The New "Trial Justices"

Mr. Corbin, ou Saturday, introduced
th? following ?? Bill to define the Crttui
nnl Jurisdiction of Trial Jue?ecV' qf
which he lud previously given notice:
It provides that Trial Justices shall
have Jurisdiction of all offence* ?hieb
may be subject to the pounltics of either
tiue or forfeiture, not' exceeding one
hundred dollars, or imprisonment in the
Jailor Houso of Correction not exceed
ing thirty days, and may impose any
sentence within those limits, singly or
in the alternativ?.
They may punish by fine uot exceed
ing one hundred dollars, or imprison
ment in the Jail or House of Correction,
not exceeding thirty days, all assault
and batteries, and other breaches of the
peace, when the offence is uot of a high
und aggravated nature, requiring, in
their judgment, greater punishment.
They may cause to be arrested all
affrayero, rioters, disturbers and break*
era of the peace, and all who go armed
offensively to the terror of the people,
und such as utter menaces or threaten*
ing speeches, or otherwise dangerous
ami disorderly persons.
Persons arrested any for of said offences
shall be examined by the Trial Justice
before whom they ore brought, and may
be tried before him, and if fonnd guilty,
may be required to And sureties of thn
peace, aud bo punished within the lim
its prescribed iu Section 2, or when the
j offences is of a high and aggravated na
ture, the;.- may be commited or bound
ovor for trial before the Court of Gener
al Sessions.
They shall have jurisdiction of lar
cenies, by stealing of the property of
another, of money, goods or chattels, or
any bank note, bouud, promissory notes,
bill of exchange or other bill, order or
certificate; or any book of account for
. or concerning money or goods due, or to
become due, or to bo delivered, or be
?delivered; or any deed or writing con
lainiog a conveyance of land; or any
other valuable contract in force; or any
receipt, release or defeasance, or any
writ, process or publio record, if the pro
perty stolen docs not exceed twenty dol
lars iu value.
They shall have jurisdiction of the
offences of buying, receiving or aiding
5n tho- concealment of stolen goods or
proporty.
They shall hare jurisdiction of the
offences of obtaiuing property by any
fslrc pretence, or by any privy or token,
or by any game, device, slight nf hand,
pretensions to fortune telling, triok or
other means, by the uso of cards or other
implements or instruments, where they
would have 'jurisdiction of a larceny of
if he same property, and may punish said
?offences the same as larceny.
They shall cause to be arrested all
persons, found within their counties,
charged with any offence,?and persons
who, after committing any offence with
in the county, escape out of tho saino;
?examine into reasons, felonies, grand
?arcenics, high crimes aud misdemeanors;
'.and commit or bind over for trial, those
?who appear to be guilty of crimes or of
-.fences not within their jurisdiction, and
punish those guilty of such offences with
in thoir jurisdiction.
AH proceedings before Trial Justices,
t in criminal cases, shall bo commenced
on information, under oath, plainly and
substantially settiug forth tho offence
charged, upon which, aud only which,
shall a warrant of arrest issue.
The information may be amended at
any time before trial.
All proceedings bo furo Trial Justices
shall bo summary, or will) only such de
lay as a fair and just examination of
tho caso required.
Every pemon nrrested aud brought be
fore a Trial Justice charged with an of
fence within his jurisdiction, shall be
entitled, on demand, to a trial by jury,
to be selected in the manner indicated
by Section 6 of the Act entitled "Ah
Act-to pro vibe the temporary appoint
ment of Magistrates, aud to define their
powers and duties," ratt6od 24th day
of September, A. P. 1868.
Trial Justices are authorised to issue all
necessary processes to cirry thoir powers
intoeffect, aud may exercise all the pow
ers heretofore conferred by law upon
Magistrates
Every person coin ictcd be furo a Trial
Justice, of any offenco whatever, and
sentenced, may appeal from tho sentence
to tho next term of the Court of Goner
al Sessions for the county. The ap
pellant shall bo committed to abide the
sentenco of said Court until he recog
nise to tho State in such reasonable sum,
and with such sureties as tho Court re
uuirei, with condition to appear at the
Court appealed to, and at any subsequent
term to which the caso is continued, if
not previously surrendered and discharg
ed, and so, from term to term, uutil the
final decree, sentence or order of the
Court thereon; and to abide such final
santeuce, order or decree, and nnt depart
without leave; and, in the meantime, to
keep the peace and be of good behav
iour.
