f Section 1. Be it enacted by the Sen
uto anil House of Representatives of the
State of South Carolina, now met und
sitting in General Aswnihly, and by the
authority^ the eamo:
' Villngegc of St. Stephens.
That fitmi ?Su after the paesnge of
thisact, all citizens of this State having
resided twelve months within this State
end sixty day* in the village of ?St Ste
phens, shall be deemed, atid are hereby
declared to be, a body politic and corpo
rate, and the said village shall be called
ami known by tho name of St. Stephens,
nod itscorporato limits shallextcud three
fourths of u mile in cneli direction from
the'Depot of the Northeastern Railroad

fourth Monday in March, 1871, and on

citizens of the S'tate, and who shall have
"resided within the State twelve months,
and iu the said village sixt}- days imme
diately preceding the electic-u. shall be
entitled to vote for said intcudano and
wardens, paupers aod persons under dis
abilities for crime excepted.
iSec. 3. The said election shall be
held tt some convenient public place in
said village, from eight o'clock in the
morning until f;.ur o'clock in the after
noon, and wheu tb? polls .shall be closed
the Managers shall forthwith count the
votes and declare tho election, and give
notice thereof, in writing, to the inten
dant therein being, who shall, within
?two days thereafter, give notic, or cause
the same to be given, to the pcrsocs duly
elected: Provided, the commissioners of
election of Charleston county shall call

shall appoint managers to conduct the

said commissioners shall count, tho vot 5
and declare the election, und uotify the

and wardens, before entering upon the
duties of their officers, shall, respective
ly, take the oath prescribed by the con
stitution of the State, and also, the fol
lowing oath, to wit : "As intendant (or
warden) of the village, of St. Stephens,
I will equally and impartially, to the
host of my ability, exercise the trust re
posed in me, ??nd will use my best en
deavors to preserve the peace and carry
into ellcct, accordii'j to law, the purpo
ses for which I have been elected : So
help mo God." And if any person,
upon being elffctcd intendant or warden,
shall refuse to act as such, he shall for
feit and pay to the council the stun of
twenty dollars for the use of tho said
village: Provided, T! at no person who
lias attained the age. of sixty years shall
be compelled to serve in either of said
officers; nor shall any other person be
compelled to serve, either as intenda..t
or warden, more than one year iu an;
term of three years. The intendant and

wardens, for the time being, shall always
appoint one or more boards of managers,
three managers for each board, to eon
duct ihc election, who, before they open
the polls, shall take r.n oath fairly and

6x0. t>. That the intendant and war
Qcns, duly elected nnd qualified, shall,
during their term of service, severally
and respectively, be vested with all the
powers of (vial justices, or justices of the
jpcaco,asttbo caso may be, in this State,
within the limits of the said village, ex
cept for tho trirl of small and mean causes;
and the intciuluut shall, or may, as often
as is necessary, summon the wardens to
meet in council, any three of whom, with
the intendant, shall constitute a quorum
to transact business; and they shall be
known as the town council of St Stephens;
and they, and their successors in office
hereafter to bo elected, may have a com
mon seal, which shall be rffixed to all of
their ordinances; may sue ond be sued,
plead and be imbhviUed, in any court of
justice in thiH State, and purchase, hold,
possess and cfijoy, to them and their
successors, in perpetuity, or for any term
of years, any estate, real, personal or
mixed, nnd sell, alien or convey the
same: Provided, The same shall not
exceed, at any one time, the sum of ten
thousand dollars. And the said town
council shall have authority to appoint,
from, timo to time, as they may see lit.

marshals or constables of said village as
the said council may deem necessary and
expedient for tho preservation ol tho
peace, good order, and police thereof,
which persons, so uppointcd, shall, with
in the corporate limits of said village
have the power and privileges, and bo
subject to all tho obligations, penalties
and regulations, provided by law for the
office of constable, and shall be liable to
be removed at the pleasure of said coun
cil. And the said town conucil shall
nave power to establish, or authorize the
establishment of a market bouso in said
village, also to authorize tho establish
me.it of a guard house, nnd to prescribe
suitable rules and regulations for keep
ing and governing the same; and, until
tho said guard bouso be established, they
shall bo authorized to uso a room in the
common jail of tho county of Charles
ton, for the coofiuomou?? of nil who mry
be subject to be committed for a viola
tion of any ordinance, rules and regulu
turns of said town. Aud the said town
council, or the sold iotondant and war
dens, in person, any one or more of
them, may authorize and require any
marshal of :he town, or any constable
specially appointed for that purpose, to
arrest and commit to the said guard house j
or jail of Charleston county, as the case
may be, for a term not exceeding twenty
four hours, any persou or persons who,
within the corporate limits of said town,
may be engaged in a breach of the peace
uuy riotous or disorderly conduct, open
obscenity, public drunkenuess, or any ol
them. Aud it shall be the duty of tho
duty of the town marshal or constabhs
to arrest and commit all such offenders,
when required so to do, and who shall
huvo power to call their assistance the
pnete comiialu*, if need be, to aid in
making such arrest; aud. upon the fail
urj of said officers to perform such duty
as required, they ..hall, severally, be sub
ject to such fines and penalties as the
town couucil may impose upon them.
And all persons so improucd shall pay
the costs aud expenses iucidout to their
imprisonment, which said costs and ex
penses shall bo collected in the same
manner as is provided lor the collection
of fines imposed for the violation of or
dinaucos, rules and fogulutious : Provid
ed, That such imprisonment sh 11 not
exempt tho party from the payment of
any fine the council may impose lor the
offence which ho, she or they may have
committed. And the said town council
shall have full power aud authority, un
dsr their corporate soal, to make all such
rules aud regulations, by-laws and ordi
nances, respecting the streets roads, and
the business thereof, as well as the poliie
system of the said town, as shall appe; r
to them necessary and p.opcr for the se
curity, weliuro and convenience, and for
preserving health, order and good g"\\
eminent within said town. And the
town council may impose line-; for off n

lations and ordinances, and appropriate
the same to the public use of said town ;
and tho said town council shall have the
same power that trial justices of the
peace now havo, or may he rafter have,
to cotnpl tho attendance of witnesses,
and requiring them to lmvc evidence
upon the trial befi rj thorn of any person
or persons for n violation of any of their
ordinances, by-laws, jhIo; or regulativ n ;
but no fine above the stun of twonty-fivo
dollars shall be collected by said cot u ii
except by snit in the proper courts of
justice in (Iiis State; and. also, th t

to, the laws of the State.

terms as their ordinances or by-lws may

applied to the public uses of said town;
and all persons infusing to labor, or fail
ing to pay such commutation, shall bo
linblo to such lino, not. oxceeding twenty
dollar^ for any one vonr, ns tho said
town council may impose; nnd they shall
have power to enforce the payment of
such fine in the same manner as is now
or may bo hereafter, provoded for the
collection of county taxes. And the
suid town council sbull have power, with
tho consent ul* the adjacent land owners,
tr, close all such roads, streets and ways
within the said towu as they may deem
nncossary, by tho sale of the frcohold
therein, either at privnto or yublic sale
as they may adjudge best for tho interest
of tho said to-n; uud they shall keep in
repair all such new streets, roads ways as
they may, from time to time, doe in noocs
ssry tor the improvement und couve lience
of said town: provided, that no street,
fbad or way shall be opened without fmt
having obtained the consent oi the land
owner or owners thereof, through whose
premises any such new street, road or
way may pass.
Skc. 7. The said rowu council shall
have power and authority to require all
persans owning a lot or lots in said town,
to close in, and to make and keep in
good repair sidewalks iu front of said
lot or lots, whenever the siuio shall front
or adjoin any public street uf said town,
if, in the judgment of the council, such
sidewalk shall be necessary, the width
thereof, and the manner of construction,
to pe designated and legu'uted by the
jiid town Council; and lor default or re
f.-sal, after reasonable notice, to make
and keep iu good rej air such sidewalks,
and to close such lot or lots, the town
council may cause the same to be made
or put in repair, and tcquiro the ownst
to pay the price of making cr repairing;
aud the said town towu Council arc- here
by s in powered to sue for ar.d ivoover tho
same by action of debt, in any court of
competent jurisdiction : Provided, That
such contract for making or repairing is
