that I recoguizc tho supremacy ot the
constitution aud luws of tbo United
StatC9 over the constitution uud laws of
any State; and that I will support, pro
tect and defend thn constitution of tbo
United States, nnd the coustitutiou of
South Carolina, as ratified by the people
on the sixteenth day of April, 1868;
and I do farther solemuly swear, as
Intendant (or warden) of Aiken, that I
will equally and impartially discharge
the trust reposed in mo, aud will uso my
best endeavors to preserve the peace,
and carry into effect, according to law.

Sic. 45. That nil mala persons who
arc Constitutionally dualified to vote for
members of either branch of tho State
Legislature, and who have been perma
nent residents iu tue suid towu for six
month? immediately previous to the
election iu which thoy offer to cast their
votes, or who are owners iu their own
right of a freehold estate in said towu,
of which they havo been legally seized
foa three months previous to the election
accompauied with actual residence in
the town (which, however, must be pe
riodical, or intended so to bo,"^ for at
least one month previous to the election,
shall bo cutillcd to vote for intiitendant
aud wardcus of the said towu. The
Town council shall n'so bu authorized
to prescribe, should they at any time
deem it cxpudident, as n quulfiicntiou
for voting for iutendant and wardcus,
tbo payment of a poil tax not exceeding
tho sum of one dollar.
Sec. 46. That iu caso a vacancy
should occurju the office of iutendant,
or any of tho wardens, by death, resigna
tion, icmoval, or othcrwiso, or in case of

pointment of the iutendant uud warden,

Sec. 47. Tho electtou of the iuten
tlanl and wardens of the said town shall
be held at, ,\tho town hall, or some other
couvcuient public place iu tho said town,
on the secoud Monday iu September of
oach aud every year, from ten o'clock A.
m., until three o'clock i?. m., when the
polls shall be closed, and the managers
shall forthwith couut the votes, proclaim
tho election, and give uuticc in writing
to the persons elected. Tho intcndanl
and wardens, for the time beiug, shall
appoint three managers to hold the ensu
ing election, and for ai.y subsequent
elections; the nth angers shall always ill
each case, be persons who are able to
read and write with facility, nnd shall
before they open the polls for such elec
tions) take an oath fairly and impartially
to conduct the same ; and the managers
of such election arc hereby authorized
and empowered to administer, if they see
fit an oath to nuy person offering to vote,
and to make all other necessary inquiries
for the purpose of ascertaining whether
such per-on is qualified to vote under
this law.
Sec. 48. That theiutonduntand war
dens, duly elected and qualified, shall,
during their tonn ol service, severally
nnd respectively, wuuui mo umum oj
bu id town, bo vested with all the powers
and jurisdiction of magistrates or trial
justices of this State, except for the trial
of small and mean causes; aud the iu
tendant shall, as occasion may require,
summon the wardens to meet in council,
a majority of whom shall constitute a
quorum for tho transactiou of business.
Tho said towu council shall have full
power, under its corporate seal, to ordain
and establish all such rules, by-laws and
ordiuonecK respecting tho streets, pave
ments, ways, markets, public buildings,
Weights, measures, wells, disorderly
places, firo .department, police, and iu
general, every other by law, as shall ap
pear to them requisite for the security,
wclfaro and convenience of tho said
town, and for preserving health, peace,
cleanliness, order and good government
within the samo, and to prevent tbo vio
lation of its ordinances, by ordaining
suitable fines, not, UOWGVOr, in any CflSO
to exceed tho sum of fitty dollars : Pro
vided that no fine above tho sum of
twenty dollars shall be collected by the
said couueil, except by suit in a court of
couipetont jurisdiction : Aud provided,
further, That no ordinunco shall bo re
pugnant to, or inconsistent with, the Jaw
of the land ; and all ordinances shall be,
at all times, subject to repeal by the
Legislature.
Sbo. 49. Tho intendant and wardens
shall have power to bleot or eppoiut a
marshal, if they see fit, a deputy ni?r?

proper, w'.io shall b^> duly sworn in by
tho iu*cudaut, and vested with nil the
power constables uow have by liw, and
whesd power uud authority shall be pu
ticularly confined within the limits of
tho said towu; but whose further power
aud authority shall also extend to the
arresting aud taking in custody any per
son or persons within a distanco of lour
mile in each and every direction, be
yond aud without tbe corporate limit a,
who shttll violate any ordiuunco of the
said town : Provided, sail! office be c:m<i
mit ted within the corporate limits. The
duties of the marshal shul! be to collect
ull fiues and forfeitures imposed by the
intcudnut and wardcus, and to eufcrec
and carry into execution and effect the
by-laws and ordinances of the said cor
poration, aud who shall bo liable to bo
removed by tbo said town council; and
the said intendant and wardens shall

nance whenever they shall deem it expe

shall have power to elite* or appoint n

whose duty it shall be :o attend all meet
ings of council, and make a record in a
book kept for that purpose of all tbe
proceedings thereof; to tiikp charge of
all papers belonging to council, nnd to
lodge with the proper officers all sum
mons, executions, eic , und receive re
turus; to keep a regular account of all
receipts and disbursements, which ac
counts shall, at all times; be ncoessafclo
to tho intendant or any of the wardei s;
uud it shall be his duty to make an offi
eial semi annual report to the council ( I
the state of bis accounts, at which times
tho doors of the council room shall he
opeu to all tho citizens of tbe said town;
and which reports shall be regularly en
tered iu a book kept for that purpo-o.
Ho shall attend to the publication ol ail
ordiuauccs aud other documents ordered
by council to be published. lie shell

may preccribe, not, however, exceeding
one year, and shall receive such com

Sec. 51. That the said towu council
shall bavo yower to establish a guard
house, and to prescribe, by ordinance,
suitablo rules and regulations for keep
ing and governing the Burnt*; and the
suid towu council may, by ordinance, i r

any one or more of them, authorize and
require any marshal, deputy marshal or
police tfflucr, or any coin-table, spcbiul
ty apco'.ntob, to arrest and commit to
said guard house, or other place of cus

for a term not exceeding iorty-eight
hours, any persons who may pe engaged
in a breach ot the peace, any riotous or
disorderly conduct, open obsceuety, ;
lie drunkenness, or in any conduct gi
ly indecent or dangerous to the citizens
of the said town, or any of them. .lud

mit all such offenders, and who shah:

town council to open any street within

the name; alleging that ihn said street is
necessary for his uso and hccommodn
tion, and that there is rio other direct or
convenient nccess for him to llio bu ii ?
