored man) was elected engrossing clerk. The latter, it was stated, formerly held a clerkship in the Provost Marshal's office under General Gilmorc. The convention then took a recess until 8 o'clock, m P.M. ~ The Evening SE&siONwas consumed in rambling discussions and ballotings for officers. E. Conway was elected Sergeant-at-arms; Peter Miller, assistant Sergeant-at-arms; Sam Dickson, doorkeeper; and John Fitzsimmons assistant doorkeeper?all colored. R. C. DeLarge (colored) notified the convention that he would to-morrow move for a reconsideration of the vote by which Conway was elected sergeant-at-arms, it having been proclaimed that the person aforesaid was incompetent to discharge the duties of the office. At 12 o'clock, the convention adjourned to meet at 10 o'clock, A. M., to-morrow. , i thiri> day. Tfiursday, January 16.?The convention assembled at 10 o'clock, and after calling the roll, the Secretary read the journals of yesterday's proceedings. Some discussion ensued with reference to the election of sergeant-at-arms, it having come to the knowledge of delegates that they had chosen a colored man wholly iucompetent to discharge the duties of the office. ine several motions on tnis suDjeei were wuudrawn to permit of praver, and at the request of the President, B. F. Whittemore, a white delegate from Darlington, officiated. Ou motion of B. Odell Duncan, of Newberry (white), the resolution referriug to chaplains, adopted yesterday, was reconsidered, and on further motion of the same delegate, the President was empowered to appoint some member of the convention each morning to open the proceedings with prayer. On motion of the same delegate, the doorkeeper was instructed not to admit any one who has not credentials as a member, or is privileged as a reporter or invited guest The convention proceeded to the election of messengers, which resulted in the choice of W. S. Elliott (colored) and J. D. Bryce, (white). An effort was made to secure the appointment of three pages, but after discussion the whole matter was laid on the table. J. J. Wright, (colored), of Beaufort?I wish to offer as a motion that this convention do all it can to sustain The Charleston Daily News and Courier for the correctness and impartiality with which they have thus far reported the proceedings of the convention, and go as far as becomes gentlemen to cause the Mercury to "evaporate." This produced an animated discussion, and was finally disposed of by laying the whole matter on the table. F.J. Moses, Jr., of Sumter, introduced the following resolution: Resolved\ That a committee of three be apSointed to wait upon his Excellency Governor amcs L. Orr ana request him to address this ^ convention, and that said committee report to morrow. L. S. Langlev (colored), moved that the word "provisional' be inserted before the word "Governor." Mr. Moses accepted the amendment. J. J. Wright (colored), moved to lay tho resolution upon tho table. The motion was not agreed to. The resolution wm? finally adopted, and a committee of three appointed to wait on Governor Orr and request him to address the Convention on Friday evening. The Committee consisted ofF. J. Moses Jr., and J. M. Rutland, white; and W. J. Whipper, colored. J. k. Jillson (white), of Sumter, presented the ' resignation of Conway, the colored sergeant-utarms elected last evening, which was accepted. A committee was appointed to report what standing committees were necessary for the business of the convention. After some confusion, growing out of attempts to hold an evening session, the convention adjourned until 10 o'clock, A. M., to-morrow. fourth day. Friday, January 18.?The Convention met at 10 A. M., and was called to order by the President, A. G. Mackey. Prayer was offered by Rev. F. L. Cardozo. The roll was called, and ninety members answering to their names, the President announced a quorum present, and the convention ready to proceed to business. ,F. J. Moses, Jr., from the committee to wait upon his Excellency Governor James L. Orr, and to request that he would address the convention, reported that they had performed that pleasing duty, and that his Excellency had accepted the invitation. The committee recommend that when this convention adjourns, it adjourn to meet this evening, at half-past seven o'clock, and that the Governor be introduced to the convention at eight o'clock this evening. Adopted. J. M. Rutland offered the following: Resolved, That it be referred to a special committee of five to inquire as to the propriety of calling to the aid of tnis convention, one or more of the solicitors of the State for the purpose of preparing, in proper legal form, the ordinances and other measures of this convention, and that the said committee report by resolution or otherwise. Langley offered the following: Resolved, That, in the opinionof this convention, the weal of the republic of the commonwealth of South Carolina requires that the further confiscation of lands and disfranchisement for political offences should be forever abandoned. Laid on the table. B. F. Whittemore, chairman of the committee to report what standing committees were necessary for the convention, reported the following: Committee on Bill of Rights, Legislative Committee, Executive Committee, Committee on the Judiciary, Committee on Franchise and Elections, Committee on Education, Committee on Finance, Committee on Rules and Regulations, Committee on Petitions, Committee on Miscellaneous Matters, Committee on Review and Consolidation. Report adopted and the committee discharged. B. 0. Duncan wished to submit a motion ot very grave importance to the convention and to the State, ana offered the following: Resolved, That a committee of five be appoiuted to consider what measures are necessary for the relief of the people of the State, and to report as earfahM possible.N. (jr. Parker offered the following, which was referred to the Committee on the Legislative part of the Constitution: Whereas, in every State of the United States, and in every unreconstructed State under the Government ol the United States, the several divisions of the same are denominated counties, except the State of South Carolina and Louisiana. Therefore Resolved\ That the several districts of this State shall hereafter be known and denominated counties. C. P. Leslie offered the following: Whereas the financial condition of the peeple of this State, considered in connection with tne future prosperity of all the people, and finally to enible the people to pay theii aebts, be it Resolved, That it is a fit and proper provision Tor homesteads to be incorporated in the constitution of this State. Referred to the Legislative Committee. R C. l)eLarge offered a resolution which wpif' idopted, inviting all the Judges of the State Courts aow in the city, to seats upon the floor of this coution. N. G. Parker offered the following, which was referred to the Committee on the Constitution: \N ORDINANCE TO ALLOW EACH HEAD OP A FAMILY IN SOUTH CAROLINA A HOMESTEAD, AND TO PREVENT THE LEVY AND SALE OF THE SAME UNDER ANY CIRCUMSTANCES. Be it ordained-, That hereafter, each head of a family in this State shall he allowed to own a homestead, which shall oonsist of one hundred acr&Kif. land, with a dwelling house and other improvements thereon, if not exceeding the value of two thousand dollars: Provided, That none of the above lands be within the limits of a city or incorporated town; or in lieu of the above land real estate in a city or town, not exceeding two thousand five hundred dollars. . The above named homestead shall be exempt from levy and sale by virtue of any process whatever under the laws of the State. B. Byas offered the following, which was referred to thd Legislative Committee: Resolved, That a Special Committee be appointed to take into consideration the political division of the State. F. J. Be it ordained, by the people of South Carolina in regular convention assembled, That all contracts and liabilities made for the purchase of slaves, whether by parole or under seal, where the money has not been paid, shall be null and void, and all Clerks of Courts of Common Pleas, and Masters in Equity, be required, on proper affidavits, to annul the same. On motion the Convention adjourned. Evening Session.?The convention assembled, and was called to order at half-past seven o'clock, Dr. A. "G. Mackev in the Chair. The roll was called and ninety members answered to their names. The president announced that a quorum was present, and the convention was ready for business. Mr. F. J. Moses moved that when this convention adjourns, it adjourn to meet at 12 M., on Monday, which was carried. 13. b. Randolph gave notice that he would introduce, on Monday, a petition to the Congress of the United States, praying for the continuance of the Bureau of Freedmen, Refugees and Abandoned Lauds, until the restoration of the civil government, and that then a Bureau of Education be established by the general government. The president announced the following committee on Printing: Messrs. R. C. DeLarge, Dr. J. C. Neagle, S. Corley, A. C. Richmond, B. F. Randolph, J. M. Ransier, L. S. Langley. At about 8 o'clock, General Canby, accompanied by Captain Caziarc, A. A. G., Second Military District, entered the hall, and was introduced to the Convention by the president There was some applause, and when it nad subsided, the president said that General Canby was not there ready to make a speech, but that he desired to return his warm thanks to the members. Shortly afterwards Governor Orr, accompanied by Judge Moses and several other gentlemen, entered the hall, and was presented by the president, who said that the convention desired to hear the Governor, because thev knew that, in his high do sition, he had many opportunities of knowing and learning the wants and necessities of the people, I and that he could assure him that he would receive I a careful and patient hearing at the hands of the convention. Governor Orr proceeded to address the convention at some length. The News says that "the address was listened to with marked attention, and although it was evident that many of the truths were unpalatable, much was uttered which received commendation and applause."
