The writer certainly shows himself open to the well-directed attack of cur friend, "OrlJSTBR,",in his thoughtless oud silly reply. All public officers should expect the criticism of the public. Their reply * to this criticism, when exercised, should be,*fi explanation of themselves, and not iri.'this eyllubub malevolonce all around. Mr. Pohl in Iiis letter asserts in substance that ttiere are Trial Justices who havo swin dled tho County. As a public journal' ist we demand proof of this assertion. If anybody has been playing a cheating game towards the Stato or County, in Che'capacity of Triul Justice, the public has a right to know who they aro, and demand proof for conviction. And now as- Mr. Pohl is a sworn officer of the State, and consequently bouud by said oath Ot? obligation to protect her rights, ah?'mbre especially those of tho County in.which he holds his appointment, it is "his ItigUest and most imperative duty to bring these parties, who have been play ing a double game in tho role of the Trial Justice, to condign and merited punishment. Tho assertion is made in so many words that somebody's course would not stand tho test of the square ; and as tho onus probandi rests upon Mr. l'ohl's shoulders, the public, to whom he has voluntarily given the intelligence, will certainty have a very curious opin ion of him, unless he assists them in havingtheso swiudlcrs brought to the pro per place. If it is at all probable that a Trial Justice who has only hold his po sition for a few mouths, could have had tho State indebted to him in the pretty littlo sum of "several thousand dollars," by" ''turning things to account," it is "hignly necessary that n rigid examina tion should speedily take place in this branch of our judicial department. As we said in the onset, replies to criticisms should always be to explain uway the cause fbr criticism, or in exculpation of the ucts of the party attacked. Mr Editor Permit me through your columns to reply to a communication signed Oldster, which appeared in your issue of tho^Oth inst. I shall endeavor to bo very brief, by making a short cut, knowing if made in the right place, it will provo just as futul. I shall therefore content myself by branding him on ass, aud leavo him for a while, in order to laj bcforejjtho public, the very cases he refers to, commencing first with the case Tho Stato Vs. Nelson Smothers: Nol son Smothers is a gcutcel colored mini employed hero as a Hole! waiter he hired a girl about thirtcou years old, to take oare of his child; it is said that he bent her, and the mother of the girl n genteel woman of color entered suit in my offioe ngiinst him, for an Assault and Battery, there boiug other business in the office at the timo, her cuso had to be nccessarilly doferred ? for two days, and then was tried on tho eighth duy of May commencing at 7 o'clock Pin. Mikcll Carroll Esqr appearing for tho defcuce, I would say here for this gen tleman, that while he is alive to the du ties of his profession, ho is - only resilient, and not a native of these parts, and is unlike many of the new made fledgelings of the Low, who have yet to learn somo thing of legal etiquette, and that Shakc spearo done up in bombast, before a jury, is not law practice i However Mr Editor pardon me if I have digressed from the subject ; I will etato, that tho defendant called for a jury, they were summoned, all b?ing colored excepting Mr A. Loryen, who isnn intelligent gen 11onian, and r Merchant of good standing in the place He acted as foreman. After the case had been hc&rd lefore the Court, and the jury charged, they went to the jury room, aud failed after boiug out, to agree, .1 his jury was thorcupou discharged and tho case Carried before another jury the following evening at the same hour. This jury I will particu larly state, was selected from tho most in telligent class of our citizens and num bered four white, and two colored, Their names were ns follows,?-Messrs J. W. Fairey, Kwd Carroll, L. 0. Rlgga, S. S. Turner, nl white, the two colored were, Thomas Murphy, nnd Gabriel Fairey, After retiring they held tho case under consideration for possibly two hours, and then found the Defendant, "Not Guilty," whereupon the Prisoner was discharged. Now sir take up the other case, whieh is as follows thero came into my office a colored woman who said she wanted to prosecute a colored man, for repeatedly passing through hor farm, llo lives about two miles fron? this place I sent for him tho next day, he came and so did she, I gave tlteni a preliminary invostig ition, the papers were partly arranged for the case, when it suddenly comes to light, that she is half sister, or some other relation of his they looked smilingly at each other, aud proposed to pay Two Dollars, half of which was paid, aud they thcu departed better?friends than ever. This Oldster iu his attempted burlesque of my Court, or in other words the Court of Branchville, would try to make it appear, that injustice was prac tised, does there seem to be any of it here; had I not the power in this case, of turning it to some accouut provided I had followed the illustrious example of some who have been deprived of lite offices to the one I hold, by making this poor, ignorant, trespasser, suffer for a time in jail, in order to swindle the State out of an amount largely in excess of the Two Dollars, agreed upon by the parties themselves. Now I claim that I do not only have the honor of holding my office by tight of Executive appointment, but by the wish and consent of honest, re spectable, intelligent citizens of both parties, aud that my official acts as well uh the I)oekct books, in my office, are and ever will be open to public inspec tion as well as to that of the grand jury, which I iuvite at any and all times, aud will add that all lines, so far received in my office for the State have been paid over, while I bavo not yet received one cent from it, for the State owes me but little, while if I had adopted the course of many, it would without a doubt have owed uio thousands, uow sir I will stop my extravagant waste of ink on this Oldster for really I fear by his name he is cnther too old and feeble to stand it, or having reached his second childhood, it would be a pity to brand him a Liar. Notice of the time and place of such meet ing to be given by the Clerk of the Board of Trustees by posting written or printed no tices in three (8) public places of the School District at least ten (10) days before said meeting. Your speciul attention is invited to the following extracts from an Act to amend au Act entitled "An Act to establish and maintain ti system of Froo Common Schools for the Sinte of South Carolina,-' ap proved March 6th, 1S71: Bsc. XXIX. Tho County Treasurer shall pay over all moneys by hint receive'!, which shall have been assure 1 by virtue of tho\ofo of any District meeting as hereinafter pro vided for, in tho County in which such dis trict is situated, on the order of the Clerk of the Board of Trustees of said District, coun tersigned by the County School Commission er, to he used for the purpose directed by' the District meeting so bold.
