SECTION 1. Bo it enacted by the Sen ate and House of Representatives of the State of South Carolina, now met and bittihjc in General assembly and by the authority of the same, That if any per son shall assault or intimidate any citi ten because of political opinions*or tho exercise of political t ights und privile ges guaranteed to every citizen of tho United States by tho Constitution and laws therefof, or by tho Constitution and laws of this State, or, for such reason, discharge such oitizens from employ ment or occupation, or eject such citi sec from rented houso or laud or other property, such person shall he deemed guilty of a misdemeanor, and, on con viction thereof, bo fined uot less than fifty or moro than ono thousand dollars, or bo imprisoned not less than three months or moro thou one year, or both, at the discretion of tho Court. SEC. 2. That if any two or more poi sons shall band or conspire together, or go in disguise upon the public highway or upon the premises of another, with intent to injure, oppress, or violate the person or property of any citizen, be cause oi his politicul opiuiou or his ex ... pression or exercise of tho sumo, or shall ' attempt, by menus, measures or acts, to hinder, provcut or obstruct any citizen in the free exercise and enjoyment of any right or privilege secured to him by tho CotiStitution nud laws of tho United States, or by the Constitution and laws of this State, such person's shall be deemed guilty of a felony, aud, on con viction thereof, be fined uot less than ono hundred or more than two thousauu dollars, or be imprisoned uot less than six months or more thnu three, years, or botA,*? the dtscrctian of the court; and shall thereafter bo ineligible to and dis abled from holding any offico of bouor, trust or profit in this State. Sec. 3. That if, in violating any of the provisions of this .Act, any other crime, misdemeanor or felony shall bo committed, tho offender or offenders shall, i.n conviction thereof, be subjected to such punishment for tho same as is attached to such crime, misdemcunor and folony by the existing laws of this State. 2kc. 4. That the Sheriffs, constables and other officers in tho several circuits or counties vested with powers of arrest ing, imj'risoning and bailing offenders against the laws of this State, bo, and aro hereby, specially authorized und re quired to institute proceedings against all and every person and persons who shall violate any of the provisions of this Act, and cause him and them to be arrested, imprisoned or bailed, us tho may require, for a trial beforo such court as shall have jurisdiction of the offence. Sec? b. That tho Circuit Courts of this State, within their respective cir cuits, in the counties of which tho cir cuits are respectfully composed, shall have cognizance of all offeuccs commit ted against the provisions of this Act, and.of all other onuses arising under this act. Sec. 6. That it shall be the duty of shcriffS,' couetablcs, and other officers who may be specially empowered, to obey anoVcxeeute nil warrants and other pr?P^s issued uudet the prov:siou8 of th?ftct to them directed; and should anj sheriff, eoustable, or other officer specially empowered, refuse to receive such warrant or other pt'occss, when tendered to him, or neglect or refuse to recugg^uch warrant or other process, when tendered to him, or neglect or reftaty to exeeute the same, he shall, on conHBtjlon thereof, be fibeu in the sum of fi$? hundred dollars, to the use of the citizfffs' deprived of the rights secured by the provisions of this Act, or be im prisoned iu the Comity jail, in the dis cretiol of the Court. And the better to enabld the sheriff's, coustables, and other officers jtpeeially empowered, to execute all such warrants and other processes as may be directed to them, they shall have authority to summon aud call to their aid tho by-Standers or jmssc covu'latus of tho proper county; and all pctsouH refus ing to^Vjbey the summons or call of the officdra thjis empowered shall bo deemed guilty of a' GuTsaemettuor, ?n-j, on cuu victipj^hefeof, be punished. And such warrants aud other processes shall run and ho executed by said officers any where within the circuit or county iu which they ale issued. SE/if 7, That any person who shall hindenpf^rvjvent or obstruct any officer or othe/'l^r'sph charged with the execution of any warrant or other process issued under" tho provisions of this Act, in ar resting sny person for whoso apprehen siou sprich warrant or other process may have been jtusucd, or ahull rescue, or at tempt to rescue, such person from tho custody of tho officer or person or per sons lawfully insisting him, as aforosaid, or shall aid, abet or assist any person so arrested, ns aforesaid, directly or indi rectly, to escape from the custody of tho officer**fl?rfe?n or persons assisting him, us aforesaid, or shall harbor or conceal any potion for whose arrest a warrant or otherprocess shall have been issued, ho ns to nravfTBt;his dine.';v<>ry and arrest, after notice or knowledge tut tho lact oi the isj?t(ng "I such warrant or other ?d? process, shall, on conviction for cither of said offences, bo subject lo a fine of not loss than fifty, nor more than ono thou sand dollars, or imprisonment of not less than three mouths, nor more than ono year, or both, at the discretion of the Court haviuS jurisdiction. Seo 8. That any citizen who ?hall be hindered, preventod or obstructedtcd in the exercise of tho rights aud privileges secured to him by tho Constitution and laws of the Uuitod States, or by tho Constitution and laws of this Stute, or shall be injured in his person.or properly because of his exercise of the samo, may claim and prosecute the Couuty in which tho offence shall be committed for any damages ho shall sustain thereby, and the said county shall bo responsible for the payment of such damages as tho court may award, whioh shall bo paid by tho county treasurer of s-ich couuty on u warraut drawn by tho county commis sioncra thorcof; which warrant shall be drawn by tho county commissioners as soon as a certified copy of tho judgment roll is delivered them for file iu their offico. Sec. 9. In all cases where any dwell iog house, building, or any propcity, rcnl or personal, shall bo destroyed iu lousequcuco of any mob or riot, it shall bo lawful for the person or persons own ing or interested iu such property to bring suits against thn county iu which such property was situated and being, for the recovery of such damages as ho or they may have sustained by reason of the destruction thereof; and tho amount which Bhall be recovered iu said action shall bo paid iu the mauncr provided by Section 8 of this act. Sec. 10. That no person or per* n shall bo entitled to tho recovery of such ; damages if it 6hall appear that the de struction of his or their property was caused by his or their illegal conduct, nor uulesa it shall appear that he or they upon kuowledge had of the intention or attempt to destroy his or their property, ?t to collect a mob for that purpos), aud, sufficient time intervening, gavo notico thereof to constable, sheriff, or trial jus tice or justice of the peace of the coun ty in which such property was situated and beiug; and it shall bo tho duty of such constable, sheriff, trial justice or justice of the peace, upon receipt of such notice, to take all leg:tl means necessary for the protection of such "property as attacked, or threatened to be attacked ; and, if such constable, sheriff, trial jus tice, or justico of the peace, upon receipt of such notice, or upon knowledge of such iutention or attempt to destroy such property, in any wise received, shall neg lect or refuse to perform his duty iu the premises, ho or they so neglecting or re fusing shall be liable for the damngos done to such property, to be recovered by action, and shall also be deemed guil ty of a misdemeanor in office, aud, on conviction thereof, shall forfeit his com mission. Sec. 11. That uothing iu this act shall be constructed to prevent the per son or persons whose property is injured or destroyed from having and maintain ing his or their action against all and every person and persons eugaged or par ticipating in said mob or riot, to recover full damages for any injury sustained : Provided, however, That no damages shall be recovered by the party injured against auy of the said rioters for the same injury for which compeusatiou shall be mado by tho couuty. Sec. 12. That it shall be lawful for tho county commissioners of the couuty ngaiost which damages shall bo recover ed uudcr the provisions of this act to bring suit or Buits, iu the uume of the county, against auy and all pcrsous en gaged, or in auy manner participating in said mob or riot, aud against any con stable, sheriff, trial justice, or justice of the peace or other officor charged with tho maintenance of the public peace, who may be li.ib'o, by uoglcot of duty, to tli6 provisions of this act, for the re covery of all damages, costs and expen ses incurred by said county, and such suits shall not abate or fail by reason of too many or too few parties defeudaut being named therein. Approved March I, Lc?7i An Act to Establish the Charleston Chari table Association, of the State of South Carolina, for thr Benefit of the. Free. Schools Fund. Section 1. Bo it enacted by the Sen ate and House of Representatives of the Stato of South Caroliua, now met and sitting in General Assembly, and by tho authority of the Batno, That R II Wil loughby, F II Frost, J V Horbach, M j Hirsch ?nd Oscar B Little, of South Carolina, and their associates or partuers, shall have tho full righ*, and aro hereby authorized, to form themselves into a pnrtucrship association, to be known un der tho name and style of R II Willough by, and Company, or such other names as they may now or hereafter assume. S?c. 2. That all tho rights of corpora tions known as banks be, and tho same aro hereby, vested in tho said firm, for the purpose of loaning out money on in terest, purchasing and mortgaging real estate, buying porsnnnl properly; mid thoy shall have the same rights and pri vileges now enjoyed by tho banking in stitution* of the Stato; they shall also have ike right to dispose of any and all such property, real, personal or mixed, that they may become possessed of, in any manner, and on such conditions, as the said firm or association may deem fit and proper and to the advantage of said firm and to promote the interest of said School Fund of the State of South Caro lina. Sec. 3. Bo it further enacted, That, before commencing business under the provisions of this A t said firm e'.mll pay or cause to be paid, into tho hands of the Stato Superintendent- of Educatiou, the sum ofono thousand dollars, (8 1, 000) to be used for tho benefit of the free -schools of South Carolina, and annually thereafter a like amount, for the term of ten years, or so long as said partnership shall choose to bo business, it being un derstood and ngrced that said payment of ono thousand dollars per anuum by said association is tho consideration upon which tho privilege of iucort oration herein is granted; and whencvor said company, or firm, association, shall fail to pay said consideration'^ then their right to transact business shall cease, Skc. 4. That tho association, company or firm incorporated and established by tiis A.'t shall have lull power, and ure hereby authorized, to establish agencies throughout the State. Sec. 5.
