Agents of Insurance Companiee doing business in thil State, that ?"h and after the twenty-first day of February, 1870, they will be required to obtain new licenses, and before said licen ses arc issued, the Companies will be requir ed to make a deposit of certain bonds or stock with tho Act of December 22d, 1809, a copy of which is hereunto appended. AN ACT to regulate the Agencies of Insu rance Companies not incorporated in ihe State of South Carolina. 8BCTItiH I, He it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitiiug in Geueral Assembly and by the authority of the same, That it shall not be lawful, nftcr the first day of April, one thousand eight hundred and aixty-nine, for any agent or any Insurance company in the United States, or any foreign State, incorpo rated by the laws of this State, to take risks or transact any business of insurance in this State without first obtaining license from the Comptroller General, which license shall ex pire on the 81st day of March of each year. Src. 2. Tbutb before the Comptroller General shall issue suebjicense to any agent of any insurance company not incorporated in South Carolina, there shall be filed in his office a certified copy of tho charter of tho company from?which the said agent or at torney has received his appointment, and also a certified copy of tho vote or resolution of tho Trustees or Director of said company appointing him suck agent, accompanied by a warrant ot appointment under the othcial seal of tho company, and signed'by tho I'rcxident aud Secretary. That said companies have fulfilled the provisions of their respective charters, and of the extensions and amendments thereto, in every particular, and whether there has been any change of charters since last statement. 2d. The amount of policies outstanding as near as can be ascertained. 6d. The character of the risks, and the rule governing companies and their agents in taking the same, both as to locality and amount. 4th. Tho particular character of the as sets, specifying 'he amount of cash and pub lic, bank, manufacturing or other stocks and bonds, or other securities, held by the com panies, with the evidenoe that they are held by them, the rule of investment in real es tate, securities, and the general localities of real estate secured to oompanies. 6th. That every agent or attorney ob* lalning SUoh license shall ulso cause such li cense to be published in some newspaper, to be designated by the Comptroller General, having circulation in the county in which he resides. The compauy shall also furnish the Comptroller General, through their agent, an annual statement of the affairs of the com pany, as provided in the second Section of this Act, and it shall be the duty of the agent or agents to publish the same. Sec. 4. That if the Comptroller shall bc soiue satisfied that any company is insolvent or unsafe, it shall be Ids duty to refuse li cense to its agent or agents, and to "/ithdraw any license that has been already issued. Ski;. 5. That any person who shall deliver any policy of insuranee, or collect any pre mium of insurance or transact any business of insuranee in this State, for any company in the United States, or foreign State, not incorporated by the laws of this State, with out having first obtained license as by this Act required, or after his license has been withdrawn, or who shall in any way violate the provisions of this Act, shall be fined for every such offence not loss than one hundred dollars, nor more than five hundred dollars, at the discretion of the Judge: Provided, further, That nothing contain*.* in this Sec I tiou shall release any company or companies upon Any policy issued or delivered by it or them. Section 1. lie it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in Gen eral Assembly, and by the authority of the same: No Company or Association which is now organized, or which may be hereaf ter organised in thin State, to carry on the business of insurance of ariVkind or kinds, shall proceed further with business (as the case may be) until they hnvo deposited with the Comptroller General of this Stato bonds or stocks Of7 this State equal to the sum of fifty thousand dollars par valuo for each Life Insurance Company or Association, and twenty thousand dollnrs par value for each other lnsuranco Company or Association. The Comptroller General .?hall hold such bonds or stocks as security for policy holders iu the Company or Association; but, so long as any Compuny or Association so depositing shall continue solvent, the Comptroller Gen eral may permit such Company -#to collect und receive the interest on such bonds or Btocks bo deposited. Skit. 2. Whenever any Company or Asso ciation is, or shall become fully organised, and the said Company or Ass ciation have deposited with the Comptroller General the requisite amount of State bonds or stocks, it shall become his duty to furnish the Corpora tion or Association with a certificate of such deposit, which certificate or duplicate thereof certified by the Comptroller General, may be used in and be evidence fur and against the Corporation. * Skc. 3, It shali not be lawful for any per son or persons. Corporation of Corporations, Association or Associations to act within this State as agent, or otherwise, in rcociving or procuring applications for insurance of any kind or kinds, or in any manner to aid in transacting the business of insurance of any kind or kinds for any Compauy or Associa tion incorporated by, or organized under the laws of this or any other State Government, or any foreign Government, until such Com pany or Association have deposited with the omptrollcr General of this State, for the benefit of the policy holders of such Com pany or Association, citizens or residents of the United States, bonds or stocks of this Stato equal to tho sum of fifty thousand dol lars par value for each Life Insurance Com pany or Association, and twenty tbousaud dollars par value for each other . Insurance Company or Association ; but, so long as any Company or Association so depositing shall continue *wtvenf.'"v tu? .Comptroller General ^?mii Huf? i>onipnii/* or Association to collect and receive the interest on such bonds or eto-jks so deposited, and have appointed an Attorney in this Stute on whom process of law can be served ; and said Attorney shall have tiled wiih the Comptroller General a certified copy of the charter of said Com pany or .Association, and also a certified copy of the vote cr resolutions of the Trustees or Directors of such Company or Association ap i pointing him the Attorney of such Company, I which appointment shall ctntinue until another Attorney be substituted ; which shall be done upon the death, removal or in capacity to act of such Attorney, or may be done by such Company or Association nt any time. When the foregoing requirements, and such other requirements as now are, or may hereafter bo required by law, shall be complied with the Comptroller General shall give a certificate to that effect, and also state the netne of the Attorney, which certificate, when filed in the County Clerk's Office of the County where the agency is to be located, shall be the authority to commence business. Skc. 4. Every violation of this Act shall subject tho Company or Association, or agent or agents, violating, jointly and severally, to a penalty of five hundred dollars for each violation, which shn.ll be sued for and recov ered in u joint or several civil action, in the name of the State of South Carolina, by the Solicitor of the Circuit in which the Com pany or Association, or agent or agents so violating, shall be situated ; one-half of such penalty when recovered shall be paid into the County Treasury of such County, and the other half to tho informer of such viola tion ; and, in case of the non-payment of such penalty, the persou or persons so offend ing shall be liable to imprisonment for a pe riod not exceeding one year in the discre tion of the Court having cognizance thereof. Sko. f>. The Comptroller General shall safely and separately keep the bonds or slocks of eaoh Company or Association, nnd ceived ; and during the usual office hours, shall keep the bonds or sleeks, subject to the examination of the representative of any Com pany or Association having made a deposit, ns required by this Act ; and the Mate shall be responsible for the return of all said boHds or stocks dy the Comptroller General. Skc. 6. All Acts ami parts of Acts incon sistent or conflicting with this Act are here by repealed. Ski: 7. This act shall dike effect sixty days after its passage.
