TEXT OF RIMMING BILI. THE MEASURE DE8IQNED TO REFORM THE DISPENSARY. The bill popularly known as the Raysor-Manning bill, beoause it was the joint work o? Senators Rnysor, o? Orangeburg, and Manning, of Sumter, being the fruit of the ma tured thought and labor of these two men, who conscientiously believing that the dispensary system, properly and honestly conducted, oners, under the conditions prevailing in the State, not only the best, but the only prac tical and satisfactory means of con trolling the liquor traffic and mini mizing the evils that attend the use of any and all alcoholic liquors as a beverage, sought to frame a law that would purge the State dispensary of the corruption believed to exist therein, and so to hedge about the management with restrictions that the opportunity for graft and dis honesty in the purchase of liquor and other supplies whioh the law, as it utood, not only permitted, but ap peared to invite, would be impossi ble. Senators Kaysor and Manning, with the same object in view, viz to make the dispensary as nearly as possible a graft-proof business insti tution, whioh under the exercise of the police power of the State should control and regulate the liquor traffic, which is conceded by all to be an evil that of necessity must be regu lated and curtailed for the public good, worked independently at first, each preparing a bill to be intro duced in the Senate. When the Legislature convened they fonnd that their bills were drawn on simi lar lines and they, therefore, decided to jointly prepare a new bil!, utiliz ing the best features of each of the two previously prepared. The great est care was exercised in drawing this bill ; information and sugges tiens were sought from Senators and others who desired to purify the dis pensary system and make it the in strument for good that it was and is capable of being made. When the bill was completed and introduced in the Senate it at once came to be known as the Raysor-Manning bill Upon being referred to committee in the regular order, the bill was given thoughtful consideration and a rigid and;patient analysis. The result of the committee's consideration was a substitute bill, which embodied the distinctive features of the original bill, that being used as a frame work, and also the ideas of the committee and others who had made suggestions looking to the perfection of the pro posed new dispensary law. Among the suggestions thus embodied in the bill was one made by Senator Till man that liquor be purchased from United States bonded warehouses ex clusively. This substitute bill, whioh was in fact the committee's bill, although built upon the RayBor-Manning bili as a foundation, was still popularly known as the Haysor-Manning bill and by that title it is yet known. This is the bill that the House of Representatives rejeoted and practi cally refused to consider at all, after the effort to force the Morgan (House) bill through the Senate had failed. This i? the measure that is now the leading issue in the State campaign, and which is the dispen sary plank in the platform of Hon. Richard I. Manning in his campaign for Governor. Occupying as it docs, so important a place amongst the issues of the campaign, a synopsis of the bill will bo both interesting and instructive. Section 1 prohibits tho manufac ture, sale or keeping of spirituous, malt or other intoxicating liquor that is aged as a beverage, except as here inafter provided, under a penalty. Sec. ?nd f 1.00; all <lrugc>ta. detrimental to the morals, good health and safety of the Stato, and all such liquors may be seized wher ever found, without a warrant. It also prescribes the proc?dure to be followed by those wbo desire to im port liquor for personal use in order that they may do so legally. The expense of making tests of liquors to determine their purity is to be paid by the State Treasurer out of the funds of the dispensary in his hands, and not by the Board of Directors as heretofore. Section 2 repeals Seotion 556, whioh creates the State Board of Di rectors, and thereby abolished that board, the three members of which are entrusted with the management of a $8,000,000 business and paid only $400 a year apiece. This is one of the most important, as well as sen sible and necessary, reforms contem plated by the bill. The next seotion (3) is the most striking feature of the entire bill, as it contains the provisions tbat will wipe out the graft that has attended the purchase of liquor and other dis pensary supplies. It first provides for the election of a Commissioner at a salary of $3,000 per year, who shall be the executive board of the State dispensary. Hi? tenn of office is fixed at two years. The Governor is empowered to suspend the Commis sioner for cause. The Commissioner is required to advertise for twenty days, commenc ing the first day of March in each year, in two or more daily papers of this State, and one daily nowspaper in eaoh of the cities of Louisville, Cinoinnati, Ohio, Baltimore, Md., and Pittsburg, Pa., for bids to sup ply the kinds and qualities of liquors required for sale by the State dis pensary during the ensuing year, the same being specified in the advertise ment. These bids must be sealed, and without mark to distinguish them one from another, and sent by express within ten days of tbe last advertisement to the State Treasu rer, in whose custody they remain until opened, on Maroh 31st, in pub Ho, by a committee of three citizens, appointed by the Governor oo or be fore Maroh 20th. Contraots are to be awarded by this committee to the lowest responsible bidders for the several kinds of liquors and other supplies required. The members of the oommittee are to be paid $10 eaou per day and five cents mileage for each mile actually traveled, and they are ineligible for reappointment. All bidders are required to give good and sufficient bond as a guarantee of good faith for the performance of the obligation in the event of receiv ing a contract. The contracts must be approved by fhe Attorney Gene ral and tbe amount of bond shall equal 20 per cont of the estimated cost of the liquor or other supplies to be purchased. The kinds of liquor that shall be purchased are the following : Pure cologne spirits, or deodorized alcohol, 95 per cent from govern ment bonded warehouses. Two stamp whiskey, 50 per cent proof, from the bonded warehouses of the United States, with the understand ing that the State shall buy the whiskey on the warehouse certificates md shall pay the revenue taxes itself in order to insure its not being adul terated or tampered with. The three kinds of liquors, corn, rye and l>ourbon, shall be purchased in this way in the quantities, whioh, in the judgment of the Commissioner, will bo required by the demand in this State. It is permissible to make ?ontracts for each of the four kinds )f alcoholic products above desig nated with different persons for the mpply needed for the year, to be jrdered out by the Commissioner, as indicated, and the bidding for the different varieties of whiskoy shall ndicate not less than twenty differ mt brands of whiskey quoted on the narkct in the wholesale prices cur rent of tho various cities designated, rio whiskoy shall bo purchased for iso in this State that is less than one /car old as shown by the warehouse certificate. A record of all bids iball be kept in a book provided for ;hat purpose. The bids above des gnatod shall inolude whiskey one ?'ear old, whiskey three years old, whiskey five years old, and those -vhiskeys " "ie ages designated shall >e a basis n mixed with cologne ipi ri ts or sold just as they arc re ceived, for the different grades to be urnished the county dispensers. Tho Ik>mmissioner shall also, in tho same way, invite bide, to be opened and contracts awarded at the same time and in the same manner as hereinbe fore provided, for Cognao brandy, California brandy, peach and apple brandy, rum and gin in such quanti ties, with the right to purohase more, as may be in his judgment necessary to supply the demands. Theso bids shall specify the kinds and qualities of such liquors, and bids for wines, liquors and cordials shall be limited to such as may be advertised for by the Dispensary Commissioner as hereinbefore provided. Bids for beer (to be advertised for, opened, etc., as aforesaid.) shall designate the alco holic contenta, not less than 4 per cent, and the amount of malt and hopB to be used in its manufacture, and no beer shall be purchased that is not shown by chemical analysis not to contain salacilio acid, or any other adulterant, to prevent fermen tation. No beer shall be purchased except export beer, or that whioh is already in bottle and pasteurised and beer in kegs aged at least three months in cold storage. Bids shall also be advertised in the manner al ready provided in the purohase of liquors, and at the same time for sup plying the State dispensary with glass willes, demijohns, corks, labels, sealing wax, shipping cases, paper wrappers for the bottles, and all other needful supplies required in the conduct of the business of the State dispensary, and these shall be let to the lowest bidder, in like man ner as provided for the bidding for liquors, and a bond with good and sufficient sureties shall be required for the faithful performance of the contracts. The Commissioner hav ing ordered out the whiskey and cologne spirits of the kinds and qualities designated, is authorized and empowered to employ, for a period of four months, a skilled ex pert to blend the same under his di rection and supervision, in suoh a way as to supply as nearly as practi cable the liquors known to commerce, but which shall not in any way be adulterated by admixture of any in jurious or unhealthful ingredients, and in order to do this, he shall take out a rectifier's license from the United States government, and thus be enabled to rectify or mix the liquors which are required for the business. Such blending shall be done upon a formula that shall be posted in the Commissioner's office, subject to personal inspection by any citizen. The liquors thus mixed or blended shall be designated by the sigus x, xx and xxx and the age of the whiskey mixed with the cologne spirits shall constitute the basis, to wit : Whiskey one year old with the proportion of cologne spirits used, shall be designated as x ; three years old as xx, and five years old as xxx ; provided, That if there shall be a de mand for the straight whiskey, un mixed with cologne spirits, the same may be used instead of the blended goods, and the price shall be gov erned by the relative cost of the same and the labels indicate the charaoter of liquor, whether blended or two stamp. There shall be another brand, known as xxxx whiskey, which shall be whiskey bottled in bond, not less than seven years old ; or the same varieties of liquors as desig nated by the distillers' brand may be purchased from the bonded ware houses, as hereinbefore provided, in the barrel, and may be bottled at the State dispensary the same as other liquors are bottled. There shall be no oase whiskey kept in stock at the State dispensary. All such pur chases must be made upon special orders sent through the county dis pensers to the State dispensary by the person or persons desiring to ob tain same, and the State dispensary shall order the said goods shipped direct to the county dispensary. All whiskey, whether "blended" or "straight," shall be put up in bottles of full measure and labelled as here inbefore provided, and the proof, or alcoholic contents of each paokage shall be printed on said label, to gether with the price as fixed by the State Board, and tho grade of the whiskey shall be blown in the glass as x, xx, xxx or xxxx : Provided, This shall apply to only snoh whis key as may be bottled at the dispen sary, and it shall be a misdemeanor for the Commissioner to bott! ', labol or sell any liquors whioh shall rot be true to grade blown in the glass, pun ishable by fine or imprisonment, in the discretion of Court : Provided, further, That nothing herein con tained ah all prevent said Commis nioner of the dispensary from making distillers in this State contracts for the purchase of liquors manufactured by them within this Slate. Section 4 of the bill ameuds Sec tion ?58 of the Code so as to have the salaries of employees fixed by the General Assembly instead of by the State Board of Directors. The Commissioner is to be put under $75,000 bond, approved by the At torney General. The Commissioner is charged with the management and control of the State dispensary, sub ject to the provisions of the dispen sary law, and is empowered to enter into contracts and employ, or dis charge, the officers, employees and laborers necessary to the conduct of the business. He is forbidden, how ever, to employ any person who is related to him by blood or marriage within the sixth degree. Liquor sold to the county dispensers shall be sold at a profit not exceeding ten per cent of the cost to the State. The County Boards of Control are to be appointed by the Governor, by and with the advice and consent of the legislative delegation, or a ma jority of the same, from the respect ive counties, instead of by the State Board, as heretofore, and the Gover nor is given authority to remove members of the County Boards for cause. The County Boards of Con trol employ the dispensers and clerks, who are not to be related to them. The Commissioner, instesd of the State Board, is required to attach a certificate as to the ohemioal analy sis, purity, etc., to every package of liquor sold in, or brought into, the State. Any packages of liquor with out suoh certificate may be seized and sold as contraband, and the com mon carrier bringing it in may be fined. Beer dispensers are hereby ex pressly prohibited. The use of request blanks by county dispensers is required,, but hereafter these books shall be fur nished to the Auditors by the County Board of Coutrol instead of the State Board, and shr.U be paid for out of the funds of the county dispensaries. County Boards of Control are given authority to establish dispen saries and to designate their location, of which twenty days' notice shall be given. The establishment of a dispensary may be prevented by a majority of the voters of the town ship in which it is to be located sign ing a petition to tbe County Board, requesting that the proposed dispen sary be not established. The failure of dispensers to per form their duties is to be reported tc the Governor instead of the State Board of Directors, and be is re quired to forthwith institute propel proceedings to enforce the law Heavy penalties are fixed for thc violation of any of the requirement! of the law by dispensers. Dispensen are required to use the request books and report to the Auditor on or be fore the 10th of each month, and tc subscribe, to an oath that they have complied with the law in this respect. The sale of liquor to minors, intox i cated persons or persons in the habi of becoming intoxicated is forbiddei and fails to make accurate returns ai required by law, showing the tru< signature to every request by him re ceived and granted, or sells liquor U any person without first requiring i written request therefor, is liable t< a suit for $200 damages on tho bone of such dispenser, to be brought b; the Solioitor, who is r?quired t< bring suit when information i lodged with him. Permits to manufacture liquo may be granted by the Commissione under proper restriction, provided ii Section 13, which amends Sectioi 571. Section 10, the last seotion of th bill, is one of the most important and is as follows : Seotion 19. That Seotion G03, Vol II, Criminal Code of Laws of South Carolina, 1002, be amended by ad ding at the end thereof the follow ing : The said committee shall have the power to make, presoribe and promulgate, and the Commissioner shall enforce suoh rules and regula tions governing the conduct' of the offioers, employees and methods of business of the State dispensary, as, iu their judgment, may seem wise and proper, not iuconsisteut with law ; so that when so amended the said section shall read as follows : "Section 608. The presiding officers of the Senate and House of Repre sentatives shall annually appoint a committee, consisting of two mem bers of the House of Representatives and one Senator, whose duty it shall be to make quarterly examinations of the books and financial transac tions of the State dispensary for the fiscal year, beginning on the first day of November previous to the date of their appointment, and to make a written report of suoh examinations to the Qeneral Assembly at the ses sion next succeeding after their ap pointment. It shall be the duty of at least one member of said commit tee to be present at the taking of the inventory of the stock of the State dispensary at the end of each quar ter. "Each member of said committee shall receive the same per diem and mileage as members of the General Assembly, to be paid out of the dis pensary funds by warrant of the Dis pensary Commissioner on the State Treasurer : Provided, That no per diem be allowed to the members of said committee for more than twenty four days during any fisoal year. The said committee shall have the power to make, prescribe and pro mulgate, and the Commissioner shall enforce suoh rules and regulations governing the oonduot of the officers, employees and methods of business of the State dispensary as in their judgment may seem wise and proper, not inconsistent with law." Secretary of State Root will shortly arrive in New York from his attend ance at the Pan-Amerioan Confer ence. Secretary Root made a fine impression on the delegates from the other republics, and by his clear and eloquent speeches made it plain to them that the United States had no ulterior designs on any of them. He announced that this country would not interfere in the management of even the weakest nation, and let it be known that we would not allow interference from any European nation. His visit has resulted in a much more friendly feeling toward this country. Water now supplies 1,500,000 horse-power for eleotrieal work, about one third of it in the United States.
