The burning of a dwelling had been charged to the night riders, threatening letters had been received by good citizens and s:gn3 posted telling what they proposed doing. Sheriff John E. He admitted iu the lower court that he called often and stayed late and that he really cared for her. He talked marriage to her many times, but when he found that she had said she never wanted to be a mother he refused to make an engagement for marriage. He qnit calling at the home and later Miss Reynolds brought suit for breach of promise. The court held that no particular form of ^ords was necesary for an engagement and that simply discussing the marriage relation was not to be considered an express contract of marriage and when Curry had Jfound that Mary Reynolds objected to children there was nothing to prevent his stopping his attentions there and then.
