Cullen A. Battle related tho following story in tho course of his spcooh: During tho winter of 18G3-G1, it was my fortune to bo president of ono of thc courts-martial of the Army of Northern Virginiu. Ono bleak December morning, while tho snow covered the ground and thc winds howled around our camp, I left my bivouao Bro to attend tho session of thc court. Winding along for miles, uncertain paths, I at length arrived at tho court, at Hound Oak Church. Day by day it had boen our duty to try tho gallant soldiors of that army, charged with violations of military law; but never had I, on any previous oocasion been greeted by such anxious spectators as on that morn ing awaited tho opcuiug of thc court. (Jaso ofter caso was disposed of, and at length tho caso of "Tho Confederate Stales vs. Edward Cooper" was called-chargo do ??rtiou. A low murmur roso spontaneously from tho battle-scarred spectators as n young artilleryman roso from thc prisoner's bench, nni in response to tho question "Guilty or not guilty?" answered, "Not .guilty." Thc Judge Adv?calo was proceeding to open prosecution, when tho court, observing that tho prisoner was unattended by counsel, interposed aud iuquirod of the accused, "Who is your counsel?" Supposing that it was his purpose to represent himself be foro tho court, tho Judge Adv?calo was instructed to proceed. Every charge and specification against tho prisoner wos sustained. The prisoner was then told to introduce his witnesses. Ho replied: "I have no witnesses." Astonished at the oalmn08S with which ho seemed submitting to what ho regarded ns inevitable fate, I said to him: "Havo you no defence? Is it possible that you abandoned your comrades and deserted your colors without any rea son?" Ho replied-"There is a reason but it will avail mc nothing in a military court." I said: "Perhaps you are mistakoo; you aro charged with thc highest crime known to military law, and it is your duty to make known tho causes that influenced your ac tions." For the iirst timo his manly form trembled and his bluo eyes swam in tears. Approaching tho president of tho court ho presented a letter saying as ho did so: "Thora Gonoral ia what dono it." 1 opened tho lettor and in a moment my oyes filled with fears. It was passed from ono to tho othor of tho court until at last all had seen it, and those stern warriors who hod passed with Stonowall Jaokson through a hundred battles wept like little children. Soon us I sufficiently recovered my self possession, 1 read tho letter as tho defence of tho prison cr. It was io these words: "My door Edward: I havo always been proud of you, and sineo your connection with tho Confed?ralo army I have teen proudor of you than ever boforo. I would not have you do anything wrong for thc world; but boforo God, Edward, unless you oomo homo wo must die! Lost night I was aroused by littlo Eddie crying. ? oallcd and said: "What's tho matter Eddie?" and ho said. "Oh, mamma, I'm so hungry." And Lucy, Edward-your darling Lucy she never complains, but sho is growing thinner and thinner every day. And bu foro Ood, Edward, unless you come home wo must die. YOUR MAUY." Turning lo tho prisoner I asked: "What did you do when you rccoivod this?" Ho roplied: "I made application for a furlough end it was rejeotod; again I mado applica lion and it wns rejected; a third timo I mado application and it wns rejected, und that night I wandered backward and for ward thinking of my homo, with tho mild eyes of Buoy looking up to mc, and thc burning words of Mary sinking into roy brain; I was no longer tho Confederate sol dier, but tho father of Buoy and tho hus band of Maty, and 1 would havo passed thoso lines bad every gun in tho battery fi rod at mo. I wont to my homo. Mary ran to meet mc; her angol erins embraced mo, sud whispered: "Oh Edward, I mn HO happy? 1 am so glad you got your furlough?" REASSESS si E:.f OF RAILROADS.-Under thu act providing for tho Railroad Commis sinner tho Comptrollor mado an assessment on thc various railroads, in which oesesss mcnt thc Air Linc Railroad wns not included. Since thc assessment was made tho Supreme Court of tho United States has rendered a decision to tho effect that tho Air Line Railroad is Hablo to taxation in thc State of South Carolina; consequently thc Comp trollor issued a few days ugo a circular to ull thc Rai I roads iu tho State, calling for un amended return. As soon as this return caines in a new assessment will bo mude, including luis road. CHARLESTON, March 5 -John II Pen dcrgrast has been convicted of libel before Judge Mackey, at Kingstrce, and sentenced to two years' hard labor in thc penitentiary, or pay live hundred dollars fine and costs of | suit. Thc libel consisted in thu publica tion in the Western Rep?blicau of last November of a letter charging tho malingers of election at Kinnstrcc with stuffing thc ballot box nod charging certain citizens with voting moro th in once. Pondorgrast was one of tho principio witnesses before tho Teller Committee ut its recent session in Charleston. RONDOUT, N. Y., March 13 -There was groat disorder ut thc town of KingStotiporl to day. No ono but ling men was allowed to vote, taxpayers being assaulted and driven from the polls. The civil officers being unable to leprcss thc disorder, thc military was called upon. Great excite ment prevails. Thc polls aro broken up and tho board has gone away. Thc military cannot arrive on the ground in timo to do anything for to-day's election. Such costly pun ishmcnts arc a little too much for tho Tex ans and they think a liberal application of tho lash would control these petty criminals. Wc aggrcc with Texas papers, Corbin, after banning around the United States Senate for two yours in a vain attempt io possess himself of another man's property, announces his voluntary retirement from the contest. This is very kind of Corbin since his claim has been kicked out three or four times. That any person riding or driving upon tho sidewalks, or lead? ing a horse ar horses thereon, except to cross tho raine, or placing any obstruction thereon which may impede a freo piissngo, sbnll bo held guilty of a misdemeanor, and bo pun ished ut tho discretion of thc Council, within thc limits of their authority. Il shall bc the duty of the marshal to arrest nil persons guilty of misdemeanors or lighter crimes within thu corporulo limits nf thc town of Walhalla, by violation of tho laws of the State of South Carolina, or by violation of any ordinance of tho town of Walhalla, and bring them before tho Inten? diint or a Warden acting in bis slead, shall have power to pass such order in tho premi ses as in his opinion justice may require, consistent with the authority nf the Council, in such case provided. .^KC. 17 Be it further ordained.
