J^omts-Couokko 1'boi-i.k jKlb Bound to KutnA?wtlinora, March 22* ?The case of Harriet A- C.illy, colored^ againht the Baltimore and Ohio Uailread Company, which has been ou trial four days iu the United Btates District Court, before Judgo Giles, was concluded this morning, and under instructions from the Court, the jury rendered a verdict for the defendant. The notion, with seventeen otbera, was brought against the company under the civil rights act of Congress of March 1, 1876, which imposes n penalty of $500 on fcny person who should deny equal accommodation to a ay oitisen, regardless of previous condition, in hotels, theatres and publie conveyances. The plaintiff, a colored woman of Maryland, claimed to have been denied accommodations pn the company's, train in June, 187G, and was oompellsd, as shs alleged, to oooupy a compartment oar which was inferior, simply because of her raoe or color. The company denied this, and prevsd that coloied persons had the same rights on all their trains ss whites. The court, however, heard arguments on the constitutionality ef the act under the fourteeutli amendment to the rnn stitulton, and held: 1. That thcslaughter house cases (16 Wallace) had determined that the privileges belonging to cltiiens of the United States, as such, were dif, ferent from the privileges belonging to citiiena of the Stale, as such, and that only the former were under Congressional protection ; that this opinion had been subsequently afliriued by the United States Supreme Court. 2. That the right to ride on n railway car for purposes of local travel was not a privilege of a citizen of the United Statos, as such, but wa3 a privilege belonging to a person by virtue of his 8tate citizenship ; and therefore, for the denial of such.privilege, the citizen must look for redress to the State tribunals; that it was not in the power of Congress to inflict a penalty tor the denial ef such a privilege. The act, therefore, was unconstitutional. This opinion accords with that of Judge Emmonds, Uuited States Circuit, Judge for>the Sixth Circuit, and Judge Sawyer, of Ccliforuia, and nther Federal Judges. A B-\?n ofUksprradoks.?Orangeburg, 8. C., March 21.?The store of Mr. Weeks, near Fort Motte, having.been burglariously entered last week, a warrant was taken out for tho arrest of the offenders, David Mart and 1stael Pinckney, i~?both colored. The proofs were conclusive beycn-J doubt, and Captain F. W. Wannaraaker, Trial ^^^Justice under Gov. Hampton's appointment, sent ' his constable to make the arrests. The constable was resisted, beaten with a fence rail and sent back. Captain Wannaraaker then seut two others, who returned, not being able to ? eneci the arrest, as the two negroes defied all law, and so replied. A prominent citiien, Mr. Shirer, was next sent with nine others ; he, too, returned with the information that the parties had surrounded themselves with a crowd, and would not be taken. The qnestion then was to submit to the burners of a brace of desperadoes or enforce the law.? Captain Wannamnker got together four white men, and came up with the offenders about eight miles from Lewisville. He recited his mission to Israel l'inckney, who seemed te be the leader of the gang of twenty that he found, all of whom held drawn pistols. Israel replied that I "there was no law," and "he'd be d d if any t white man should arrest him." Captain WanIk namaker raised his pistol, as did Hart, anu Captain Wannamaker fired, dropping him at once. The rest of the gang fled. Captain Wannamaker placed the wounded man |&|a in cure of a physician, after capturing two others, then came to Orangeburg to wait any charges, if any, in these lawless, out-of-joiat times. Marshal Nelson gave the word 'fire!' aud , ' five guns fired, tho balls penetrating the body in the region of the heart. Lee fell square back on ? his coffin, dead. Death was instantaneous ? The body was placed in the coffin and the crowd dispersed. There were about seventy-five persons all told on the ground. Not a child or a relative was there. The best order prevailed. Lee's last words to Marshal Nelson were "Aim at niy heart." The body is now on the way to bo delivered to the relatives at Cedar City. Nicbolls is Governor, and his authority is net disputed in the State, except by a faction of corrupt carpet-baggers in New Orleans, propped up by the presence of Federal force. When Hayes hesitated to make good his promises after entering the White House, and sought frivolous excuses for non-aotien, it was evident that he either meditated treachery, or wanted moral sutings to execute the task of so called rk "conciliation." He lias vacilliated from day ..day and swung backward and forward, until j^is weakness, or his^ baseness has sought the y ^present mode of relieT from vexatious preMuro. We ore not disnppolulod in this outcome, because, after a thorough examination of Hayes's career, nothing could be discovered in it whioh atlraoled confidence or inspired admiration.? His last canvass for Governor of Ohio, where he introduced religion aa an element of the eaa?> paign, upon the most false and soandaleus pretext, showed him to be a low and unscrupulous demsgogue, capable of prostituting what most men hold sacred, to serve the ende of party and personal ambition.?Cor. N. Y. Sun. The Louisiana commission is losing ground. It is coming to be understood that there is no authority for it in law, and no money fo pay its expenses. It has no power to administer oaths, and its decision will have uo legal foice whatever. The Cabinet had a two hours session. Soiae allusion was made to South Carolina aud Louisiana. The President reported progress ia forming the commission, exhibiting answers declining to serve. It is positively ascertained that Wheeler will not serve, and thai ftt adjournment Gov. lirowu was the only person who had uccep ted. Beyond this no information was vouchsafed. Was it Hydrophobia ??Elisabeth Klages, a three-years-old child of St. Nioholss svenue, near li!4tii street, N. Y., was bitten on the cheek near (lie ear by a dog about a month ago. The wounda were well esuterised, and healed. The dog waa not auppoaed to be rabid. On the 18th inst., however, the child waa aeiaed with convulsiona of the thorax and tipper extremities, ?nd died in about twenty-four hours. There waa no hydrophobia in the opinion of her physician, and he gave aa the eause of death "convuleiona, seemingly arising from irritation of 4P9 pneumegastrio nerve." Mr. Jefferson Davis, assisted by M^or W. T. Walthall, a well known literary gent|sw-rest* ding in Mobile, is engaged in writing a history - of .the part he took in the eventfhl struggle that resulted in the overthrow of the oopfedantoy. The younger Wilkes, about nine years of ago, called to the boy to stop striking his brother, as he had already killed him.
