A LIVELY LETTER. *'01d*ter" Replies to Trial Jus tice I?olil? Some pretty Plain Talk. BranohviUe, Juuo 8th, 1871. Jiuik* SAcUi?*.?Sir 2!u?h, persona me not; I will make a Star-chamber matter of it; if he were,.twenty sir.John Falstsffs, be shall not *b?*? Robert Shall:-.-.-.- Esq., 8lender\'~-ni the county of'Oloslci, Justice Of ponce Mid eorttrh. 7 Shmuw. All, cousin Slender, and cuit * *rp?Shajctpcart. Merry Wive* of Vfindtpr. Editor Or any dnag Artest IVieems that the "cap fits" the poll ! Bo the po//says itself 1 How remarka ble it verification of the statements, in toy last letter, is found in the reply to me, in your last issue ! I stated, in my last, that "we have a Court dowu here as is a-Court," and I ask you have we not;-by the statement of the Court it- j eelf ? Is it not a Court of Uncommon Pleas? i Is'it not equal to the Court of Ssneho Prfggft? En paitant as to the mkgxilutle of Snncho Panza's Court. The Court says, in its verification, that "the "Court of Saucho Panzn is a subject nf too much magnitudo for my braiu." Without arrogating to myself the pos session of the judicial brain of this our Conrt, I have certainly a sense of humor sufficient to appreciate tho rich farce of ingenious justice portrayed, in the Court whore Saucho believed himself a judge of mattem grand and mean, and to be reminded of it by "our" Court. Perhaps our Conrt here at Branchvillo (which is so?disani tho Court of Branchville!) bas read Don Quixote ; perhaps it is his beck of precedents; perhaps lost in ad miration of its magnitude, he apcB San. . cho's Conrt in his own. Perhaps his idea of its magnitude, is expressed in tho words ignotam pro magniftco! I said that our Court down here sits o'nights, Areopagus-like. The Court says itself the case of Smothers was tried on May 8tb, commencing at 7 P. M. A mistrial ensued and the case was con tinued until the "ucxt evening, at the same hour! I did misstate the verdict. It - Was "Not Guilty." That was a miss tatement as to the jury. To them I apologize; for my esteem for my fellow citizens named iu the verification ns composing the jury, is just as great, as that entertained by tho Court, if not so i ridiculously aud fawningly expressed. But all of my statements as to the Court, , aro certainjy verified by the Court's own ridiculous detail. Then as to the trespass case ! How rny statement of tho process for bringing parties into Court is verified by the Court ? It say? : "I sent for him next dsy, he came"! How touching! Lot the Court give the rest iu itsowu syntax which is peculiar, and $uigeneral "I gave them a preliminary investiga tion, the papers were partly arranged for the case, when it suddeuly comes to light, that she is half sister, or some other relation of his they looked smil ingly at each other, and proposed to pay Two Dollars, hulf of which was puid, and thoy then departed better fricuds than ever." % "What a scene ! In the startling dis covery of a newly-found and near rela tive, they smiled a "smile that was child like and blanri," and enthusiastically .proposed?what ? A merry making of friends "that the lost is fouDd"? A . yell? An embrace? What did they propose ? 7o pay Tuo Dollarn ! How extravagant their joy ! More, in their wild enthusiasm "half" was pail cash to the Court.' No doubt the Court could ? ? .? -. 1_?I_ ?*?yr^?- ------ -o . - beautiful an episode in the history of this "Court" ! Do its docket-books whioh liko its "official acts" are upeu to .the public view, give a faithful record of this holy scene ? If so let tho public, Mr. Editor rush down and read and melt.! By tho way are tho "official acts" of this Court like thoso of tbe General Assembly, to be published ? ' Bui. alas ; to mar, the beauty of this "oflfcaiaJ act" of the Court's ! Half was paid cash ' The othor half of. tho vol usterr roa^c-offerino- to tho Justice of the Peace; how about that, May it please the Court ? Peace offerings must not be by piece" meal; the Court must have it all, and the parties aro threatened with impris onment in the County Jail, if it is not paid. Does this too appear upon the open Docket-books? Do the open Docket-books shew up tbe case of coat stealing, where no oath was administered to any body and where with a mockery of trial a colored man was sentenced to twenty days in jail ? Do tho Docket books give the account of the hricft-to\t ? We will, however rcserre the account of this for 6ur next, if this Court wants to oc further shewn up. Enough Mr. Editor, appears from the statement of tho Court itself to show that' we*bare a "Co?rtl "which I am free to maintain. What an unfortunate expression of this Justice of tho Peaco is that of "turning things to account"! Has this Court a precedent book by which ho turns things to account, or does he do it by his own ingenuity and tawir vivrttT j "If, "says this Justice Shallow," I had adopted the course of many, tho State would have owed mo thousands,! O' immaculate Dogbory ! many get thous- j ends ! but thou hnst but "a little"! How sad ! How much greater is thy little thon the thousands of "the many"! But how plainly this Court saw liow to turn things to account, and how nobly it resisted the tempter ? It aays, "Had I not the power in this case ol turning it to some account" ? Had he in this case ? I dont Mr. Editor see that ho had any such power! If ho thinks ho has such power, will ho, can he always thus resist? If he has such a power or thinks he has how we must all dread him ! How would he use tho power ? Perhaps by "robbing Peter to pay Paul" (Pohl). Perhaps by playing "Witt/ Pry"! No Mr. Editor, this question usked with such apparent coolness and impudence, "Had I not the power," is enough of itself to condemn this Court. Perhaps he may some day discover hin mistake. He has no such power. As to the "many" who make "thous nnds," I suppose the other Trial Justices in this County are meant. They he thinks hate the "power" like himself, and they unlike himself he Rnys have made "thousauds." Lot th. m speak for themselves! Now, Sir, has not this Court made n rich attempt to reply to the just criti-1 cisin, in which it is my right, as a citi zen, to indulge? Has he not shown himself up a genuine Justice. Shallow ? Dogberry, another type of his kin I, furnished by the bard of Avon, sighed that the sexton was not there to write him down an "ass," but this immaculate .Justice has written himself down, and published himself in his County's Journal, over his own signature in terms unmistakably plain and irrevoca ble?a most egregious ass ! His reply is a stupid failure. Instead of denying my statements he Verifies them by giving the public the ridicul ous details of his practice, those very details corroborating my charges. Iiis reply exposes not only these details, but his ignorance, of duty as well as of grammar. It shows but the''fitting of tho cap" aud the "wincing" of "the galled jade" under my criticism, which appears too well merited to be a jest. Under his mistaken notions of his ? power to turn things to account," I would warn him of another tribunal to which he is answerablo besides that of public opinion ; and whore, if he cx crcis.s his supposed "power," he may meet with a punishmcut severer than criticism or censure. ^ He concludes his reply by saying, that "really" "he fears" und that "it would be a pity to brand" his critic ' a liar." Ho may well tear and it really would be a pity for hint to do this. I cannot say that this Judge Shallow is a liar, iu his details of his Co^rt bocauso they confirm my statements But in his personal allusions I do say, without fear or pity that he is a "liar." That is plain enough even for him. Further, I, like the statements I make, am not mythical, but substantial and real, and this Justice Shallow who whines so at being abused can got my name by proper application to you. Mr. Editor, if ho desires satisfaction, other than that of ngaia publishing himself an "ass." OLDSTER. Proceeditigs of Council. Oranoeburq C. H., S C.. June 6th, 1871.
