Be it enacted by tho Sonato and House of Representatives of tho State bf South Carolina, DOW mot and sitting ia General Assombly, and by tho authority of the same: That tho plaintiff lo all aotions for tho recovery of realty bo, and is hereby limited to two aotions for tho samo and no more; Provided, that tho costs of the first action bo first paid, and tho second ootion bo brought within two years from tho renditiou of tho verdiot or judgment in tho first action, or from tho granting of a new suit or discontinuance therein. Be it enacted by tho Senate- and IIouso ! of Representatives of tho State of South ! Carolina, now met nod titting in (louerai ? Assembly, and by tho authority of tho sume: SECTION 1. That a Department of Agri culture is hereby croated and established which shull bo under oootrol and supervis ion of a board, which shall bo constituted as follows, to wit: Tho Governor, who shall bo ex ojfficio ohairman, Master of tho Stata Orango of Patrons of Husbandry, tho President of tho Stato Agricultural and Mechanical Sooicty for tho time being, and two other persons to bo cleated by tho Gen eral Assembly, who shall hold their office for two years, and until their suocosors oro olootcd and qualified. SEO. 2. Tho Board shall meet for tho transaction of business io tho oity of Col umbia as ofton cs they doom expedient, but at least twico in each year; thoy shall rccoivo no compensation but snail bo allowed, ex cept tho Governor, tho sum of three dollars per diem and iivo cents per milo aotually travolcd whilo engaged in tho duties of the Board, not exceeding fifteen days in ono year. SEO. 3. Thcro shall bo a Commissonor of Agriculture, who shall bo an agriculturist. Ho shall bo olootcd by tho General Assem bly and shall bold tho office for a tenn of two years, and until his successor shall bo elected and qualify; ho shall bo paid a sal ary of twenty one hundred dollars per annum, payable monthly, oed shull give bond with sureties conditioned for tho faith ful disoharge of tho duties and of his office; in the sum of ?0,000 to bo approved and filed in Uko manner as tho bonds of Stato oHiceis. Ho shall bo empowered to employ an efliciont clerk whoso salary shall bo 1,200 per annum, payable monthly. SEC. \. Thc board shall presoibo tho du ties of thc commisioner' and said commis sioner shall observe all rules prescribed and execute all orders issued by said Board uot inconsistent with law. SEC. ?. Thc boaid shall bo empowered to hold iu trust and cxccrciso control over donations or bequests mode to them for thc purposo of promoting tho interests and purposes of this uct. SEC. O. Tho board may prescribo forms for and regulato tho returns of such county agricultural .societies us tuny bo chartered by this State and furnish such blanks as may bo ncsccssary to securo uniform und reliable statistics of their operations. SEC. 7. Tho boord shall have power, and it shall bo their duty to prcsoribo blanks and bavo them issued, through tho com missioner, to tho auditors of tho various couutics, with complote instructions for tho collection of agricultural statistics and in formation; aud it shall bo, pud is hornby, m ado tho duty of tho couuty audit ors to fill all snob blanks, when filled, promptly to tho commissioner of agriculture. SEC. S. Tho board shall investigate su o h subjects relating to tho improvement of agrioulturo aud for tho inducement of im migration aud capital IIB they may think proper, including sheep husbandry, diseases of oattle aud other domestic animals and their eures, tho ravages of iuscots and remedies to abate thc sauio, fences, reduc tions of cost of same, &c. SEO. 9. Thc board shall have power in eases of confagcous disease among any kiud of Stook or animals to quarantine or baVO tho samo killed and burned. Sue. 10. Tho commisioner of agriculture shull preparo und keep iu tho department books of registry, wherein any person may have entered upon payment of registry fee of ono dollar for each tract, or lot, any real estate for salo, with terms, and til o in thc ofiico any plats descriptive popers, &o, de sired; also, books iu which may bo eulcred thc wants of laborers seeking employment or of employees,*- seeking labor, the registry foo of ouc dollar to bo paid by tho persoi: making, it and tho books open to inspection of all persons free of charge. SEC. ll. Thc commissioner of agrioul turo shall communicate, correspond and oo operate with thc commissioner of agrioul turo of thc United States, and receive fron bim and distribute most ad vantageously ul seeds, plants, documents aud information SEC. 12. It shall bo thc duty of tho com mission er to collect specimens of WOOt suitablo for manufacturing purposes, agri cultural, mineral and pltosphatio deposits o thc State, and deposit tho samo in his roon at tho Capitol, and cause correct analysis u such as may bo deemed expedient to b made aud recorded io a substantial book t bo kept for tho purposo. SEO. 18. Thc Board and Commissionc shall make an annual report of all thc pro occdings of thc department to tho Gcucra Assembly. SEC. 14. Tho Commissioner of Agricul lure shall bc ex officio Fish Commissionc of this Slate and shall bo charged with a the duties and invested with all thc powci of Pish Commissioner. SEC. 15. Thc Board provided for in tl first Section of this Aol shall have supe vision over thc fish interest and Comtnii stoner of this State, sud with tho supe vision and enforcement of thc laws at: regulations which or may bo enacted in th Stutc for tho salo of commercial fertilize and scods. SEC. 10. That tho office of phosplmto i spoctor and that of phosphate agent bo ar tho carno aro hereby abolished, ai that tho Agricultural bureau aro ohargi with all thc duties devolving on said ollie ncsccssary for tho protection of tho rigli and interest of tho Stato in tho phospha rook ?nd phosphatio deposits belongil thereto. SEC. 17. That tho board and oommision of Agriculture shall have power and a t hon ty to appoint nspcoial assistant to uttct to thc phosphate department and royal and said assistant shall rcceivo a salary 31,200 per annum, payable monthly. SEC 18 That all persons or oompani engaged in thc manufacture or salo of fe tilizors or commoroia) manures shull pay tho commisionor of npricultur twenty-li ocnts per ton for every ton of such fortil zer or commercial manure sold or offered I salo in this Stutc, tho said umouot to bc pa into thc Stato treasury for thc Oxolusivc u and benefit of the Department of Agriuu turo. Any person or offioer or agent of a corporation noglcoting lo pay tho sum pn vided in this section shall bo doomed gui! of a misdemeanor, and upoa conviction shall be fined in tho discretion of tho Court 1 which lino shall be paid into tho Stato ] treasury for tho exclusivo uso and ..benefit of tho Deportment of Agriculture. That every bagr barrel OT other package of such fertilisers or commercial manures as abovo designated, offered for salo in this Stato shall havo thereon a plaioly printed label or stamp, which shall truly set forth tho namo, location and trade marie of tho manufacturer; also tho ohomioal compo sition of tho contents of such, package and tho real peroontago of any of tho fol lowing ingredients asserted to be present to wit: Solublo and precipitated phosphoric acid, solublo potassa, ammonia or its equivalent ia nitrogen, together with tho dato of its analysis, and that thc privilege tax provided for ia Section 18 hos beca paid; and aoy suoh fertilizer os shall bo as certained by analysis, not to contaia tho ingredients and porcentugo set forth as abovo provided sholl bo liable to soizuro and condomtntiou and when ooudomocd shall bo sold by tho Board of Agriculture for tho exclusivo usc and benefit of tho Department of Agrioulturo. Tho Department of A?rioulturo shall have power and authority, at all times, | to have oolloctcd samples of any commercial fertilizers offered for salo in this Stato uud havo thc same unalyzcd, and such samples shall bc taken from ut least ten por cent of thc lot from which they may bo selootcd. SEC. 21. Tho department shall, us soon as practicable, prcpuro a convenient hand book, with tho necessary illustrative mops, whioh shall contain all accessary information ns to tho mines, minerals, forests, sol's or their products, climates, water and water powers, fisheries, mountains, swamps, in dustries and all suoh statistics as aro best adapted to give proper information of thc attractions and advantages which this Stato ' affords to immigrants and ?hall moko illus trative exposition thereof, wheoover practi cable, at International or Stato exhibitions. SEO. 22. That oil moneys arising from tho tax or lioenscs from fines and forfeiture, fees for registration of lauds for salo or employment wanted not heroin otherwise provided for shall bo paid into tho Stato ' treasury and shall bo kept on a separate account by thc trcaurer os a fund for thc exclusivo uso and benefit of Department of Agriculture; und until Buch fund can bo made available os aforesaid, the stun of 85,000 is borcby appropriated to tho support ? of this depart men t outof aoy moneys arising from tho phosphate royalty, und to bc drawn by warraut of commissioner, countersigned by tho Governor, cv officio chairman of tho ' Board of Agriculture.
