An Act to Amend un Act entitled "An Act
to Establish and ?Maintain a System ot' Free j
Common Schools for tho State of South
Carolina."
SECTION 1. Mo tt enacted by thc Scnato
and House of Representatives of thc State
of South Carolina, now met nod sitting in
General Assembly, and by thc authority of
; samo, That thc State Hoard of Education
shall consist of tho several County School
Commissioners and the State Superintendent
of Education, who shall bo ex officio Chair
man of thc Hoard, and who shall bo entitled
to voto ou all questions submitted to tho
Hoard. Thc Hoard may elect ono of its
members as Socrotaiy.
SKO. 2. That thc State Hoard of Education
shall hold its first mooting at tho Capital of
the State on thc second Wednesday after the
approval of this Act, and shall thereafter
meet on thc first Wodniisduy in October of
every year at tho Capital of thc Htato, and ut
such other times and places as thc olato Su
perintendent of Education shall direct. The
members of the Hoard shall bo entitled to re
ceive a mileage nt thc rate of twelve cents per
mile, going and returning from thc meetings
ot tho Hoard aforesaid, lo be paid by the
State Treasurer on presentation of a coi tWi
enie signed by the Chairman aud Secretary
of the Hoard.
Six. ii. That, for thc purpose of procuring
nu uniform system of text-books, lo be used
in the common and public schools throughout
thc Stale, there shall be a Commission uf five
appointed, to consist of His Excellency the
Govoriior( who shall bo.ee officio Chairman,
tho Chairman of tho Committee on Educa
tion of tho Scuatc und Hous3 of Representa
tives, and, for tlie purpose of selecting thc
other two members, tho Senate shall, by a
majority of votes, appoint one, and thc House
of Roprcscutatives sholl, in like manner, se
lect tho other : Provided, That the Cominis
sion heroin appointed, shall not have powei
to amend or chungo tho Hst of text book's ni
ready in usc until tho first of January, 1878,
unless authority bo granted to the Commis
sion by Act of the General Assembly u
amend the list aforesaid : And provided, far
(her, That thc Commission ?hall decide upon
a list of textbooks lo bc used in thc cool mor
and public schools throughout thc State, nm:

Education at its first session., Thc meeting!

as may bc deemed necessary, and of tnktnj

SKO. 4. That tho School Trustees of ever
School District shall make out and forward t<
tho School Commisioner of thc county whore
in such School District is situated, a list o
all text-books needed by thc persons uttntidinj
school, which list, when properly certified ti
by said Trustees, the School Oommissiono
shall approve and forward to thc Stnte Super
in ten dent of Education. The State Super
intendent of Education shall, as soon us prac
tieublo after the receipt of such list, forwari
thc books therein required freo of charge
And thc General Assembly shull, by appro
priation, provide for tho payment of the book
aforesaid.
Six1. 5. That tho Stato Hoard of Educa
tien shull take and bold in trust, for tho State
any grout or deviso of lands, and any gift o
bequest of money, or other personal property
made to it for educational purposes, nud shal
pay into the State Treasury, for safe kccpiii:
aud investment, all moneys and incoiyes froi
property so received. The State Treasure
shall, from time to time, invest all such mon
cy in tho nome of tho State, and shall pay t
thc Stato Hoard of Eduoation, on tho wai
rant of tho Governor, tho iucoiuc or principa

SEC. 0. That tho present S.tato Suporii

SKO. 7. That ho shall, before entering u

ved by tho Governor, conditioned for tl
faithful and impartial performances of tl

tho timo of giving bund, take and subscribo
tho oath prescribed in Section 30 of Ai tide
II of thc Constitution of tho State, which
oath shall bc endorsed upon thc back of said
bond, and thc bond shall bo tiled with, and
preserved by, tho Secretary of Stato.
SKJ. 8. That thc Stato Superintendent
of Education shall re?oive, ns compensation
for his services, tho sum of two thousand live
hundred (2,500) dollars per annum, together
with his actual cost of transportation when
traveling on public business, payable quar
ter-yearly out of tho^StatO Treasury.
SKO. ?. That lie shall have goncral super
vision over all thc common and public schools
of tho State, und it shall bc his duly, to visit
every County In tho Stato, for tho purpose of
inspecting tho schools, awaking un interest
favorable to tho cause.of education, nod diffu
sing as widely ns possible, by public addresses
j and porsoiitil communication with school ofii
cors, teachers mid parents, a knowledge of ex
isting defects, and desirable improvements in
tho government and instruction of tho schools.
SKO. 10. That ho shall secure uniformity
in tho usc of text books throught thc common
und public sohools of thc Slate, and shall for
bid tho use of sectarian or partisan books and
instruction in schools.
Bl'.O. ll. That ho shall prepare and trans
mit to thc several County School Commission
ers, school registers, blank certificates, re
ports, and other suitable blanks, forms and
printed instructions ns may bc necessary to
aid school ofiioci'S and teachers in making
their reports, and carrying into full effect tho
j various provisions of tho school laws of this
, State; and shall causo tho laws relating to
common schools, with such rules, regulation,
forms and instructions ns shall bc prc?oribod
by tho Hoard of Education, to bc printed,
together with a ouitablo index, in pamphlet
form, by thc person authorized to do thc
State printing, at tho expense of tho Slate;
and ho shall cause copies of tho same to bo
transmitted to tho several Cou?ty School Com
missioners for distribution.
SKO. 12. That it shall bo thc duty of thc
State Superintendent of Education lo collect

maps and charts as can bc obtained without
expenso to tho Stute; and ?lao to pur
chase, nt un expense not exceeding fifty dol
lars a year, rare and valuable worka, on cdu
tion, for thc benefit of lonohors, authors nod
others, who may wish td consult thom j and
thc said sum is hereby annually appropriated
for this purpose out of any moneys in thc
Stato Treasury not otherwise appropriated.
SKO. 13. That copies of all papers filed in
thc office of tho State .Superintendent of Edil

SKO. l-l. That tho State Superintendent
of Education shall submit, in his annual rc
port, a statement of his ofiioinl visit dur

though the Governor, to thc General Assoin
bly, at each regular .session thereof, showing

him, and to bo disbursed by tho said State

Sro. 22. That on the first day of January
j next succeeding thc date of his election, ho
! shall take and subscribe thc oath of offico
j prescribed in Section SO, Articlo ll, of thc
! Constitution of this State, which oath bc shall
j file in thc office of thc Clerk of the Court of
i i.ic County in which he was elected, and
I shall immediately ' enter upon tho discharge
lof his duties; ?ind upon his failure so to do,
j or ii" for any other cause there should bo a
I vacancy in thc oilico, thc Governor shall ap
! point a person to fill such vacancy, who shall
? qualify within fifteen days after his appoint
ment, and shall continue in office until thc
time prescribed for filling said office by elec
tion, as heroin provided; and should tho
person so appointed fail to qualify within tho
Hmo specified, such failure shall create a va
cancy.
SKO. 23. It shnll bc thc ditty of each
i County School Commisioncr to visit each of
tho schools in his jurisdiction, at least three
times a tenn, and to noto thc course and
method of instruction, and tho lr inches
taught, and to give such recommendations in
thc art of teaching and thc method thereof in
each school ns shall bc necessary and expedi
ent, so that uniformity in thc course of stud
ies, mid methods of instruction employed
shall bc scoured, ns fur as practicable, in the
schools of the severable grades respectively.
lie shall acquaint himself, as far as practica
ble, with tho character and condition of each
school, noting any deficiencies that may exist,
cither in thc government of thc school ortho
classification of its pupils, or tho method of
instruction employed in thc several brunches,
and shall tnnkc such suggestions in private to
thc teachers as to him shall tippcor necessary
to tho good order of tho school and tko pro
gress of tho pupils.
Ile shall note tho character and condition
of thc sohool houses, tho sufficiency or insuffi
ciency of tho furniture, and shall inako such
suggestions to thc several District Hoards, ns,
iu his opinion, shall seem conducive to tho
comfort and progress of thc pupils of the sev
eral schools, lt shall bc thc duty of each
County School Commissioner to aid tho tcnoh
ers in all proper efforts to improve thomselVes
in flit iv profession.
For this purpose ho shall nnoourogo tho
formation of associations of teachers for mu
tual improvomunt; he ahull attend tho meet
ings of suolr associations, and give such od
vice uud instruction in regard to their con
duct and management as, in his judgment,
will contribute to their greater efficiency.
Ile shall also doli ver a public lecture to the
people in eaoh of tipa scvorul Distriotfl of tho
County each year, for tho purpoao of eleva
ting tho standard education, and increasing
tho gctioral interest of tho pcoplo in public
schools.
SEO. 21. That it shall bo bis duty to seo

bo taught, ns faros practicable, orthography,
reading, writing, rriilrmotio, geography, En
glish grammar, history of thc United States
and of this Stato, and good behavior,
SKO. 25. Ho shall on or bcfoi tho first
day of Oct icrof caph year, forward to tho
Stato Superintendent of Kdnoation an exten
ded report, containing an abstract of rcportB
mado to him by. tho various school oflioors and.
tcachcre iu Iiis county, and showing tho con- I
dition of thc schools under his charge, sug
gesting such improvements in thc school sys- ,
tem us he may deem useful, and giving such ,
other information in regard to tho practical
opcratiou of tho common schools aud laws
relating thereto, os may bo deemed of public
interest; Ho shall also inoludo in his roport
such other mattera as ho shall bo directed to
report hy the Stato Superintendent of Edu
cation.
Ska 2G. That, should he fail to make thc
report required in thc proceeding Section, he
shall forfeit to thc school fund of his County
his lust quarter's salary of that year, and shall
also bc liable for all damages caused by such
failure.
SEO. 27. That he shall, at all times, con
form to tho instructions of the State Super
intendent of Education, as to matters within
thc jurisdiction of said Superintendent. Ho
shall serve as tho organ of communication
between the said State Superintendent and
school authorities. lie shall transmit lo
school officers, or teachers, all blanks, circu
lars, and other communications which aro to
them directed.
SEC. 2S. That each County School Com
missioner shall receive, os compensation for
his services, including expenses of transpor
tation within his County, an annual salary of
one thousand dollars, except the County
School Coiumissiouer of Charleston, who shall
receive nu anuual salary of one thousand
two hundred dollars, payable quarterly by thc
State Treasurer.
SEC. 29. Thc County Treasurer shall pay
over nil moneys by him received, which shall
have bcou assessed by virtue of tire vote of any
district meeting, as hereinafter provided for,
in thc County in which such district is situa
ted, on thc order of thc Clerk of tho Board
of Trustees of said District, countersigned
by tho County School Commissioner, to be
used for the purpose directed by thc District
meeting so held. Snid money shall bc as
sessed mid collected at thc time, and in thc
manner that County taxes arc assessed and
collected; and if thc inhabitants of any School
District, at their annual District meeting,
shall fail to provide for thc raising of such
tax, then thc County School Commissioner
of thc County in which such district is ?itua^
ted shall bc required to withhold from said
Diatriot that part of thc Stato appropriation
derived from tho revenue of thc Stutcya-ud to
apportion and distribute thc same to thc oth
er Districts of tho County which have com
plied with tho requirements of this Act :
Provided, That in School Districts where
there aro less than one hundred children be
tween the ages of six and sixteen, thc inhab
itants moy raise such a sum, per child, as
will bc sudioicnt to maintain their schools.
Sue. 30. That it shall bc thc duty of each
County School Commissioner, immediately
after the passage of this Act, to divido the
County into convenient School Districts, for
all purposes connected with tho general inter
est of education, and re district tho same,
whenever, in his judgment, thc general good
requires it. And every School District or
ganized in pursuance of tim Act shall bc a
body politio and corporate, by tho name and
style of Sohool District No -j (guch a nutu
ber as may bo designated by the Couuty
School Commissioner,) of-County, (tho
name of the County in which thc District is
situated,) Stato of South Carolina, and in
that name tony suo and be sued, and bc capa
blo of contracting and being contracted with,
and holding such real nod pcrsonul estate as
it niay^ come into possession of, by will or
otherwise, or as is authorized to bc purchased
by tho provisions of this Act, all of which
shall be used exclusively for school purposes.
Each School District shall bo confined to tho
management ntld control of thc Hoard of
School Trustees hereinafter provided for, who
shall hold their office for two years, and until
their successors arc appointed and qualified,
and the said Trustees shall bo exempt from
militia and road duty, and payment of poll
tax.
SOE. SI. That thero shall be, in each
County, a Hoard of Examiners, oomposcd of
tho County School Commissioner, who shall
ex oficio, bo Chairman, nod two other mem
bers, who shall bo appointed by thc County
School Commissioner, and shall hold office
for tho ter^i) of two years from tho timo of
their appointment; but no person shall be
appointed a member of' thc Couuty Hoard of
Examiners, who is not competent to teach a
first grade school.
It shall bo thc duty of thc County Hoard
of Examiners to examine all candidates for
thc profession of teacher, nod to give to each
person found qualified a certificate, sotting
forth the branches of learning ho or sho may
b*c cnpablo of touching. Such examination
to bo renewed every your, and no teacher shall
bc employed in any ot thc common or public
schools, without, a certificate from thc County
Hoard of Examiners, or thc Stato Superin
tendent of Education
SEO. 32. Thuttho Hoard of County Sohool
Examiners shall meet nt least twico u year, at
such places, nnd nt such times, ns the County
School Commissioner shall nppoint; that thc
County Sohool Commissioner sholl bo Chair?
ninn and Clerk of tho Hoard, and shall keep
a fair rcoord of their proceedings, and a reg
istor of tho nnmo, ago, sex, color, residence,
und dato of certificate of eaoh person to
whom a ccrtifioato is tssucd, and in onso a
certificate bo cancelled, shall mako a propor
entry of tho mano.
SEO. 33. It shall bo the duty of each Coun
ty Hoard of School Examiners to appoint for
ouch nnd every School District in their coun
ty throo School Trusteos, who shall hold their
office for two years, whoso duty shall bo as
hereinafter prescribed j and they ohnll have
power to fill, from time to time, all vacancies
willoh may occur in their rospootWo /Sohool

SEO. 84. Tliat tho said Trustees, withiu

SEC. 85. That it shall bc tho duty of tho
Baid Trustees, and two of whom shall consti
tute a quorum, to meet us soon and often as
practicable, after having been appointed and
qualified, at'thc pitreo which shall be most
convenient in thc District, and at their first
meeting they shall organizo by appointing
one of their number Clerk of thc Board, who
shall preside ut thc oflical meetings of the
Trustees, and shall record their proceedings
in a book provided for that purpose Each
momber of thc Board of Trustees shull be
duly notified of thc meetings by thc Clerk of
thc Board.
SEO. SO. That it shall bc thc duty of thd

management and control of thc local educa
tional interests of thc same, subject to tho
supervision of tho County School Commis-?
stoner, and to visit thc school at least once in
every mouth during the school term.
SEO. 87, That it oholl be tho duty of the
Trustees iu thc sovoral School Districts to
make, or cause to bc made, once in two yoars
iu each Schpol District, by tho first day of
September, an ennumcratiou of all tho chil
dren betwecu thc ages of six. (6) and sixteen
(10) years, resident within such School Dis
trio, distinguishing between male and female^
while and colored. And tho Clerk of said
Board of Trustees shall return to thc County
School Commissioner a duplicate return of
the same; each school Trustee shall receive
five cents per capita for each child enumera
ted by him, tho accounts for which shall bo
audited by thc County School Commissioner,
and paid according to law by tho County
Treasurer, out of the School Fund of tho
School District wherein thc enumeration was
made. Provided, That in case of the scho
lastic population of any. School District is
not made, as provided for in this Act, by that?
time, the County "?ioard of School Examin
ers is herewith authorized to appoint r.,iV
Trustees for such School District, unless for
good and sufficient oausc thc Trustees havo
failed to act.

School District at least two weeks before tho
commencement of any or every school term,
for thc transaction of any and all business
necessary to tho prosperity of thc school, with
power to adjourn from time, and to hold spe
cial meeting at any time or piaco.
Sr.c. 39 That the Board of Trustees shall
havo power to establish and mako all ar
rangements for thc common schools of Dis
tricts, and to make thc samo comfortable,
paying due regard to any school house al
ready built or site procured, as well as to all
other circumstances proper to bc considered/
so as to best promote thc educational interest/
of their District. They shall employ teach- '
ors from among those having certificates, ont?
discharge thc same when good and sufficient
reasons for so doing present themselves j but
they shall employ no person to teach iu any
of the schools nuder their supervision, unless5
such person shall hold, at time of commen
cing his or her school, a certificate to teach,,
granted by tho County Board of School Ex:"
nmincrs, or by thc State Superintendent of
Education.
SEC. 40. That should tho Board of Trus
tees be unable otherwise to procure sites for/
school houses, they arc hereby,authorized to
appoint a jury of view of five legal voters of
thc county, who shall locate said site as tho"
public interest may require, but, except in
a city, town or village, said site shall not bo
located within two buudrcd yards of tho
dwelling of the owner of thc land taken for
said site without his consent, given in wri
tiag. Tho said jury shall assess tho value of
the same and report their action to thc Board'
of Trusties, who shall secure tho titlo and
pay for tho site, as decided by tho jury of
view, out of any moneys available for that pur
pose ; and upon such payment thc titlo shall'
immediately vest in thc Trustees nnd thoiir
successors in ofiico.
SEC. 41. That if any person or persona?
shall threaten orin any manner interfere with?
tho jury of view heroin directed to bo ap
pointed, while discharging tho duties herein
prescribed, he or they separately or conjoint
ly, shall bc deemed guilty of a misdemeanor,
ind on conviction in any Court of ompctous
lurisdiction, be fined not more lhau two hutt*
Ired dollars, or bo imprisoned not moro than'
lincty days, or shall stiffer both fine and im
prisonment, at thc discretion of tho Court,,
md any moneys accruing from such fiucs shalt

Sr.c 42. That, when it sliall so happen thatf
