S?C. 3. That it shall bo tho duty of the iutendant and wardens to keep all roads, streets and Ways within their cor porate limits open and in good repair. They shall havo power to compouud with all poi sons liable to work the streets, ways and roads'in said town, upon such tcrsis ss they, by ordiuauce, shall estab lish} the moneys so received to bo applied to tho public use of said town; aud all persons refusing or failing to pny such commutation aha-1 bo liable to euch fiue, not exceeding twenty dollars, as the town council may impose. Sec. 9. The said town council shall h?ve power to regulato sales at auction within the limits of seid town, und to grant licenses to auctioouecrs : Provided, 1 Nothing herein contained shall extend to sales by she rill", clerk of court, judge of probate, Coroner, executor or admin istrator, assigueo in bunkruptcy, or by any of tho persons out of the order, de cree of any court, trial justice or other inferior court. Sec. 10. They shall also have power to impose, an annual tax not exceeding fifty cents on every hundred dollars of the aaseracd value of real and personal estate lying within the corporate limits of said town, the real and personal estate of churches and school associations ex cepted. Tho said council shall have power to regulate the prico of liceuscs upon all public sho*s und exhibitions iu the said town; to orect a powder maga zine, and compel any person holding more than twenty-fivo pounds of powder to store the same thcrciu, nod to make regulations for the rates of storage there of, and'for keeping and delivering the same. The said council shall have power to enforce the pnymcut of all taxes levied under authority of this act, against the property aud person of all defaulters, to tho same exteut, and iu the same manner, as is provided by law for tho collection of tho general tnxes, except that executions to enforce the pay moot of tho low u taxes shall be is ? sued under the real of tho corporation, and directed to the tonn mnrthal or other person especially appointed by tho town council to collect the same; aud all property upon which a tax shall be le vied is hereby declared aud mude liable for the payment thereof, in preference to all other debts against the said prop erty, except debts due to tho State, which shall first bo paid. SEC. 11. That the said town council shall have power, with tho consent of the adjacent land owners, to close all such roads, streets and ways withiu the town as they shall deem necessary, by the sale of the freehold therein, either at public or private sale, as they may adiudge best for ihe interest of the said town, and they shall hove power to lay out, adopt, open and keep iu repair all puch new streets, roads aud ways within the town as thoy may deem necessary for the improvement and convenience of the sajd town: Provided, That no new street, road or way rhull be opened with out rst having obtained the consent of the hind owner or owners through whose premises any such new street, road or way may pass. c??- *o TI<a' 'bo c?5d Inwn council ' ' shall have power, and are hereby au thorized, to elec two or more marshals, (in addition to the sherifi of Darlington, who shall be a marshal of the town,) to fix their salaries and prescribe their du ties, who shall be sworn iu and invested with all the powers, aud subjected to all the duties and liabilities that constables uow have, or tiro subjected to by law, in addition to the duties and liabilities specially conferred and imposed upon them by the town couucil : Provided! That their jurisdiction shall bn coufiucd within the limits of the said town. Sec. 13. That {bbe said town council shall bavo power to establish a guard house, and to prescribe, by ordinauce, suitable rules aud regulations for keeping and governing the same ; and. until such guard house shill be established, thoy shall bo authorized to use a room in tho common jail of Darlington county for tho confinement of all ycrsons who may be subject to bo committed for violation of any ordinance of the town, passed in conformity to the provisions of this act ; asl the said town council may, by ordi nance, or the said iutendant and wardens in person, any ono or more of tin m, au thorize and roquiro any marshail of tho town, or soy countable, specially ap. pointed for that purpose, to arrest or j commit to said guard house or jail of Darlington county, as tho cose may bo, for a term not exceeding twenty-four hours, any person or persons who, within the corporate limits of said town, may bo engaged iu a breach of the peaoc, any riotous or disorderly conduct, open ob scenity, publio drunkenness, or in any conduct grossly indecent or.dangerous (o tho citir.ens of tho said town, or any of them ; and it shall be the duty of the marshals to arrest and aoiutnit all suoh offenders, when . required to do so, who shall havo power to call to their assist ance the potee romitatits, if need bo, to aid in making such arrests, and, upon failure of the town marshal to perform such duty, if required, they shall sev * ally be aubjeol to suoh Sues und pem.1 ties as the town council may establish; and all persons so imprisoned shall jay the costs and expenses shall be colleo ted in the same manner as pr? vided by this act for tho collection of fines im posed for viola ion of ordinauccs : Pro vided, That such imprisonmont shall not exempt tho party from tho payment of any fiuo rhe eeuueU tuay impose for the offence for which he- may have commit ted. Sec. 11. That the said town council shall have the power to col cet the taxes from all persons rep re. c. itiug, publickly, within the corporate limits, tor .gain or reward, any plays or shows, of any kiud whatsoever, tj bo used for tho purpose of said towu. Sec. 15. That all the lines v.ht.-h shall hereafter be coL-ctcd for rot^ilitig without license, within the corporate tl.e corporate limits of the said town, shall be paid one-half to the informer, aud the other half to the council, for the use of the said towu. Sec. 111. That the said l> wn co nc I shall have power to ubate all nuigmce within their corporate limit ; an 1 abo to appoint n bo. rd of htnlth of said town, und to puss 6Ueh ordinances as may be uecossary to define the duties and powers of said board, and ti impose tineu and penalties upon the members ol the said board, and to impose fines and penalties upon the members of tho s ? id board, for neglect of duty or rofusal to serve : Provided, That no One hereby authorized to be imposed shall exceed the sum of twenty dollars. The said towu council of Florence thall have power and authority to require the ow ner or owners of any lot or lots in the said town, to keep the streets in front of said lot or lots clear ofull tilth and rubbish, nod also to make and keep iu gold repair sidewalks in front of ea'd lot or lots when the sait.o shall front oi or adjoin any of the public streets of the said towu, if. in the judgment of the said towu council, such sidewalks shall be uecessary; the width thereof and the manner of their construction to1 bo des ignated aud regulated by the snid town council; and for default or refusal on the part of such owner or owuers to keep the said streets clean, or to make and keep in good repair auch sidewalks whenever required, the said town coun cil may cause the said streets to bo cleaned, or such sidewalks to bo made und kept in repair, nnd require such owner or ownurs to pry the costs and expeuses thereof: Provided, however, That contracts fos cleaning tho said streets, or making and putting iu repair such sidewalks, shall be let to the lowest bidder. Sec. 17. That the said town council shall have power to borrow money for the publio use of the corporation, by issuing, from time to time, as occasion may requiro, the bonds of the corpora tion, bearing internst at a rate not to exceed seven per centum a year, to be paid semiauuually, for un amount not to exceed five thousand dollars; and for tho payment of the interest, and th ? ul timate redemption of the priuoipal, sc cording to the terms of the loan, the said ccrporstiot; shall at ull times be liuble : Provided. That tho private property of the inhabitants of the town shall be bound for the redemption of the said loan in uo other way than by the imposition of an annual tax, accord ing to tho provisions of this act. Sec. 13. That the intoodautaod war dens elect shall, during tbeir term of office, be exempt from street duty. Each town council shall, within one month af ter the expiration of their term of office, make out and return to their successors a full account of their receipts and ex penditures during their time, and shall pay over all moneys in their posscsftiou bolouging to tho corporation, and deliver up all books, records und papers inciden. tal to their office to their successors ; anp on failure to do so, thoy shall bo liable to bo fined in a sum not exceeding one hundred dollars, to bo collected in auy proper actionby the town oouncil. That for any willful viola tion or neglect of duty, malfeasance in office, abuse or oppression, the said in tondant and wardens, jointly and seve rally, shall be liable to indictmeut in the court of sessions, and, upon convic tion, to punishment as prescribed in the preceding section, besides beiug liablo for damages to any person or persons in jured.
