Sec.'6. That tho iutoudant^aud.war-'
dens duly elected and qualified shall,
during their term of service, severally
and respectively, be vested with all the

quorum to transact business, and they

affixed to all thoir ordinances, may sue
nnd bo sued, may plead and bo i in plea
ded, in any of law or cqnity in thij
State, and purchase, hald, possess and
enjoy to them and their successors, in
perpetuity, or for any term of years,
any estate, real or personal, or mixed,
and sell, alien or convey the sauio : Pro
vided, The same shall not exceed, at
any one time, tho sum of ten thousand
dollars.' And the intendant nnd war
dens shall have full power Jo make.and
establish all such rules, by-laws nnd or
dinances respecting tho roads, streets,
markets and police of said, town, as shall
appear to them necessary and requisite
for the security, welfare tand conven
ience of said town, or for preserving
health, order, peace and good govern
ment within the same; and all t he by
laws, rules and ordinances the said coun
cil may make, shall, at all lime?, be
subject to revisal or repeal by the gcu
eral assembly of this State. And the
said council may fix and impose 1 fines
and penaltis fcr the violation thereof,
aud appropriate tho same to "the public
UBCs of said corporation : Provided, that
no punishment shall exceed fifty dollars'
fino or thirty days' imprisonment.
Sec. 7. That the iutondant nud war
dens of said town shall have full power

erns, or to retail spirituous liquors with
in tho corporate limits of Bam " town,

proper and right: Provided, That in :u>

quors, be fixed at a less sum that) is
established by tho law of this State; and
all moneys paid for liccuscs, and for
fines and forfeitures for retailing spirit
uous liquors, keeping tavern nud billiard
tables with in tho limits without licenses,
shall bo appropriated to the public uses
of said towu : Provided, That the inten
dant and wardens, duly aud qualified.

Sec. S. That it shall be the duty of

Sec. 9. The said town council shall
have power to regulate sales at auction
within the limits of said towu, and to
grant licenses to said auctioneers : Pro
vided, Nothing herein contained shal.

Sec. 10. They shall also have power
to impose on nuuual tax nut exceeding
twenty cents on every hundred dollars
of tho assessed value of real aud person

tions excepted, aud to icgulato tho prico
of licenses upon all public shows aud
exhibitions in the said town; to erect a
povr4er magazine, and compel any per
son holding moro thnn twenty-live
pounds of powder to atmo tho same
therein, and to make regulations for the
rate? of storage thereof) and for keeping
nnd delivering the Fame. The said
council shall huvo power to cufurco the
payment of all taxes levied under au
thority of this act, against tho property
nnd person of all defaulters, to the Bame
extent and in tho manner us ifl provided
by luw for the collection of tho general
.taxes, except that executions to cufurco
the payment of the town laxe? shall be
issued uudcr the seal of tho corporation,
nud directed to the towu marshal or
other persons copnciully appointed by the
town council to collect the same; and all^

' Sec. 11. That the said town council
shall have power, with the consent of
tho adjneent laud owners, to close all

tho sale of the freehold therein, either
at public or private sale, as they way
adjudge best for the interest of the said
town; and they shall have-the power to
lay out, adopt, open and keep in repair
all suoh new streets, roads and: ways
within tho town as they may deem ne
cessary for tho improvement, and con
venience of the said towu : Provided,
That no street, road or way shall, be
opened without first having obtained the
concent of tho land owucr or ownois
through whose premises any such new
street, road or way may pass.
Sec. 12. That the said town oouncil
shall have power, and arc hereby au
thorized, to elect one or more marshals,
(in ndditiou to tho Sheriff of Clarendon,
who shall also bo a marshal of tho towu)
to fix their salaries and prescribe their
datier-, who shall be Bworn in aud inves
ted with all the powers and subjected to
; all tho duties and liabilities ' that con
stables now have or are. aubjeciod to by
law, in addition to tho duties and lia
bilities specially conferred and imposed
I upon them by tho town council:1 Provi
| ded, That their jurisdiction shall be con
fined within the limits of the said town.
Sec. 13. That tho said towu council
shall have power to establish a guard
house, and to prescribe, by ordinance,
suitable rules and regulations for keep
ing ane governing the same, and uutil
such guard house shall be established,
thoy shall be authoriced to nso a room
in tho common jail of Clarendon couuty
for the co i ihn em cut. of all persona who
may be subject to be committed for vio
lation of auy ordinance of tbe town,
passed in conformity to the provisions
of this act; aud the said town council
may. by ordiunuce, or tho said iutcudant
and wardens, in person any one or more of
them, authorize and lequirj any mar
shall of the town, or any co istablo,
appointed for that purpose, to arrest aud
commit to said. guard house or jail of
Clarendon couuty, as tho case may he,
for a term not exceeding twenty-four
hours, any person or persons, who, within
the corporate limits of said tov/n, may be
engaged in a breach of the peace, any
riotous or disorderly conduct, open ob
scenity, public drunkenness, or in any
of them ; and it shall be the duty of the
town marshals .to artest nud commit all
such ofi'c?dew * hen; retired to do so,
who shall -h?vo power to call to their
assistance the vostc co)ni(afus, if need be
to aid in making such arrests'; and upon
failure of tho town marshal to perfurni
such doty ng required, they ahull seve
rally bo subject to snch finos and penal
ties as the town council may establish ;
and all persons so imprisoned shall p&y
the costs und expenses incident to their
imprisonment, whioh said costs and ex
penses shall he couoctad in the same
manner as provided by this act lor the
collection of fines imposed for violation
of ordinances : Provided*; That such im
prisonment shall not exempt the party
from tlio payment of any line tho coop
cil may impose for the offence foi which
ho may have bceu oommittod.
Sec. 14. That tho said town council
chall have the power to collect the taxes
from all persons representing, publicly,
within the corporate limits, for gain or
reward, any plays or shows, of any kind
whatsoever, to be used for the purpose of
said town.
Sec. 15. That all the tines shall here
after be collected for retailing, without
license, within tho corporate limits of
the said town, shall bo paid one-half to
the informer, and the other half to the
council, for the use of tho said town.
Sec 1G. That the said town council

towu, and to pass such ordinances as may
be necessary to define the duties nnd
penalties upon the members of the said
board, for noglect of duty or refusal to
servo: Provided, That no fine hereby
authorized to bo imposed hall exceed
the sum of twenty dollars.
Sec. 17. That the said towu couuoil
shall have power to borrow money for
tho public use of tho corporation, by
issuiug, from time to time, us occasion
may require, tho bonds of the corpora
tion, bearing interest at a rato uot to ex
ceed seven per centum a year, to be paid
semi annually, lor an amount not tu ox
cecd five thousand dollars; aud for the
payment of tho interest, and the ultimate
redemption of tho principal, according
to the terms of the said corporation shall,
ut all times, be liable : Provided, That
the private property of the inhabitants
of tho said towu ?hall bo bound for the
sedcuption of the said loan in no other
way than by tho imposition of an annual
tax, according to tho provisions ol this
act.
Sec. 18. That the iutcudant aud war

bo liable to bo fiucd iu a sum not ex
ceeding one. hundred dollars; to be col
lected in any proper action by tho to#u
council.
Sue. 19. Tlut for any willful. viola
tion ur ucglcot of duty, inulpracticc,
abuse or oppression, tho said intendaut
and wardeus, jointly aud severally, shall
be liable to indictment in the court of |
scssious, and, upon conviction, to pun*
ishincnt, as proscribed in tho preceding
section, besides being liable for damages
to any person or persona injured.
Sec. 20. That all ordinances hereto
fore passed by the town oo?'icil of Mail
ing, iu Conformity with tho authority

State, shall bo, and th ly tiro hereby, de
clared legal and valid.
