this stirring three or four times a day for a

by a great weight of bedclothes,
which often prevent their getting any sound

in his breast the resentment of years, meets
the object of his dislike on tlie streets and
shoots him down, it is suddenly discovered
that he was insane; if tilled Willi bad whiskey
he goes home and beats his wife to
death he ,is found to bo insane; if he
I hunts up a poor betrayed girl, whom he
calls sister and savagely murders her, he is
j insane; if he deliberately points a gun and
puts a handful o! buckshot into the body
I of an aged father, insanity comes to his re|
lief, and the more coolly planned and di i.

j the atrocity, ^tho more powerful element it
becomes in the defence. In print of eeoii|

sideration, it would be better to repeal the
' criminal code as it applies to murders, and

little while to indulge their insiu ; freaks on

There is a judge in California, however,
who does not believo in the iusauc dodge,
and recently sentenced two nan wli were
tried for murder and put in the usual plea.
This judgj instructed th j jury that the insanity
must be established at the time the
murder was committed, not hy inference but
by unquestionable proof, not by the opinion
ot exports but by i'aets which left no doubt!
in the tiiiuds of the jury.
I f judges generally took this view of it
justice would be more frequently dispensed
