Montgomery anti the lion. Geo. II. Walter, Memnbers of the Ioard of Phosphate Comnissioners- (eritie men: It is ia imaitter of regret to the Coosaw Mining Company that it has been found necessary, inl order to pro tect their rights, to make any applica tion to the Courts, ani that soni ac commodation cotild not have been reached by which litigation woulil have been avoided. They have always de sired to live as Iaw abiding citi'zens, conducting their affairs on btusiness principles and avoiding all coinplica tions and litigation. But no alterna tive was left to them, and in taking this course they have only exercised the privilere guaranteed to every citi zen of having the rights which they claim to possess passed upon by the Courts of the country. While, however, the mat ter is t hus pending there arises a practical and business question upon which it may not be improper that I should a<ddrvss you. When the Act of the Ieneral Assemn bly of 1890 went into effect onl the 1st day of March, 161J1, out, of respect to the action of the General AsseIby, the Coosaw Company sulspended opf-er4a tions for the time heing, although they were advised that such legislation could not effect them in the exerrise of their previously acquired contrnct rights. liut they desired no conit with tle authorities, which, ai Iher learn, would have been brought atbout had they then continued ininig. They did not, however. waive in the least by such stoppage aiv rights to which they believed thelmselves enti tied, nor do they now deein it proper here to discuss their right to resmime such operations under te order of the Court. But they beg to say that tihey still earnestly desire so to ail,range with your honorable board that pending the litigation they may continue their op erations in strict compliance with all the laws of the State, anld under t ho supervision of the board. They are advised that by mittal con sent, and without reference to any or der of the Court already mwade, such mi arrangement can lie entilered into wit t out prejudice to the existing rights of ainy party, and by which t ie operations of the comlipany shall coltntinu duer the supervision of the board, and thus both the loLs of royalty to tihe State and damage to t he comipany can he avoided. The interests of the State arid the Coosaw Company are so closely inter woven that it is impossible to ai4ect one without the other. We do not, desire to injure or embarrass the State, an<u, of course, do not want to injure our selves. Any prolongedl suspension of' opera tions wvill, of course, cause serious dlam age both to the State and the c~ompany. Such dlamage) is nrot ontly loss of presenit revenue, but tire b)re*aking uip of ain estabishedi business of value both to) the company and( the State, amid which, if interrupted for arny lengthl of timue, it will be diflicult, if not impossible, to regain.
