the ages of eighteen ami forty-fivu years, re
siding in this State, and not exempted by toe
laws of the United Status, shall ho subject to
military duty excepting
1st. All pe.sons in the army or navy or |
volunter forces e! the United States.
2d lte^ular ordained or licensed minis'ei s
and preachers of the Gospel.

have served as such in the loyal militia of this
State, or in any of the United States, for the j

7th. Idiots, lunatics, paupers, and persons
convicted of infamous crimes, shall not he sub- >

Skc. -. That under the directions of the ,
j Cnmmandur-iu-Chief, all persons li ude to mil
itary duty within this State, who are not al
ready members of the National Guard, as.
hereinafter provided, shall, immediately upon
j the passage id'this Act, and from time to tiaie
thctelfter, as the Commander in-Chief shall
deem necessary, but as often as once in every
two years, be enrolled. Such enrollment shall
distinctly specif) the mimes and residences of
the per.ons enrolled and shall also divide the
same into two classes?the persons between
the ages of eighteen and thirty years to con
stitute the fust class, and the persons between
the ages id'thirty and forty five years to con
stitute the second class. Four copies of such
enrollment shall be made by the officer making i
! the same, one of which, alter being corrected,
j shall be retained by him; another shall 1>
filed in the office <>! the Town or City Clerk
in which such company is enrolled; another
shall be filed in the ollice of the Clerk of the
Courts of Record in the County where such
district is situated ; and the fourth shall be
filed in the Adjutant General's office The
. persons making such enrollment shall he com
pensated at the rate of one dollar and fifty
cents per day for every tiny necessarily spent
in making und copying the same; the number

County Treasurer. And when the name ol
any pcrs-.m {between the ages of eighteen and
twenty-one years shall appear on the said roll
liable to pay the said line, the said warrant
shall direct jjhe collector to collect the same of
the lather, guardian or employer with whom
such person tili alt reside or bo employed, or
out of any property such minor may own or

said Count*'; and such collector shall proceed
and execute such warrant, and no property
now exempt from other executions shall be ex

Sec. 4. Tho County Treasurer of each
County shall, on or before the twenty-fifth day
?if April in fach year, pay to the Treasurer of
the State, npo l his orders, the actual sum re
ceived from jUdimiucnts who have failed to at
tend Mteh musters and drills; and it shall be
the duty of the officerd commanding the sev
eral regiincutw, to furnish the County Com
mis.-i.im'rs.t'ic names who have failed to at
tend such musters ami drills. The County
Couitnissiouer shall give the names of the per
sons &?} failmg to tho County Auditor; and uu
less they are excused, shall place an extra as
sessment of line dollir per d iy on their gene
ral tax. if a property holder; and in case said
delinquent or any ol them arc not property
h ddcrs. then he or they shall be compelled to
work the public roads, at a rate not exceeding

Sec. 5. The bond re<juired to be executed
by the collectors, receivers of taxes aud County
Treasurers, shall also apply and extend to any
moneys required to be collected for military
purposes by this Act.
SEC. (?? That all tavern keepers, persons
keeping boarders in their families, keepers ol
boarding houses, and any master or mistress
of any dwelling house, shall upon the applica
tion of any oifi -er authorized to make ?nc!i
curolimuut. give iuforuiutiou of the names of
all persons residing or lodging in such house
liable to be enrolled, aud all other proper
information concerning such persons as such
officers may require.
Sec 7. That if any person of whom iu
forinaliou is required by any such officer, in
order to enable him to comply with the
provisions of this Act. ?hall refuse to give
such information, or shall give false informa
tion, he fh H forfeit and pay twenty dollars
for each item td'information demanded of him
by any such officer and falsely stated, and a
like stun for er.ch individual uutuo concealed
or falsely stated; and every person who shall
ieft.se to j:ive his own name ami proper in
formation, when applied t i by any such officer,
or shall give a false name or information, shall
forfeit ami pay a like sum. such penalties to
be recovered in any c urt of competent
jurisdiction in the name of the State of South
Carolina; and it is hereby made the duty of
such officer to report the name, o' all persons
who may incur an) penalty, under this Sec
tion, to any Magistrate or Justice of the Peace
in the County for prosecution.
SEC. 8. That wherever an enrollment shall
be made as provided in this Act, the Hoard
of County Commissioners -ball cause to be
published, once a week, for four weeks pre
vious to the first diy of February, in a news
paper with circulation in the County, or by
written or printed placards, in not less than
lour public pi.ices, a luliee that such rolls
.save been completed and filed as aforesaid,
which notice shall also specify that any per
son who claims that bo is. fur any reason,
exempt from military duty shall, on or before
the fifteenth day of February next ensuing,
tile a written statement of such exemption,
cettilied by affidavit, in the iffjce of said
Clerk of the Courts of Hcoord, or before a
.Justice of the Peace or Magistrate, in said
County) and the publication of uoh notice
shall be sufficient uottce of ?uoh enrollments
to all poisons named therein; such roll shall
be made in the form prescribed by tho Com
iminder-iu-Chtof; and tho Adjutunt-lJcncraU
shall furnish all tho enrolling olfieurs suitable
blanks and instructions for the completion of
such enrollment.
Ska'. U- That all persons claiming excrop

verified by affidavit, in the office of tho Town
Clerk of the township in which ho resides, on
or before thu fifteenth day of January; iu
default of which, auch person shall lese the
benefit of auch exemption, except auch as are
especially exempted by this Act or by Act of
Congress.
Sec. 10. That the person making such en
rollment shall, thereupon, if such pcrsou be
exempt according to law, mark the word
''exempt ' opposite the unme of each person
presenting such exemption ; it such exemption
be permanent, the name of such person shall
not be included iu any subsequent enrollment.
If any person shall swear falsely iu such
affidavit, he shall, upon proof thereof, be
adjudged guilty of perjury iu any Judicial
Court ot competent jurisdiction.
Skc. 11. That the persons thus enrolled
shall form the rcperve militia of the State of
South Carolinia; those over eighteen mid not
over thirty years of age, shall constitute the
reserve of the fust class; and those over thirty
and under forty-five years of age, shall con
stitute the reserve of the second class.
Skc. 12. That if any officer charged with
any duty under the provisions of this Act,
shall refuse or neglect to perform any of the
duties requited of him by this Aet. he shall
forfeit ami pay the sum of not less then fifty
nor more than one hundred dollars for each
ami every offence, to be recovered iu tlur name
of the people of the State of South Carolina;
and such officers shall, as an additional penalty,
be deemed guilty of a misdemeanor; und it
shall be the duty of the Solicitor of the
Judicial Circuit within which said offender
residua, upon the com] laiut of the command
ing officer uf the regiment, or on the part ot !
I the Board of Couuty Commissioners, to
[prosecute the same. Any penalty incurred
aud paid, ur collected uud.-r this section, shall

StIC. 13. That the Adjutant-General, un

regiments, squadrons, troops, batteries an 1
companies, cause the same to be numbcrc 1
and lettered as nearly in conformity with tlu

I Sec. 1">. That an Assistant Adjutant
j General may be appointed, if deemed necess

duties of Quartermaster-General shall devolve
upon tho Adjutant-General in times of peace.
Skc. 1(?. That in case of invasion, insur
rection or rebellion, or imminent danger there

munitions of the State shall be stored under

officers of divisions, brigades and regiment*
may direct.

incident that occurred iu the good old days
when his lather was Governor of Kentucky.
Howell, who kept a restaurant aud drinking
saloon in Frankfort, reudercd his monthly ac
count to "John" (the hoys could get credit
then) which amounted to Si.r>0. Johnny weut
to his fothcr to get the money.
"One huudrcd and fifty dollars,*' said the
Governor, "that is a large hill, son."
'?Yes, I entertained a great many friends
during the mouth."
"Have you the hill with you ?"
'*I believe SO,"?hesitatingly.
"Lot me see it, son."
"Johnny" slowly drew forth a long strip of
hill paper, on which there was exactly 41
! items put down us ??d'ks," ranging from ten
! cents to as many dollars. The governor nd
| justed his spects, and regarded it attentively,
