NEWBERRY, S. C.
. Wednesda Morning, April f8, 18E9.
We invite attention to the following let
te1 ' recently--addressed . by tho Act ing
:olicitor of Newberry County, to Gov
ernor Scott, in reply to a notw written
by the Govert.or through his Secretary to
Sheriff Paysiniger, which communication
we regret that the Sheriff has nisild.
It is said to contain serious charges against
the dignity an'd honor*ofthe citizens of the
County. We are satisfied that the im
putations are without foundation in truth.
Newberry has never been in a more quiet
and orderly condition ; and but for those
who live by creating evil for political ends,
we should very soon have peace, com
fort and comparative prosperity.
MEsSRS. EDIToRs: You will oblige me.
by pntbli.hing the sutjoined letter. I wrote
at in reply to one addreaaed by one Dr.
Robert K. Scott, (who is by courtesy, styled
Governor of South.Carolina), to :he Sheriff
of Newberry Gounty. Personally, I care I
nothing for the matter ; but I felt it my
duty, as acting Solicitor, to clear the Coun
ty of Newberry from the violent and ground:
less accusations made against it. Dr. Scott
is quite in a rage, I learn ; and one Mr.
Selby (who is said to edit a little sheet in
Columbia), is also unwilling to see the good
citizens of Nenberry exonerated. I there
fore call upon you to make public, a state
ment of which those two distinguished
gentlemen are afraid.
J. F. J. CALDWELL.
.VEWBERRY COURT IIOUSE,
March 29tii, ISt9.
To His Excellency
GOvERNOR R. K. ScoTT-SIR : The Sheriff
of Newberry ('ounty shemed me during the
recent session oh the Court, at this place, a
letter which you bad addressed to him,
through your private Secretary, it, regard
to certain-acts of violence, alledged to have
been cotunited on the premises of G. G
Dewalt, and in the neighborhood of Poma
tia, in this Cou::ty. I feel it my duty as
acting Solicitor, to reply to the charges and
th:eatscontainted in that letter.
Your Excellency, as it appears to me, has
improperly charged the Sheriff. Even un
der the net regime, I conceive that it is not
the duty of the Sheriff to bring before the
Grani Jury, all di-rttrbatnees th,it may oc
cur in his County ; because he is not the
officer to wa!.on any one makes complaint,
and therefore he caaaot-be expected to be
infornied as to any criminal complaint, ex
cept by heat-sar. 'the letter which I have
previously spoken of. shonld hav. been ad
dressed to n:ie, as the officer repreet.ting.
the State. of Sot h Carolina.
But I waive the inaformalhity. So s->on as I
ha d notice of your letter, I proceeded to
investigate the comtl..ants made. I called
the attemion of thet Grandl Jury to the mit
ner ; I sent G. - G. De-Walt before them,
-tnd when he failed to give them such in
formaation as won'ad warrant them in manking
a presen'menlt against anay one, I sent out
thae Slum;iff to sa est and bring before the
Court, n'tiy And a:! persons who could or
woirdd give inah.rmiato. I brought thae
mlatter before the Gdurt a seconadti9pe;
when those meana failed, I persuaded his
Honor Judge Rutl.:nd, to charge the Granad,
Jury againa upon the su'bject; I sent again
for witntesses ; 1 went to th-e Grand Jury
roonm and instructed tdienm as to 'heir duty.
It all availed nothing. No particle of in
telligence could be elicited, and there was
cons- quently, no indliotmnat made out.
The conviction is therefore, -forced ann
me, thaat only mielicious'persona *have mae
these represenatations to y ou -persons whose
sole delight consists ini toameiting dhiscord
between the two races and the t wo Political
parties in this State. The Cousta have al
way a been ope-n here far all persone of what
ever race or social positiona. We are a
laab~tidin: people. We desire that every
,absall be secured iaa liae, libertv and
property. We t tint peace, and we insist
upon ju-tice. Give uzs ah.,t !
