of the Court. The Court of Claims
dismissed the petition on the ground
that it did not aver that the, claimant
had not given aid or comfort to the re
bellion, and that it did not sufficiently
aver executive pardon. The Chief Jus
tice held (the same as in the case of
Armstrong vs United State, recently
decided) that the President's proclama
tion of December 25, 18G8, gmuting
pardon and amnesty unconditionally
and without reservation, .relieves the
claimants, in all cases under the Captu
red and Abandoned Property Act, from
proof of adhesion to the Uu itcd States
during the lute war, and the judgment
dismissing the petition was reversed.
It will be seen that this is the second
decision of the kind that lias becu ren
dered, and already many persons in tho
South have taken advantage of it under
these 'decisions moat of the property
taken at the South during the war can
be reclaimed.
