Sjbc. G. That tho iuteudant aud war
dens duly elected and qualified shull;
during their term of Borvice, severally
and respectively, be vested with all the
powers of a trial justico or other inferi
or court; and tho i n tun dan t shall aud
may, as often as may bo necessary, Btiru
mons the wardens to moot in council:
any two of whom shall, with tho inteu
dant or any three wardons, constitute a
quorum to transact busiucss, and they
shall bo kuowu by the namo of the town
council of Mnuuiug. Aud they, aud
their successors hereafter to be elected,
may have a common seal, which shall be
affixed to all their ordinances, may sue
and be sued, may plead aud be imploa
ded, in any of law or equity in this
State, and purchase, hald, possess and
enjoy to them and their successors, in
perpetuity, or for any term of ycars;
any estate, real or personal, or mixed,
and sell, alien or courey the saute : Pro
vided, The same shall not exceed, at
any one time, the sum of ten thousand
dollars. And the intendant nnd war
dons shall have full power to make and
establish all such rules, by-laws and or
dinances respecting the roads, streets,
markets aud police of said town, as shall
appear to them necessary and requisite
for the security, welfare and conven
ience of said town, or for preserving
health, order, peace aud good govern
ment within the same; and nil t he by
laws, rules and ordinances the said Coun
cil may make, shall, at all times, be
subject to revisal or repeal by the gen
eral assembly of this Stutc. Aud the
said council may fix nnd impose fines
und penaltis fcr the violation thereof,
and approp.iatc tho same to the public
uses of said corporation: Provided, that
no punishment shall exceed fifty dollars'
tine or thirty days' imprisonment.
Sec. 7. That the intendant aud war
dens of said town shall have full power
to grant or refuse licenses to keep tav
erns, or to retail spirituous liquors with
in tho corporate limits of said town,
upou such conditions, aud ujjer such
cirtumstanccs, as to them shall scorn
proper and right: Provided, That in no
instance shall the price of c license to
keep tavern, or to retail spirituous li
quors, be fixed at a less sum than is
established by the law of this State; aud
all moneys paid for licenses, and for
?qcb and forfeitures for rctailiug spirit
uous liquors, kcepiug tavern aud billiard
tables within tho limits without licenses,
shall bo appropriated to the public uses
of said town : Provided, That the inten
dant and wardens, duly aud qualified,
shall not have power to grant any li
.cense to keep taverns or retail spiritu
ous to extend beyond the term lor which
they have becu elected.
Sec. S. That it shall be tho duty of
tho inteudunt and wardens to keep al.
toads, streets aud wins within their cor.

with all persons liablo to work tho
streets, ways aud roads in s-aid town,
upon such terms as they, b}T ordinance,
shall establish, the moneys so received

dollars, as the town council may impose.
Sec. 9. The said town council shall
have power to regulate sales at auction
within the limits of said town, and to
grant liccuses to said auctioneers : Pro
vided, Nothing herein contained shal.
extend to sales by Sheriff, clerk of court
judgo of probate, coroner, excutor or
administrator, assignee in bankruptcy,
or by any trial justice or other inferior
court. j
Sec. 10. They bhull also have power
to impose an auuutl tax nut exceeding
twenty cents on every hundred dollars
of the assessed value of real and person
al estate lying within the corporate lim
its of 6aid town, the veal and personal
estate of churchrs aud school associa
tions excepted, aud to regulate tho prico
of licenses upon all public shows and
exhibitions in tho said town; to erect a
pow-der magazine, aud compel uny pcr
bon 'holding more than twenty-live
pounds of powder to sforo tho same
therein, yud tomnko regulations for the
rates of Htorago thereof, and for keeping
and dclsvering tho name. The said
council shall have power to enforce the
payment of all taxes levied under au
thority of this act, ngairfst tho property
nnd person of all defaulters, to tho same
extent and in the manner a.s is provide 1
by luw for the collection of the general
taxes, except that executions to enforce
tho payment of the town taxes shall be
issued under the scul of tho corporation,
nud directed to the towu marshal or
other persons cnpaciully appointed by the
town council to collect the Bume; und all

Which shall first be paid.
Sxo. 11. That the said town oounoil
shall have power, with the consent of
tho adjacent laud owners, to close all
buch roads, streets aud ways within the
town as they may deem necessary, by
tho sale of the freehold therein, oither
at public or private sale, as they may
adjudge best for the iutercst of the said
town; und they uhall have the power to
lay out, adopt, open and keep in repair
all such now stroets, roads and ways
within tho towu aB they may deem ne
ccssury for the improvement and con
venience of the said towu : Provided,
That uo street, road or way shull. be
opened without first having obtained the
concent of tho laud owner or owners
through whoso premises any such new
street, road or way may pass.
Sec. 12. That the said towu council
shall have power, and arc hereby au
thorized, to elect one or more marshals,
(in additiou to tho Sheriff of Clarendon,
who shall also bo a marshal of the town)
to fix their salaries and prescribe their
duties, who shull be sworn in aud iuves
ted with all the powers and subjected to
all the duties and liabilities" that con
stables now have or are sttbjec'.od to by
law, iu addition to tho duties and lia
bilities specially conferred and imposed
upon them by tho town council: Provi
ded, That their jurisdiction shall be con
fined within the limits of the said towu.
Sec. 13. That the said towu council
shall have power to establish a guard
house, aud to prescribe, by ordinance,
suitable rules and regulations for keep
ing anc governing the same, and until
such guard house shall be established,
they shall he authoriced to uso a room
in the common jail of Clarendon county
for the coufiucmeut of all persons who
may bo subject to bo committed for vio
lation of any ordiuauco of the town,
passed in conformity to tho provisions
of this act; and tho said town council
may. by ordinance, or the said iuteudant
and wardens, iu person any one or more ol
them, authorize and lequirj any mar
shall of the town, or any cu istablo,
appointed for that purpose, to arrest aud
com>'it lb Paid, guard house or jail of
Chiron don county, as tho case may b*,
for a term not exceeding twenty-four
hours, any person orpcrsous, who, within
the corporate limits of said towfn, may be
engaged in a breach of the peace, any
riotous or disorderly conduct, open oh
Eccnit'y, public drunkenness, or in any
of them; and it shall be the duty ol the
town marshals to arrest and commit all
such offenders nhen i nquired to du so,
who shall havo power to call to their
assistauco the iiowt comitatus, if need be
to aid iu making such arrests; and upon
failure of t)io town marshal to perform
such duty a.-, required, they ahull seve
rally ho subject to such fines and penal
ties as the town council may establish ;
and all persons so imprisoned shall pay
the costs and expenses incident to their
imprisonment, which said costs und ex
penses shall ho collected iu the same
manner its provided by this act for tho
collection of fines imposed for violation
of ordinances: Provided, That such im
prisonment shall not exempt the party
from tho payment of any tine tho coou
oil may impose fur the offence foi which
ho may havo bceu committed.
Sec". 14. That tho said town council
chall have the power to collect the t.ixrs
from all persons representing, publicly,
within the corporate limits, for gain or
reward, any plays or shows, of any kind
whatsoever, to be used for the purpose of
said town.
Sec. 15. That all the lines shall here
after bo collected for retailing, without
license, within the corporate limits of
tho said town, shall bo paid one-half tu
the informer, and the other half to the
council, for the use of tho said town.
Sec. 1G. That the said town council
shall have power to abate all nuisances
within their corporate limits ; and, also,
to nppoiut a board of health for said
towu, and to pass such ordinances us may
be necessary to define the duties and
penalties upon tho members of the said
board, for ueglect of duty or refusal tu
?erve: Provided, That no fine hereby
authorized to bo imposed shall exceed
the sum of twenty dollars.
Sec. 17. That the said town couuoil
shall have power to borrow moucy fur
tho public use of the corporation, by
issuing, from time to time, as occasion
may require, tho bonds of the corpora
tion, bearing interest at a rato uot to ex
ceed seven per centum a year, to be paid
semi annually, for an amount not to ox
cecd live lliuusnnd dollars ; aud for the
payment of the in tor eat, and tho ultimate
redemption of the principal, according
to the terms of the said corporation shall,
at all limes, be liable : Provided, That
the private property of the inhabitants
cf tho said towu .shall bu bound fur the
sedctnption uf the said loan in no other
way than by the imposition uf an annual
tax, according to the provisions: ol this
act.
Sec. 18. That tho intendant aud war
dens ibet shall, during their term of
office, bo^cxcmpl jrdui at. tut duty. Each
town council .hall, within one mouth

cessors, a full accouut of tlioir receipts
and expenditures during their lime, uud
shall pay over all monoys in their pos
session belongiug to tho corporation, and
deliver up all hooks, records and papers
incidental to their office, to their succes
sors ; and on failure to do so, they shull
bo liable to bo fined iu a suiu uot ex
ceeding one hundred dollars, to be col
lected iu any proper action by tho towu
council.
Skc. 19. That for auy willful. viola
tion or uegleot of duty, malpractice,
abuse or oppression, the suid intendant
and wardens, jointly aud severally, shull
bo liable to indictment in the court of
scssious, aud, upon conviction, to pun
ishment, as prescribed in the preceding
section, besides being liable for damages
to any person or persons injured.
Sec. 2o. That uii ordinances hereto
fore passed by the town COU'iOil of Mail
ing, iu conformity with tho authority
granted by such existing laws as d > not
conflict with the constitution of the
State, shall bo, and th ?y ore hereby, de
clared legal and valid.
Skc. That all nets and parts of acts
heretofore passed in rel it ion to incorpo
ration of tho village, of Manning be, nnd
and tho ilamc arc hereby, repealed.
