Whereas, It appears by the books of the State treasurer that there has been duly issued certain certificates of State stock, to the amount of five thousand six hundred and 6ixty dollars (856G0) to John Phillips, cxc:utor of John Camp bell, deceased; and, whereas, suid stock was lost or destroyed at tho burning of Columbia, in February, 1SC3; and, wher n8, it is cquitablo aud just that the stock should be renowed on the the part of the State; therefore, bo it Resolved by tho Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by tho authority of the samt!, That the State treasurer be, and he hereby, authorized to reissue to siad John Phillips, executor of John Camp bell, deceased, ccrtiGcatcs of stock of the same amount, payable at the same time, and bearing the same rate of interest, as those lost or destroyed; and that the said John Phillips is hereby required to de posit with the State treasurer a bond, legally executed, in the penal sum of eleven thousand three hundred and twenty dollars (811,320) to indemnify the State against loss. Sec. That this gift and grant is made upon tho express condition that said grantees shall pay to the Stato of South Carolina tho sum of one (1) dollar per ton for ovcry ton of phosphate rock aud phosphatic deposits dug, mined and re moved from the said navigable rivers and waters of tho State j and, further, that the said guarantees shall pay into tho Treasury of tho State tho sum of five hundred dollars, as a license fee, bc furo ounimcncing busiuess under said grant. Sec. 3. llcfuro commencing opera, j tions under nuthotity of this Act, said I grantees and their associates shall file^ or causa tu br filed, in the office of the State Auditor, n bond in the penal sum of fifty thousand dollurs (50,000) dol lars, conditioned that said grantees and their tssociatos shall make true, aud faithful returns to said s!a e uuditor, annually, on or before tho first d.iy oi October, and oftcner, if icquired by tl c said State Auditor, of the uutnbcr of j t ms of phosphatic rooks and phospnntic deposits dug, iniucu and removed by them from the bees of the navigable streams and waters of the State; and shall punctually p;y to the State Treas urer, Annually, on the first day of Octo ber, one (1) dollar per ton for every ton for cucry ton of phosphate r< cks and phosphatic deposit by them dug, mined and removed from the beds of the navi gable streams aud waters of the State during the year preceding; said bonb to be renewed annually, aud approved by the Attorney-General. The books of said grantees and their associates shal be opeued to tho iuspectiou of the State Auditor, or agent duly appointed by hitu for that purpose. SEC. 4. That the capital stock of said company shall consist of two million (2,000,000) dollars, to bo divided in shaics of one hundred dollars, each, with tho privilege of increasing the same to a*i nmouut not exceeding five millio > dollars; and whou the sum of three hun dred thousand dollars shall ha\ i bet n subscribed, tha said company may I c organized and go into operation. Sec. 5. That the profits of said company may, from time to time, he divided among tho stockholders ucordingto such rules and regulations as they may pre scribe, not repugnant to the luws of the State Sec. G. That the steck of said compnny may be transferred in such manner and form as may be directed by the by-laws of the Company. Sec. 7. The said company shall be en titled to all the rights and privileges ac corded to other corporations incorporated by the laws of this State: Provided, that nothing in this Act shall be construed as giveing to the said Souh Carolina Phos phate and Phosphatic River Mining Com pany the exclusive right to dig and mine in the unvigal le rivers and waters of the State. Sec. 8. All Acts aud parts of Acts inconsistent with this Act are hereby repealed. Approved March 9, 1871. Re it enacted by the Sen ate nnd House of Representatives ol the State of South Carolina, now met aud sitting in General Assembly, and by the authority of the sttne. The Enterprise Railroad Company are hereby authorized to lay their railroad traok through and along any street of tho city of Charhs ton, whioh may be necessary, iu order t<> ktMIII\.t.li <? l.i. ..... . ... ki.U . .. .. Carolina Railroad Company, and track of the Northeastern Railrotd Company, and to couuect East Ray Street wi h the Ashley River. Sec. 2. The said company arc forth or authorized to lay their rai'rond track and run their curs from any point or points on the Cooper River, to any point or points on the Ashley River, within the city of Charleston, or within ten milca of the corporato limits of said city. Sec. 3. The said company arc further authorized to issue seven per cent cou pon bonds, to the amount of ten thou sand dollars for every mile of completed railway Q Se^. 4. The said compacy arc fur tner authorized to lay their railway irack or tracks, should it be found de sirable, down to tlt'O water frout of any of the wharves >f the said city. Sec. 5.
