fivo mile box was being summoned, (he case of
tho Kt ale vs. John Singleton, for assault and
battery, was called. This was au apical from
Trial Justice Hoke, and by consent (he judgment
of tho Trial Justice was confirmed.
At 12 o'clock M., lhere being no business,
court adjourned uni il 3 P. M.
In tho afternoon of Monday (ho Mooree were

pressing their readiness lo go (o (rial, tho
organization of a jury waa begun front thc
original panel, when tho following jurors were

On Tuesday morning at 10 o'clock thc court
proceeded to fill up tho jury from thc fivo mile
box as follows: Joseph M. Kelly, C. ll. Hesso,
F. F. Sharp, J. li. Hendrix, II. 1J. J. W. Schro
der, W, A. Miles, Henry Riemann. His Honer
appointed J. 13. Hendrix foreman, when (ho

posed lo show the cviiuc was committed at (lie
tinto 6ta(cd and in this county; (hat thc defend
ants, Americas nnd Riley Moore, did (ho act,
and Ihat Jerry Mooro and Aiken Mooro were ne
cessaries before (ho fao(; (hat (hey hail a mo
tivo lo bill Bryce to got back their land and re
turn to (his State; that three of (hem oroesod
into (his Stale, on thc morning of thc night
when Bryco was killed and returned next day,
nnd (hat they were (racked from Iho river lo tho
field of llryco and back lo tho river, tho tracks
being measured at various intervals. The jury
were told (bey were not required lo find who
killed l?rycc, bul whether (bc defendants aro Ihe
guilty parlies.
Mrs. Rebecca Cox sworn-ls sister of de
ceased. Killod in this county on 25th of Au
gust, 1870. Saw thc body befi ro entirely dead.
Killed in field ono hundred yards from witness'
house in thc night. Heard thrco guns. Went
to (ho plaoo and found hint dying. Saw twp
men that night running from thc place. Moon
was shining bright.
Cross examined-Full moon as bright as I
over saw it. Run towards (he spring. Can't
toll color of clothing. Livo near lite deceased.
Saw partios from houso about ono hundred yards.
Dr. W. A. Williams bworn-Was physician af
post mortem. Found tho body in Ibo houso of
deceased. Went there day after ho was killod.
Examined tho body. Found Hirco wounds-ono
on top of left arm; cut out flesh ncvcral inches.
Another on right sido low down, and ono in back
on right of spino near lower rib. Did not dis.
scot tho body. A small orifice in (ho righi, but
did not penetrate. Tho rib was fractured near
back-bono and tho orifico about th reo* fourths of
nn inch in diamolor. Saw no evidoncc of wound
in front. It was SUfllolOnt to produco death,
Am satisfied itemised tho death.
Cross examined-Cannot say whether Itryce
was'shot or not. Death might havo resulted
from paralysis or hemorrhages. Shot In back
entered nt lower edgo of right lung and ranged
upwards and out wards. Tho wound on arm and
in front was not necessarily fatal. Thinks
wound in back fatal.
Isaac Pointer sworn-Lives in Rabun cornily,
QA. Been (hove Iwolvo months. Had lived be
foro in South Carolina.' Know (ho four prison
ers and have known (hem four or five years.
They livo in Rabun. About May or Juno talked
willi (ho prisoners; talked about (heir, land j
Jiryco had golton. They spoke of tho hardship
of paying rent. This was Jorry and Amorlous
who wanted witness to holp them get tho land
buck. Said If witness would holp thought they
could got it baok. 'Amcrlous said II ry ce chinned
to hayo paid out uionoy for tho Moores, and
Amenons s fi ul ho lind found out Hryco had never
paid anything for thom. Thought ho ought not
to bo out out of his land. Said ho was going to
havo his Innd back on good or bad terms. Said
Bryce was too smart to law with and ho would
havo his hind if ho lind him to kill. Also talked
with Jorry Mooro. Ho took witness asido and
said, Ike, I want youtotako sides willi tho boys
and havo our Innd bnok. Said Hryoo had paid
nothing for them. Ho then said if ho would go
with tho boys they would go to Bryce's at any
(Imo. Said this was a good timo. Cobb and
Bryco were ut outs and if thoy should go then
and do tho work no ono would know it and it
would bo lnid on tho Cobbs TIIIB was about
two weeks beforo Bryco wss killed. Saw Jerry
no moro. Got word from Amcrious on Saturday
ovoning, August 23d. Witness snw him Sunday
morning at John Chapman's, somo six miles
from river. Heard a gnu fire Saturday night nt
Chapman's. Next morning went to Chapman's
and found Americus, Kiley and Aiken there.
Said they wanted lo seo witness. Witness did
not tnlk with them, but went off. Next saw
them In jail at Walhalla. Talked with them;
talked with Aiken alono. Said hoiv was his caso
going to go? Witness said can't tell. Aiken
said I nm ns innocent of killing UrycensGod in
heaven. Of courso I was on this sido of thc
river. Ho said ho stopped nbout tho Hound
Mountain. Witness said bc taw thc tracks, but
did not think ho saw thc (rack of Aiken. Ame
ricus lind a shotgun, Aiken a rifle and Kiley n
pistol when ho saw them nt Chapman's.
Cross examined-Jerry Moore indicted witness
for stealing a bec gum. Witness was an CY'I
dence afterwards against tho Moores in nn in
dictment for selling whiskey. Afterwards lind
a regular bailie and cut two of tho dofendinits.
Refused to answer w het her ho had boen con
victed of firing Moore's house and shooting
Jerry Mooro by tho light of tho lire, His Honor
ruling tho witness could not bc compelled lo
answer. Witness did not remember whether
witnesses nt Greenville swore Ibey would not
believe him on oath. Witness has never said
that he intended to have tho Moores put in tho
penitentiary or hung.
Marlin itamey sworn-Livo in Kabul) county,
Gu. Was not here last court. Mover heard
Jerry Moore 8ft*y any I klug about killing Bryco.
Aiken ouco talked with witness about two years
ago about going with him lo Bryco's and help
kill Bryco. This was at .Jerry Moore's house.
Saw none of tho Movies for two or throe weeks
before Bryce was killed. Don't know where
they were at thc lime of killing.
Cross examined-Tho Moni es lived in Georgia
at thc limo he talked willi Aiken. Can'l loll all
Ibo conversation nor what led lo il. He did not
oller lo hire witnesses.
Joseph II. Kelley sworn-Live five miles from
Walhalla. Haw Aiken Moore nt witness' house
len days before thc killing. Came and went by
witness' house. Said ho was coining lo seo
about their land. Said if they could not get
their land back it should not profit Bryce any
thing. This was na bo came down. Witness
was present at contract w*ith Bryce about, the
land. Bryce waa lo have tho land if he
had lo pay thc bond, of two hundred dol
lars, and if nul he was C, have the land

Franois Rigby sworn- -Lived in 1878 at
Bryce's place Saw all four prisoners lhere.
Heard Riley and Aiken soy they would have
their land back or hill Bryce. Never stayed
all night. Otimo six or Roven limes.
Cross-examined-Was in penitentiary with
Inn-hand. Put in for ton yearn, for arson.
Told Alex. Bryco of their threat ). Said ho
was not afraid of them, Told Jim Keith's
folks. Never told any one till after Bryce
was killed. Told Mary Keilli a day or two
after ho was killed or boon after. Wus not
a witness last Court.
Sarah Bigby sworn-Lived on Bryce's
place with father. Saw all thc Moores

Cross-examined-Was a little girl whon
Hurry Bigby was sent lo penitentiary. Never
told any ono.
John Chapman sworn-Lives in Rabun
County, (la. Remember? three Moore boys.
Stayed at witness' bouso on Saturday night,
tho 23d of August, Riley stayed Sunday
night. Seemed lo ho on a visit. Americus
and wife caine about midnight. After supper
Americus went oif and when he returned
the other two boys woro with him. Said
other boys wcro hunting a s'cer and he wai
to meet thom. Before gaiting back some one
shot off a gun. Aiken had a lille, Kiley ?
pistol ami Americus n shot gun. Stayed al
day on Sunday nt witness' house. Tho j

Found canoe forty yards below tho landing.
Found Wm. Ratnoy thoro hunting canoe.
Followed tho tracks of tho Moores and

between 8 and 9 o'clock in the morning.

Elias Wellbanks sworn-Live four miles thie
sido of thc river. Was working tho public road
tho day Bryce was killed. Saw A?ioric?E
Mooro that day on tho ridge about 12 o'clock.

towards Alex. Bryce's; was about four to five

Jonas Phillips sworn-Lives fivo or sis
miles beyond BrycO. First heard of Iiis
boiug killed Wednesday. Joined parties, who
were trnckiug. Went towards river fivo or
six miles to Hamey's canoe landing. Only
two tracks nt first. After going two milos
found another track and from there to thc
river. Thorn wore thrco tracks. Only went
to tho river. Novor carried tho trail back to
Bryeo's and did not go there. Ono track
larger than othor but about same length.
Tho brood track was half soled and had round
beaded tacks iu it. The heel was large. It
had tho appearance of worn heel irons.
Examined tho tracks which carno from below
the canoo landing. They seemed to bo tho
samo tracks. The smaller track had appear*
ance of worn heel irons. Tho heel wos
narrow. Did not measure tho third truck.

Thoy traveled part of time in woods and at
other times a blind trail.
Cross-examined-Measured tho tracks four
days ufter Bryce wa? killed.
Bnxtcr Roach sworn-Was with Phillips.
Got together at Phillips' house and about 2j
miles from Bryeo's. Had tracked to witness'
boneo on Tuesday evening. Began again
Friday morning und wont to river. Went
from Witness' field to Bryce's house and then
from Bryce's to field and then on to rircr.
Saw track in Bryce's fiold. Saw two tracks
tbcro which seemed to bo tho same that passed
through witness' field. A broad track and
nariow one, half soled and heel irons on broad
ono. Shed lives between witness' house and
river. They had left tho road there, but wit
ness did not follow them. Thrco-fourths of a
milctfurthor on tracks came again into field.

ponded in measurement and appooranco with
thc tracks in Bryce's field.
