; ; Sec. d7. Tho election of the iuten
dant and wardens of the said town shall
he held at the towu hall, or some other
couveuient public place iu tho said town,
ou the second Mouday in September of
oach and every year, from ten o'clock A.
m., until three o'clock p. M., when the
polls shall be closed, and the managers
shall forthwith eouut the votes, proclaim
the election, and give uutice in writing
to the persons elected. The iotctidanl
and wardens, for tho time being, bIiuII
appoint three managers to hold tho ensu
ing election, and for any subsequent
elections; the managers shall alway.s in
each caso, bo persons who are nhlo to
read and write with facility, and shall
before they open the pulls for such elec
tions, take an oath fairly and impartially
to conduct the same ; and tho managers
of such election are hereby authorized
and empowered to administer, if they seo
fit nu oath to any person offering to vote,
and to make all other necessary inquiries
for the purpose of ascertaining whother
such per:on is qualified to vote under
this law.
Sec. 48. That the iutendant and war
dens, duly elected and qualified, shall,

and respectively, within tho limits of
said town, he vested with all the powers
and jurisdiction of magistrates or trial
justices of this State, except for the trial
of small and mean causes; and tho iu
tendant shall, as occasion may require,
summon the wardens to meet iu council,
a majority of whom shall constitute, a
quorum for the transaction of business.
Tho said town council shall have full
power, under its corporate neal, to ordain
and establish ull such rules, by-laws and
ordinonces rospocting tho streets, pave
ments, ways, markets, public buildings,
weights, measures, wells, disorderly
places, fire .department, police, and in
general, every other by law, as shall ap
pear to them requisite for the security,
welfare and convctiicuee of the said
towu, aud for preserving health, peuce,
cleanliness, order and good government
within the same, and to prevent the vio
lation of its ordinances, by ordaining
suitable fines, not, uowover, in any caso
to exceed the sum of fifty dollars : Pro
vided that no fino above, tho sum of
twenty dollars shall be collected by tin
said council, except by suit iu a court of
competent jurisdiction : And provided,
further, That no ordinance shall bo re
pugnant to, or iheotisistcnt with, the law
of the land ; and ull ordinances shall be,
at all times, subject to repeal by the
Legislature.
Sec. 49. The intendaot and Tf ardens
! shall havo power to blcct or eppcint a
marshal, if they see fit, a deputy mar
shal, uhou such ferms as they may deem
proper, w'.io shull duly sworn in by
the iutendant, and vested with all tho
power eoustables uow have by law, and
whese power and authority shall bo par
ticularly confined within the limits of
tho said town; but whose further power
aud authority shall also extend to the
nrresliug aud taking in custody any per
son or persons within a distance of lour
mile in each and every direction, be
youd aud without tho corporal" limits,
who shall violate any ordinance of the
said town : Provided, raid oflicc bo COui
mitted within the corporate limits. Tho
duties of the marshal shall be to collect
all fines and forfeitures imposed by the
iotendaut and wardens, and to enforce
and carry into execution and effect the
by-laws and ordinauccs of the said cor
poration, aud who shall bo liable to be
removed by the said town council; and
the said Intendant aud wardens shall
also have power to establish an ordi
nance whenever they shall deem it expe
dient, io ordain and establish a police

whoso duty it shall be to attend all meet

book kept for that purpose of all the
proceedings thereof; to tnku charge of
all papers belonging to council, an I t>

turns; to keep a regular account of all
receipts and disbursements, which ac
counts shall, at till times; be nceessafcle

open to all the citizens of the said town;
and which reports shall be regularly en

one year, and shall receive such com

SEC. 51. That the said town couucil
shall have yowcr to establish a guard
house, and to prescribe, by ordinauce,
suitable rules and regulation:; fur keep
ing aud governing the satin; and the
said town council may, by ordinance, or
s?id iutendant aud wardens in person,
any one or more of them, authorize and
require any marshal, deputy marshal or
police t filter, or any constable, spcbiul
ty apcointeb, to at rest and commit to
said guard house, or other place of cus
tody, to ba designated by the intcuduut
for a term not exceeding lorty-eight
hours, any persons who may pe cngai i
in a breach of the peace, any riotous . .?
disorderly conduct, open obscciioty, j ub
lic drunkenness, or in any conduct gr

it shall be the duty of the town marsh a

SEC. 53, That it shall bo the duty of
tho said council to keep all road-), ways
and streets within tho corporate limits
open and in good repair, and f r that
purpose they are invested with nil pow
era vested in the county commissioners;
and they shall have full and exclusive
yowcr to order out all tho hands u \v
liable, or hereafter made liabJo by th

and streets, within the limits of the said
corporation, as many days in each yeni

vided, It shall not be obligatory on the
town council to open any strict within

And the intendaut and wardens are
hereby individually exempted from tho
performance of road and street duty, and
no person residing within the said town
shall bo liable to work ou any road with
out the said limits, or to bo taxed or as
sessed for the same.
