Now York, March 31.-The nego
tiations for a now agreement for tho
bituminous coal minors carno to a
close thia afternoon when tho gene
ral scale committee of operators and
minors of tho central competitive
field ratified a contract embodying
the award of President Wilson's coal
commission.
This new agreemont, which iiir
volves a wage increase of 27 per
cent, becomes effective April 1 and
will continuo in force for a period of
two years.
-Must Not Increase Coal.
One of the features of tho new
contract is a clause which provides
that all "Internal differences" in the
various districts of the bituminous
coal fields will bo settled by tho dis
trict officers of tho mino workers and
operators. There must bo nothing
done, however, in adjusting these
matters that will increase the cost
of production or decrease tho earning
capacity of tho mine workers. The
new agreement also "condemns" the
bonus system now used by operators
in competing with each other for
employees. Tho contract provides
that all agreements In tho various
districts should contain a "penalty**
clause for any "stoppage of work"
or unauthorized strikes. The inter
national officers of the United Mino
Workers also agree to make tho
agreement binding in every detail.
Eight-Hour Day Continues.
The eight-hour day as now in ef
fect in the soft coal regions is con
tinued by tho new agroement.
Immediately upon ndoptio? of the
contract by unanimous vote of tho
members of tho company, it was
signed by the international officers
of the United Mine Worksrs, John L.
Lewis, president; Phillp Murray,
vico president, and Wm. Green, sec
rotary and treasurer, and by t'wo op
erators and two miners of each of
the four States of tho central com
petitive field-Indiana, Ohld, Illi
nois and Pennsylvania.

angel visited the home of Mr. and
Mrs. Mat Duncan at Easley the other
day and took their little darling baby
boy. Tho body was laid to rest in
the cemetery of tho Methodist church

W. H. Talley, of Salem, has received
his appointment as magistrate for
the Salem section. We believe that
Mr. Talley is the right man for the

Tlio roads in pur section are get
ting in such bad condition that it
is hard to go any place.
The new school building nt Salem
is now going up, and when com
pleted will be ono of tho largest
school buildings in this part of the
county. The building is 68 by 96
feet and has twelve rooms and an
8-foot hall through it.
Joe Bennett and M. L. Smith are
making a great success with their
planing work and aro now putting
up a grist mill. We believe that Sa
lem is coming to the front.
Will Sloan has recently purchased
a handsome Maxwell car. 'All that is
lacking now to give bim a great time
is a good road or two, and he says
that lie is hopeful on this score for
tho future.

Dr. L. A. Tannery, formerly a prac
ticing optometrist tof Westminster
and of Liberty, died Monday evening
lns Greenville, following a year or
more of protracted illness, at the age
of 52 years. Dr. Tann ry formerly '
resided in Seneca. He conducted a
ten-cent store hore, and was associ
ated in business with the late Mr. 1
Waite.
Dr. Tannery had resided in Green
ville for the past six months,, having \
moved there from Liberty, where he
conducted a variety store In connec- 1
Hon with his other work. Several 1
years ago he wont to Baltimore in
the hope of regaining his health and {
returned to Liberty much benefited.
.His wifo ,who was Miss Burgess, '
survives him, together with several 1
brothers and sisters..He was a mem
ber of tho Catholic church.

day afternoon at 5 o'clock from the
residence at 715 Buncombe street,

"Went Off" With Dynamite.
Charlottesville, Va., March 31.
Carrying twelve sticks of dynamite
to the top of a mountain near here
this afternoon, Grover C. Kenny com
mitted suicide by blowing his body
to bits.
Kenny had boon grieving over the
death of his wife. Shortly after tho
noon hour ho told his eight children
that he proposed to end his lifo. He
procured the dynamite and started
for the mountain top. His children
attempted to follw In an effort to
dissuade him, but wore forced to turn
back when their father began throw
ing rocks at them.
Reaching n peach orchard on tho
mountain top, Kanny placed dyna
mite on tho ground, lighted the fuse
and throw himself on tho explosive.
The roport shook the mountain-side.

Asheville. N. C., March 31.-The
United States Court having failed to
make a test case out of Cook vs. ID.
H. Jennings because of the failure
of the jury to agree on a verdict,
the Superior Court of Transylvania
county will next undertake a trial,
w iv ich all parties Interested hope will
result, in a decision by the highest
court deciding the responsibility of
tho defendant for damages resulting
from" the sweeping away of Lake
Toxaway dam by the 1916 Hoods.
The case, which is one of some forty
of the same kind, has been set for
trial at Brevard on April 16.
The suit is brought by two South
Carolina counties to recover from Mr.
Jennings $6,000, alleged lo be dam
ages' caused by tho sweeping away
of the two bridges in South Carolina
by the water when the dam broke
after tho great quins. Cary & Cary,
of Plckens, S. C., and Welch Gallo
way, of Brevard, will represent the
plaintiff, and 'Merrimon, Adams and
Johnston, of Asheville, and Chas. B.
Deaver, of Brevard, the defendant.
The case is interesting to lawyers
because, although there have been
cases of dams breaking in tho State,
none of them has reached the Su
preme-Court, lt is said, and there is
no decision to guide the Superior
Courts in deciding to what extent
the owner of a dam is responsible
when it breaks and causes damage
to other property. If the owner em
ploys the best engineers and builds
a- massive structure, sparing nothing
to make it safe, ts he hold responsi
ble If lt is swept away by a cloud
burst, or earthquake, or some such
cause? It is said to be agreed that
the owner would be Hablo if ho built
a flmsy'dam.
The people of tho Brevard and
Toxaway sections ore much Interested
In the case to bo tried because tho
rebuilding of tho Toxaway dam ls
dependent on the outcome of those
damage suits. And sections which
are interested in the development of
water powers are also watching these
cases because, if the courts decide
that the owner of a dam is responsi
ble for damages tb tt may take placo
by reason of tho dam breaking un
der any and all circumstances, they
will take second thought before be
ginning construction, since there ts
always the possibility of a cloud
burst, and while an earthquake ls
not likely to como this way, still, lt
is pointed out, there ls no guarantee
that it will not.

thorize by law the distribution of
nitrate of soda, which Secretary of
War Baker several days ago prom
ised Senator Smith, of South Caro
lina, to release to the farmers for

ing emergency.
On being informed of this hitch
in the program Senator ?Smith to-day
introduced and secured the immedi
ate Senatorial passage of a joint res
olution giving the requisite author
ity to the Secretary of War, with the
stipulation that the nitrate advanced
from the government munition
stores shall be replaced at a. later
date by the fertilizer distributors or
users obtaining it. The resolution
must pass the House and be signed
by the President before it becomes a
