WASHINGTON, December 2.-In the
Sepremo Court to-doy Justice Field deliv
ered th" opiuion in tho cuso of Johu T.
Keith, plaintiff in error, against E. A.
Clark, oollcctor iu error to thc Supreme
Uourt fer the State of Tennessee. Thc
principal question involved io this cause is
whether tho Stete of Tennessee is obliged to
receive in payment of taxes tho now de
preciated notes of tho Hank of Tonnosseo
ns it hound itself to do by section 12 of thc
charter of tho bank in 1838; or whether
it can repudiate tliut contract os to notes
issued after Moy 0, 1801, on tho ground
that tho State government was then forci
bly soized by insurgents and its power
usurped. Thc case raises several Federal
questions of interest.
In the opinion delivered, Justice Miller
holds:
J. That lite theory that there can bo two
different political entities called Stutcs
within tho sumo geographical limits, one
loyal and one rebellious, is fanciful and
untenable, and there nover has been more
than ono political society in existence ns an
organized State of Tennessee from tho day
of its admission into thc Union in 1700 to
tho present hour.
2. Thero is no foundation for theory
which maintains such separation of the
pecediug States from tho general govern
ment as to make their legislation, while in
rcboliion, void and invalid unless rati
fied by positive laws enacted since their
restoration.
3. Thero is no evidence in thc case to
prove that tho issues of notes by thc Dank
of Tennessee niter May 0, 1801, were made
for tho purpose of aiding insurgents or in
violation of tho constitution and laws of thc
United States, and that consequently thc
contract which tho State mudo in 1838 to
tako thc notes of thc Dunk of Tennessee in
payment of taxes is and has all the timo
been under tho protection of the Federal
constitution.
Tho judgment of thc Supreme Court of
Tennessee is, therefore, reversed, and thc
caupo remanded for further proceedings in
accordance with this opinion. Justice
Bradley delivered a dissenting opinion,
denying tho assumption that tho govern
ments of the seceded Stated were lawful
governments. The Chief Justice also dc
livered a dissenting opinion.
NEW WAY TO FAY OLD DEBTS.-A
proposition has recently been mode that
tho national debt can now ho paid off by
tho imposition of unnuul tax of $20 on
"generals," 810 on "colonels," and ?5 on
"majors." There is no doubt of this. Tho
enormous revenue thut would accrue from
such a source would in ii very short time
wipo out thc entire debt. After this it
could bo applied to thc settlement of tho
labor question, as tho fund would be sufli
oicDt to moko n handsome distribution per
capita for tho whole country. It is a won
der that Butler and Mr. Kearney have not
thought of this bofuro. It would bc no use
to imposo a tax on tiny titlo below tho rank
of "major," for Captain Vance, thc appoint
mont olork of tho Treasury Department,
says so far as he can discover, ho is tho only
"oaptain" loft, either of thc Union or Con
federate armies. Thia is sad, but in lieu of
"oaptains"a tax might bc )nit) on "judges."
Even in tho present dull times there nrc
not less than two thousand "judges" in
Washington alone, nnd thc "generals" aro
simply countless. Mn ny or them doubtless
would find it d'idioult to pay the tax, but
sooner than port with thc titlo they would
manage to squeeze it out.

keep o sleeping room free from a musty and
unwholesome smell.

A slight, dry cough is sometimes au
attendant. The patient complains of
weariness and debility ; he is easily
startled, his feet are cold or burning,
and he complains of a prickly sensa
tion of thc skin; his spirits are low;
and although he is satisfied that exer
cise would bc beneficial to him, yet
he can scarcely summon up fortitude
enough to try it. In fact, he distrusts
every remedy. Several of the above
symptoms attend the disease, hut cases
have occurred where few of them ex
isted, yet examination of the body,
after death, has shown the LIVER to
have been extensively deranged.
