which has been on trial four day* in the United
States District Court, before Judge title*, wis
concluded this morning, aad under instructions
from the Court, the jnrv rendered a verdict for
the defendant. The aotion. with seventeen otbera,
was brought against the company under the
civil rights act of Congress of March 1, 1976,
which imposes ft penalty of 9500 on any person
who should deny equal accommodation to any
citisen, regardless of previous condition, la hotels,
theatres and publie eon veyanoes. The plain- ,
tiff, a colored woman of Maryland, claimed to
. have been denied aooommedationa pa the eous- <
pany's.train in June, 1876, and was compelled,
as she alleged, to occupy a compartment oar
which was inferior, simply because of her raoe
or color. The company denied this, and proved
that colored persons had the ssiaa rights on ail
their trains as whites. The court, however,
heard arguments on the constitutionality of the 1
aci unuvr ius louriceutn tmenJaicul to the constitution,
nnd held:
1. That thcslaughter house cases (16 Wallace)
had determined that the privilege* belonging to
citizens of the United States, as such, were different
from the privileges belonging to citizens
of the State, as euch, and that only the former
were under ''jngressional protection ; that this
opinion had *>eeu subsequently atlirnied by the
United States Supreme Court.
2. That Ctc right to rid-j on a railway car for 1
purposes of local travel was not a privilege of ]
a citizen of the United States, as such, hut was
a privileg > belonging to a person by virtue of j
his State citizenship ; and therefore, for the denial
of such.privilege, the citizen must look for <
redress to the State tribunals; that it was not in j
the power of Congress to inflict a penalty lor the
denial ef such a privilege. The act, therefore,
was unconstitutional..
This opinion accords with that of Judge Ernroonds,
United States Circuit,.Judge for,the Sixth
Circuit, and Judge Sawyer, of California, and
-other Federal Judges.

March 21.?The store of Mr. Weeks, near Fort
Motte, having been burglariously entered last
week, a warrant was taken out for tho arrest of
the offenders, 1'avid Hart and lsiael l'inckney,
^^both colored. The proof's were conclusive beyond
deebt, and Captain F. W. Wannamakcr, Trial
^i^Justice under Qov. Hampton's appointment, sent
1 his constable to make the arrests.
The constable was resisted Keeten
rail and sent back. Captain Wannaraaker than
sent two others, who returned, not being able to "
? effect the arrest, as the two negroes defied all
law, and so replied. A prominent citisen, Mr.
Shirer, was next sent with nine others ; he, too,
returned with the information that the parties
had surrounded themselves with a crowd, and i
would not be taken. I
The question then was to submit to the humors 1
of a brace of desperadoes or enforce the law.?
Captaiu Wannamaker got together four white v
men, and came up with the offenders about eight *
miles from Lewisville. He recited his mission *
to Israel Pinckney, who seemed to be the leader
-of the gang of twenty that he found, all of
whom held drawn pistols. Israel replied that
"lliero was no law," and "he'd be d d if any ,
white man should arrest him." Captain Wan- '
namnkcr raised his pistol, as did Hart, and Cap- 1
tain Wannamaker fired, dropping him at once, t
The rest of the gang fled. ,
, Captain Wannamaker placed the wounded man
in care of nphysician, after capturing two others, 1
then came to Orangeburg to wait any charges,
^ if any, in these lawless, out-of-joint times. So
inuch for the procrastination polioy. The negro

five guns fired, the bulls penetrating the body in

his coffin, Head. Death was instantaneous ? ,
The body was placed iu the coffin und the crowd }
dispersed. There were about seventy-five persons
all told on the ground. Not a child or a ,
rclutive was there. The best order prevailed. t

demagogue, capable of prostituting what most

The Louisiana commission is losing ground.
It is coining to be understood that there is no
authority for it in law, and no money to pay its
expenses. It has 110 power to administer oaths,
and its decision will have no legal foice whatever.
The Cabinet bud a two hours session Some

The President reported progress in form- ,
iug the commission, exhibiting nusners decliu- j
ing to serve. It is positively ascertained that
Wheeler will not serve, and that at adjournment (

Was it Hydrophobia ??ttli/.&heth Khiges, a !
three-years-old cliild of St. Nicholas avenue, 1
near LMtli street, N. V., was bitten on the cheek 1
near the ear by a dog about a month ago. The
wounds were well cauterized, and healed. The 1
dog was not supposed to be rabid. On the 18th '
iust., however, the child was seized with con- '
vulsions of the thorax and upper extremities,
and died in about twenty-four hours. There
was no hydrophobia in the opinion of her phy- |
nician, and lie gave as the cause of death "con- ,
vulsions, seemingly arising from irritation of
nneumoirnstric nerve." i
Mr. Jefferson Davis, assisted by Major W. T.
M nlthali, n well known literary gentleman reai? '
ling in Mobile, is engaged in writing a history
of the part lie took in (lie eventful struggletbat
resulted in the overthrow of tho confederacy.
He carefully preserved all the historical materi
al that came into his hands during the war, and
an exceedingly interesting and valuable work
will surely he the result of his pen. The work i

out all hands liable on their Section to perform
Road duty, and put the samo in good order by
15th April next. AH Defaulters to be warned to
appear before the Board at the regular Meet ing
ou iho seoond Tuesday in May next, (8th).?
Overseers failing to obey this order will he turned
over to the proper authorities to be dealt with as
;helaw directs.
The reporting of any road not put in good or
